On Wednesday, anonymous hackers took aim at companies perceived to have harmed WikiLeaks <http://topics.nytimes.com/top/reference/timestopics/organizations/w/wikilea…> after its release of a flood of confidential diplomatic documents. MasterCard <http://topics.nytimes.com/top/news/business/companies/mastercard-inc/index.…>, Visa <http://topics.nytimes.com/top/news/business/companies/visa_inc/index.html?i…> and PayPal, which had cut off people's ability to donate money to WikiLeaks, were hit by attacks that tried to block access to the companies' Web sites and services. To organize their efforts, the hackers have turned to sites like Facebook and Twitter. That has drawn these Web giants into the fray and created a precarious situation for them. Both Facebook and Twitter --- but particularly Twitter --- have received praise in recent years as outlets for free speech. Governments trying to control the flow of information have found it difficult to block people from voicing their concerns or setting up meetings through the sites. At the same time, both Facebook and Twitter have corporate aspirations that hinge on their ability to serve as ad platforms for other companies. This leaves them with tough public relations and business decisions around how they should handle situations as politically charged as the WikiLeaks developments. Some internet experts say the situation highlights the complexities of free speech issues on the Internet, as grassroots Web companies evolve and take central control over what their users can make public. We want to set the record straight. As a global payment service that moves billions of our customers’ funds across borders and across jurisdictions, we are required to comply with laws around the world. Compliance with these laws is something we take very seriously. PayPal’s Acceptable Use Policy states that we do not allow any organization to use our service if it encourages, promotes, facilitates or instructs others to engage in illegal activity. This policy is part of an agreement we’ve made with our account holders and with the companies that allow us to process global payments. It’s also an important part of our commitment to protect our customers and to ensure our business can continue operating around the world. In 2008 and 2009, PayPal reviewed and restricted the account associated with WikiLeaks for reasons unrelated to our Acceptable Use Policy. As soon as proper information was received from the account holder, the restrictions were lifted. The account was again reviewed last week after the U.S. Department of State publicized a letter to WikiLeaks on November 27, stating that WikiLeaks may be in possession of documents that were provided in violation of U.S. law. PayPal was not contacted by any government organization in the U.S. or abroad. We restricted the account based on our Acceptable Use Policy review. Ultimately, our difficult decision was based on a belief that the WikiLeaks website was encouraging sources to release classified material, which is likely a violation of law by the source. While the account will remain restricted, PayPal will release all remaining funds in the account to the foundation that was raising funds for WikiLeaks. We understand that PayPal's decision has become part of a broader story involving political, legal and free speech debates surrounding WikiLeaks' activities. None of these concerns factored into our decision. Our only consideration was whether or not the account associated with WikiLeaks violated our Acceptable Use Policy and regulations required of us as a global payment company. Dopo qualche giorno di ulteriori letture e riflessioni, ho provato a scrivere di nuovo sul caso Wikileaks su La Stampa di oggi. I vostri commenti (critiche incluse) sono i piu' graditi. ciao, juan carlos *Libertà di stampa oggi significa libera Rete* JUAN CARLOS DE MARTIN La discussione intorno al caso Wikileaks è stata finora sconcertante. Molti, infatti, sembrano aver dimenticato - spero solo momentaneamente - conquiste acquisite da decenni. Su tutte, i due pilastri che reggono la libertà di stampa dai «Pentagon Papers» (inizio Anni 70) a oggi: da una parte, lo Stato ha diritto di fare tutto quanto in suo potere per ostacolare la fuoriuscita di informazioni oggettivamente riservate; dall'altra, la stampa ha pieno diritto di pubblicare quanto le viene recapitato - basta che faccia notizia. Una discussione «senza inibizioni, robusta e la più aperta possibile» è, infatti, ritenuta da decenni essenziale all'emersione della verità e alla formazione di una pubblica opinione consapevole, anche a costo di qualche eccesso e anche a costo di divulgare segreti. Ma allora qual è il problema con Wikileaks? Wikileaks, infatti, non ha rubato, hackerato, sottratto alcuna informazione; ha semplicemente pubblicato documenti che ha ricevuto (Wikileaks offre una buca delle lettere online sicura), dopo averne verificato la veridicità e dopo aver ritenuto che facessero notizia. Esattamente come avrebbe fatto un qualsiasi giornale. E, infatti, nel caso specifico dei dispacci diplomatici americani, così hanno fatto alcuni tra i più rispettati e influenti giornali al mondo, come il New York Times, Le Monde e Der Spiegel. Dovrebbe, quindi, essere naturale concludere che Wikileaks si colloca pienamente nel solco della libertà di stampa così come intesa in tutte le democrazie avanzate e come tale venire apprezzata come qualsiasi altro mezzo di informazione. In questi confusi giorni, invece, molti riescono a sostenere che la medesima azione è contemporaneamente normale e criminale, a seconda se a farla sia il New York Times o piuttosto un gruppo di cittadini guidati da un australiano anticonformista.
