The decision represents a victory for cancer patients, researchers and geneticists who claimed that a single company's patent raised costs, restricted research and sometimes forced women to have breasts or ovaries removed without sufficient facts or second opinions. But the court held out a lifeline to Myriad Genetics, the company with an exclusive patent on the isolated form of genes that can foretell an increased genetic risk of cancer. The justices said it can patent a type of DNA that goes beyond extracting the genes from the body. The complex scientific case was perhaps the most important on the high court's calendar other than its more celebrated cases involving same-sex marriage, voting rights and affirmative action. And unlike those cases, which are expected to divide the court sharply along ideological lines, the controversial concept of gene patenting gave all nine justices something to agree on. The decision was based on past patent cases before the high court in which the justices ruled that forces of nature, as opposed to products of invention, are not patent-eligible. Since 1984, the U.S. Patent and Trademark Office has granted more than 40,000 patents tied to genetic material. Armed with those patents, Myriad has tested more than 1 million women since the late 1990s for mutations that often lead to breast and ovarian cancer. Most women who want testing must pay its price — $3,340 for the breast cancer analysis and $700 for an additional test that picks up a genetic link in about 10% of women who test negative the first time. Myriad officials say about 95% of its patients receive insurance coverage, often without co-payments, so that most patients pay only about $100. Myriad and a broad array of industry trade groups argued that without patent protection, research and development would dry up. Doctors, geneticists, women's health groups and cancer patients contended that competition would lower prices, improve outcomes and lead to more discoveries. The two sides had battled to a draw in lower courts: A federal district court in New York sided with the patent's challengers, while a divided court of appeals that handles patent cases ruled for the company. During oral argument in April, the court was presented with opposite interpretations of Myriad's contribution to genetic research. Christopher Hansen, the lawyer for the American Civil Liberties Union representing the patent's challengers, said Myriad had invented "nothing." Myriad's attorney, Gregory Castanias, said the company created "a new molecule that had never been known to the world." The justices generally agreed that Myriad deserved credit for its process of isolating the gene and its use – but not for the gene itself. "In isolation, it has no value," Justice Sonia Sotomayor said. "It's just nature sitting there." But the compromise that emerged Thursday was evident during that 65-minute debate. ------------------------------------- Il CONTROLLO: combatterlo o vincerlo? ------------------------------------- Per l'ennesima volta guai, derivanti dalla inadeguatezza di sistemi sociali risalenti ad oltre un secolo fa, vengono scambiati per errori e trattati come fossero fatti occasionali. Invece di capire, una buona volta, che abbiamo a che fare con un arcaico disegno della società, che non può che produrre in continuazione sciagure d'ogni tipo, si affronta ancora il controllo come fosse un irripetibile, maldestro errore dei sistemi. L'ipnosi di massa in cui è caduta l'Umanità ha avuto una genesi ed attori difficili da evitare, da mettere in discussione. E' però tempo che persone ragionevoli e raziocinanti notino l'errore madornale, di combattere aggressioni (come appunto il controllo) da parte di sistemi rimasti com'erano quando nacquero ai tempi delle monarchie senza decidersi a cambiarli, non perdendo un altro solo minuto oltre il mezzo secolo già buttato via. Saltiamo tutti i passaggi, per altro linkati a piè di email, ed arriviamo direttamente alla sintesi: Il tipo di pubblici dipendenti (che attorniano un governo ed adempiono ai suoi ordini) influenza in modo determinante l'operato del governo stesso: - fiancheggiati da acritici statali, o da operatori privati para-statali, i governi scadono nell'AUTORITARISMO, - avendo attorno coinvolti cittadini, ché partecipano a tempo determinato, i governi assurgono all'AUTOREVOLEZZA. Chi ha il desiderio di vivere in società completamente diverse da questi obbrobri, chi ardentemente spera che le cose non si limitino a migliorare ma inizino propriamente a girare come devono, faccia adeguato spazio nella sua mente per farvi entrare, belli comodi, operativamente a loro agio, i due Principi della Democrazia. La Democrazia non è quella camuffata tirannia cui siamo stati lungamente addomesticati a scuola, università ed associazioni e che ancora oggi vediamo far danni ovunque nel mondo. La Democrazia è una funzionale organizzazione della società basata sul (ed imprenscindibile dal) coinvolgimento e rispetto dei suoi singoli componenti: 1) quanto di pertinenza e proprietà della Collettività va CONDIVISO, 2) quanto di pertinenza e proprietà della Persona va RISPETTATO. Il Pubblico Impiego è parte determinante di quella Res Publica per conquistare la cui sovranità in molti persero la vita. Il senso primo ed ultimo della Democrazia sta appunto nella condivisione (nella partecipazione a tempo determinato) di TUTTI i pubblici incarichi, da quelli più umili a quelli di più elevato rango, della Res Publica. "Licenziare" gli assunti a vita (o precari aspiranti tali) nel settore finto-pubblico non solo NON è peccato ma è doveroso. Perché è proprio nel periodico rinnovo degli incarichi pubblici che si configura la Democrazia. Proprio sostituendo ai tirannici figuri statali democratici cittadini che si alternano, questi conosceranno il rispetto. Capiamolo ordunque: a che pro portare avanti insipide scaramucce che, invece di buttarli giù, ossequiano i sistemi tirannici ed i loro dispotici membri contribuendo a mantenerli al potere? Non ci facciamo ingannare oltre dai "professionisti", siano essi statali od operatori privati. Alcuni professionisti fingono di esser dalla nostra parte ma in realtà avallano il marcio sistema di cui son parte limitandosi ad un'azione di superficie, ad un maquillage che sempre nasconde la orripilante faccia di un'estesa tirannide spacciata per Democrazia. Non essendoci ancora un collegamento neuronale diretto tra noi umani, ben sapendo che trasmettere consapevolezze (entità ben diverse dalle informazioni) richiede passione e tempo, non mi resta che invitarvi ad esplorare il sito linkato qui sotto. In pochi giorni di studio e riflessione recupererete lunghi decenni dissipati in politiche finto-alternative, ché costantemente pilotate da membri del sistema spacciantisi per amici/compagni. Liberiamo le Res Publica d'Italia, d'Europa, del mondo intero dai tiranni! Finisca in un museo il SISTEMA CHIUSO e PROPRIETARIO in mano agli assunti a vita.
