This follows a consultation to which both COMMUNIA and La Quadrature du Net had answered. I have not yet analyzed the report, but they seem to make a lukewarm endorsement of some of our recommendations. Ex: Very lukewarm, close to cold: 4.1.5 Many cultural institutions from across Europe claim rights on digitised material that is in the public domain. In other words, they assert new rights that would have been created by the digitisation of the material. The basis for such claims is, however, not always solid, and the situation may varyfrom one Member State to the other, depending on the copyright legislation of the country concerned. This can lead to a situation where digitised objects are protected in one country and not in another, which is particularly problematic in a cross-border context. Good: 4.3.1 The Comité feels strongly that public domain material digitised with public money should be freely accessible for all. This should be part of the funding conditions for the digitisation of public domain material across Europe. Starts well, and continues badly (in my opinion): 4.4.1 Public domain material digitised with public money should be freely available for non-commercial re-use by citizens, schools, universities, non-governmental and other organisations. 4.4.2 The Comité also recommends that cultural institutions make their digitised material available as widely as possible for commercial entities to build upon. This will stimulate the use of the material for new information products and services. 4.4.3 Cultural institutions can, however, ask private companies to pay for the commercial re-use of the material, in order to recoup the digitisation costs and finance further digitisation. This could be done on the basis of a one-off payment or through revenue-sharing models. Specific partnerships between cultural institutions and smaller companies or universities could be considered, in order to stimulate the re-use of the digitised material for innovative information services. Overall, they should read better the Public Domain Manifesto and our policy recommendations : if a digitized version of a public domain work is in the public domain there is no legal basis for making conditions on its reuse (it is actually contrary to fundamental right to create any). You can create taxes, public trusts, statutory contributions, or voluntary resource pooling to raise resources for digitizing. Philippe

Radio Free Europe / Radio Liberty January 05, 2011 Democracies Confront Their Own Growing Censorship Tendencies by Arch Puddington, Christopher Walker The murders of journalists in Russia, the jailing of bloggers in China, and the crackdown on the media in Iran regularly remind us that freedom of expression is under duress, even in an era of expanding global communications. However, considerably less attention has been paid to a new, more insidious threat to this fundamental human right. It involves campaigns by a variety of actors --- from foreign governments and business moguls to the Organization of the Islamic Conference (OIC) --- to discourage journalists, scholars, nongovernmental organizations (NGOs), and others from speaking out or publishing material on certain subjects. This creeping censorship is manifesting itself in venues including the United Nations, the judicial systems of established democracies, and elsewhere. Often, the objective is to place restrictions on what people can say or publish about Islam. But the offensive is also being carried forward by others, including oligarchs in the former Soviet Union. *Targeting Democracies* The focus of the free-speech debate has traditionally been on societies where freedom was lacking. What really sets apart this contemporary strain of censorship, however, is that it is increasingly focused on restricting information and opinion in Europe, North America, and other bastions of free expression. Today, standards in democracies are the target. Consider the following developments of the past few years: -- Two units of the UN system, the General Assembly and the Human Rights Council, passed resolutions that call for restrictions on what people can say or write about religions, especially Islam. Those days are long gone -- unless you or your users connect to the Internet via Comcast, the giant cable network that delivers television and broadband connectivity to millions of customers. In a stunning display of arrogance, Comcast is stopping Zoom Telephonics from providing cable modems to its subscribers by imposing a ridiculous set of conditions. How ridiculous? In addition to meeting unrealistic standards about heat resistance and packaging, Zoom would be forced to pay business-class airfare and hotel accommodations for Comcast employees who journey to Asia to approve Zoom's modems, according to a complaint filed with the FCC [PDF]. ...... Looking back on the project decades later, Franklin wrote in his autobiography <http://books.google.com/books?id=6wJSqhFuSt4C&pg=PT88&dq=%22these+libraries…> that the growth of lending libraries had played a role not only in educating but also in democratizing American society. "These Libraries," he wrote, "have improv'd the general Conversation of the Americans, made the common Tradesmen & Farmers as intelligent as most Gentlemen from other countries, and perhaps have contributed to some degree to the Stand so generally made throughout the Colonies in Defence of their Privileges." Lending libraries may have been the newfangled democratizing factor of their day. Centuries later, though, the United States finds itself trailing Europe and Japan <http://www.ndl.go.jp/en/cdnlao/meetings/pdf/Open_Seminar_%28Japan%29.pdf> in creating the modern equivalent: a national digital library that would serve as an electronic repository for the nation's cultural heritage.
