Public Consultation on Patents and Standards URL: http://ec.europa.eu/enterprise/policies/industrial-competitiveness/industri… *A modern framework for standardisation involving intellectual property rights* Topic and objective The objective of this consultation is to gather information and views on the interplay between standardisation and intellectual property rights (IPR) such as patents. Standardisation is the voluntary process of developing technical specifications based on consensus among the interested parties. Standard setting takes place in the European and International Standardisation Organizations (ETSI, CEN, CENELEC, ITU, ISO, IEC) but also in other organizations and fora or consortia on national, European or international level. Many standards comprise technologies that are patent protected. Public authorities and the standardisation community have developed rules and practices to ensure the efficient licensing of these standard-related patents. The purpose of this consultation is to allow stakeholders interested in standardisation involving patents, to bring to the Commission's attention their views on – how the current framework governing standardisation involving patents performs and on – how it should evolve to ensure that standardization remains efficient and adapted to the fast-changing economic and technological environment. The European Commission has the task of ensuring that the European Union’s internal market functions efficiently. Therefore harmonisation standards are particularly important for the EU. Furthermore, an efficiently performing standardization system is crucial for the EU's objectives in the areas of industry policy, innovation, services and technological development. Target group(s) Companies of all sizes, organizations, public authorities, citizens and any other interested stakeholders are welcome to contribute to this consultation. We particularly encourage those having direct experience with standardisation involving intellectual property rights to share with us their experience and insight. This includes those currently active in standardisation activities or planning to become active, as well as those who use standards without taking part in their formulation. We also encourage participation by those having direct experience with – patent transfers – patent pools and other types of patent market intermediation – patent dispute resolution (Courts, ADR service providers, users of ADR services etc.). But for guarding anything other than Web browsing, Tor has required a mixture of finicky technical setup and software tweaks. Now routing all your traffic through Tor may be as simple as putting a portable hardware condom on your ethernet cable. Today a group of privacy-focused developers plans to launch a Kickstarter campaign for Anonabox. The $45 open-source router automatically directs all data that connects to it by ethernet or Wifi through the Tor network, hiding the user’s IP address and skirting censorship. It’s also small enough to hide two in a pack of cigarettes. Anonabox’s tiny size means users can carry the device with them anywhere, plugging it into an office ethernet cable to do sensitive work or in a cybercafe in China to evade the Great Firewall. The result, if Anonabox fulfills its security promises, is that it could become significantly easier to anonymize all your traffic with Tor—not just Web browsing, but email, instant messaging, filesharing and all the other miscellaneous digital exhaust that your computer leaves behind online. The cause? Facebook’s decision to delete the accounts of several San Francisco drag queens, enforcing a longstanding policy that users go by their real names on the site. Here in San Francisco, the activist queens known as the Sisters of Perpetual Indulgence reacted with anger and disbelief. As queens like Sister Roma rightly pointed out, alternative names are a means of greater safety, especially for those in the LGBT community. After all, we live in a country where you can be fired for being gay, a nation in which queer people are regularly disowned and taunted and bullied and beaten. Sometimes it’s unsafe to share everything with everyone. Although Facebook has since apologized to the queens, the controversial rules haven’t changed. We shouldn’t be surprised by the company’s stance. “You have one identity,” its chief executive, Mark Zuckerberg, declared several years ago. “Having two identities for yourself is an example of a lack of integrity.” Comments and policies like those betray a stunning lack of imagination. They presume that the world is a static, simple place where identities are not questioned but assured. The assumption behind Facebook’s “real name” policy is that everyone feels (or should feel) certain about who they are. Maybe that rings true for the handful of young developers running the social network in Menlo Park, Calif., but it doesn’t reflect the 21st-century world most Facebook users actually know and experience. Scusate se ritorno ancora su questa discussione di un mese fa... ma mi interessa particolarmente. E' davvero assurdo che il legislatore e la PA si inventino sempre cavilli legali e complicazioni burocratiche per vanificare il sacro santo principio secondo cui prima o poi il pubblico dominio arriva per tutto. Me n'ero occupato tempo fa su Apogeonline, commentando una bizzarra circolare del MIBACT, relativa in questo caso all'annosa questione delle fotografie all'interno dei musei.
