Related News No, according to the 300-page report issued this month by a panel of legal and intelligence experts appointed by President Obama. Yet in a ruling issued on Friday, Judge William Pauley III of the Federal District Court in Manhattan came to the opposite conclusion. "The effectiveness of bulk telephony metadata collection cannot be seriously disputed," Judge Pauley wrote in a deeply troubling decision dismissing a lawsuit by the American Civil Liberties Union that challenged the constitutionality of the N.S.A.'s bulk data collection program. Conclusions from the European Commission PSI consultation Timothy Vollmer, December 20th, 2013 Last month, Creative Commons and several other groups responded <https://creativecommons.org/weblog/entry/40741> to the European Commission's consultation <https://ec.europa.eu/digital-agenda/en/news/consultation-guidelines-recomme…> on licensing, datasets and charging for the re-use of public sector information (PSI). There were 355 submissions to the questionnaire (spreadsheet download) <http://ec.europa.eu/information_society/newsroom/cf/dae/document.cfm?action…>, apparently from all EU Member States except Cyprus. The Commission hosted a hearing (PDF of meeting minutes) <http://ec.europa.eu/information_society/newsroom/cf/dae/document.cfm?action…> on the issue on 25 November. This week the Commission released a final summary report (PDF) <http://ec.europa.eu/information_society/newsroom/cf/dae/document.cfm?action…> to the consultation. There were several interesting data points from the report concerning licensing. First, the questionnaire respondents preferred a "light-weight approach, limited to a mere disclaimer or consisting of allowing the reuse of data without any particular restrictions..." (pg5). In our submission, we said that there should be no conditions attached to the re-use of public sector information, with the best case scenario being for public sector information to be in the public domain, exempt from copyright protection altogether by amending national copyright laws. As a whistleblower of illegal government activity that was sanctioned and kept secret by the legislative, executive, and judicial branches of government for years, he undertook great personal risk for the public good. And he has single-handedly reignited a global debate about the extent and nature of government surveillance and our most fundamental rights as individuals. Monday's court ruling declaring the NSA surveillance program unconstitutional highlights the irony of the government's prosecution of Snowden. For more than 12 years, the ACLU has raised concerns about the massive changes occurring in our democracy: the rubber stamping of expansive surveillance powers by the judiciary, the clandestine nature of programs that invade the rights and lives of millions of Americans with virtually no oversight, and the quiet acquiescence of a public that believed that individuals had nothing to fear if they had done nothing wrong. That was true until Snowden awakened the American people -- and others across the globe -- from complacent lethargy. For his actions, Snowden should be applauded, not vilified. He should be granted full immunity from prosecution. And he should be allowed to resume his life in the United States as a proud American citizen. A handwritten poster by a South Korean student highlighting issues such as redundancy and suicide has sparked a nationwide protest movement, reports suggest. The poster was put up by Ju Hyun-woo on 10 December on a notice board at Korea University. "I just want to ask everybody. How are you all doing? Is it OK for you to ignore social issues since it is not your business?"the Korea Times quotes the poster as saying <http://www.koreatimes.co.kr/www/news/nation/2013/12/116_148082.html>. Within a week, more than 30 posters reportedly went up next to it, saying: "We are not doing well." *Net Neutrality and Mandatory Network-Sharing: How to disconnect the continent* Author: Andrea Renda In: CEPS Policy Briefs Date: 18 December 2013 http://ceps.be/book/net-neutrality-and-mandatory-network-sharing-how-discon… A lively debate emerged on the proposed "Connected Continent" legislative package presented by the European Commission in September 2013. The package contains a proposed rule on the 'open Internet', which was heavily discussed in European Parliament hearings in early December. This commentary argues that while the proposed rule is in principle balanced and appealing, it is utterly impractical due to the enormous uncertainty that its application would entail. At the same time, the rule is very far from what neutrality proponents have argued for almost a decade: rather than the place for internet freedom, it would transform the Web into a place requiring constant micro-management and tutoring of user behaviour. Both arguments lead to the conclusion that the current proposal should be at once reformed and analysed under a more holistic lens. On the one hand, Europe should launch an ambitious project for the future, converged infrastructure by mobilising resources and reforming rules to encourage investment into ubiquitous, converged, 'always on' connectivity. On the other hand, enhanced legal certainty for broadband investment could justify a more neutrality-oriented approach to traffic management practices on the Internet. The author proposes a new approach to Internet regulation which, altogether, will lead to a more balanced and sustainable model for the future, without jeopardising user freedom. The answer has now landed squarely on Mr. Obama's desk, with therelease late Wednesday afternoon <http://www.nytimes.com/2013/12/19/us/politics/report-on-nsa-surveillance-ta…> of a remarkably thorough and well-reasoned report <http://www.nytimes.com/interactive/2013/12/19/us/politics/19nsa-review.html> calling on the government to end its bulk phone-data collection program and to increase both the transparency and accountability of surveillance programs going forward. The 300-plus-page report was written by a five-member advisory panel of intelligence and legal experts that was commissioned by the president himself and made 46 recommendations for reform. The recommendations demonstrate how far afield the National Security Agency has wandered in its zeal to vacuum up the phone and Internet data of virtually every American, not to mention world leaders and other non-American citizens. They also show the lack of regard for the Constitution that has led those efforts, and the virtual absence of supervision and restraint by Mr. Obama and his predecessor, President George W. Bush.
