L'hébergeur Dailymotion condamné à 1,3 million d'euros au profit de TF1 et LCI

Selon nos informations, la Cour d’appel de Paris vient de condamner ce 2 décembre Dailymotion à 1,3 million de dommages et intérêts au profit du groupe TF1. Épilogue d’un dossier né voilà plusieurs années et contre lequel la société envisage maintenant un pourvoi en cassation. Next INpact publie ci-dessous la décision. Ce 2 décembre, la Cour d’appel de Paris a condamné Dailymotion à 1,3 million de dommages et intérêts. L’origine du conflit remontait à juin et juillet 2007. Le groupe TF1 avait fait constater la présence de plusieurs vidéos de son catalogue sur la plateforme Dailymotion : des épisodes de Heroes, Les Infiltrés de Martin Scorsese, le spectacle L’autre, c’est moi, de Gad Elmaleh, des journaux de TF1 et des émissions Le commentaire politique de Christian Barbier de LCI, etc. En 2012, la justice avait consacré le rôle d’hébergeur de Dailymotion, mais l’avait malgré tout condamné pour des retards dans la suppression des contenus notifiés par le groupe. Un hébergeur est en effet en principe non responsable des contenus stockés sauf si, averti dans les règles, il ne supprime par promptement les liens illicites. I lavori dei ministri europei sono presieduti dal Ministro della Giustizia Andrea Orlando, giovedì, e dal Ministro degli Interni Angelino Alfano, il giorno seguente. http://italia2014.eu/it/news/post/dicembre/cons-gai-4_5-dic/ LItalia ha pronto un ampio pacchetto di modifiche alle norme in tema di privacy e sicurezza, attualmente in discussione presso la UE, che il sottoscritto ha potuto visionare, e che è contenuto in tre documenti : uno state of play, un documento orientativo focalizzato sui principi dellone stop shop, ovvero dellAutorità competente a decidere sulla violazione dei dati personali, e quello più delicato che coinvolge il settore pubblico, ed è sottoposto dal Governo Italiano alla clausola di riservatezza. Segnalo un evento per i nexiani romani o di passaggio Giulio Think Digi Tank. Strumenti digitali per la ricerca L'attività dei centri di ricerca politico-culturale è resa oggi sempre più difficile dalla contrazione delle risorse pubbliche, dall'aumento dei costi per la diffusione dei materiali, dalla distanza dalle giovani generazioni. Di fronte a tali criticità il Crs si è fatto promotore di una proposta per la costruzione di una piattaforma digitale in grado di sostenere il lavoro dei soggetti impegnati, a vario titolo, in questo campo. L'iniziativa, che ha ottenuto il contributo della Regione Lazio e intende favorire il coinvolgimento dei principali soggetti del settore (tra cui Fondazione Basso, Italianieuropei, Istituto Sturzo, Fondazione Gramsci, Fondazione Di Vittorio) sarà presentata in occasione dell'incontro pubblico "Think Digi Tank. Strumenti digitali per la ricerca politico-culturale", che si terrà il prossimo mercoledì 10 dicembre, dalle ore 15, nei locali del Coworking Millepiani, in Via Nicolò Odero 13 a Roma. Based on over fifty face-to-face interviews, the book centers on the stories told by interviewees describing how and why they create and innovate and whether or how IP law plays a role in their activities. The goal of the empirical project was to figure out how IP actually works in creative and innovative fields, as opposed to how we think or say it works (through formal law or legislative debate). Breaking new ground in its qualitative method examining the economic and cultural system of creative and innovative production, The Eureka Myth draws out new and surprising conclusions about the sometimes misinterpreted relationships between creativity, invention and intellectual property protections. About Jessica Silbey Professor Silbey's scholarship draws from her interdisciplinary background in the humanities and law. One of her interests is in intellectual property law, particularly in the investigation of "IP communities:" activities, groups and organizations with a particular creative or innovative focus. She studies the common and conflicting narratives within those communities in relation to intellectual property law and legal institutions that purport to regulate them. She is especially interested in the connections between cultural narratives of creation, discovery, incentive and labor and their legal counterparts in IP communities, statutes and legal cases. The empirical dimension of this project (conducting and analyzing interviews with artists, scientists and intellectual property professionals) will be published by Stanford University Press in 2014. Another of her interests is in the interrelationship of law and film in legal practice and popular culture. Her research and writing in this area investigates how film and video are used as legal tools and how they become objects of legal analysis. A long-time interest since she was a graduate student in literature and film, her work explores questions such as: how does automated surveillance film become testimony in a court of law? How do cultural perceptions about film and video affect their evaluation by jurors, advocates and judges? How might legal actors and lay citizens mobilize the audiovisual technology of our twenty-first century to further the promises of our justice system? A current project in this area concerns ultrasound technology and the politics of reproductive choice. Professor Silbey teaches courses in constitutional law and intellectual property. Professor Silbey received her B.A. from Stanford University and her J.D. and Ph.D. (Comparative Literature) from the University of Michigan. Before joining the faculty of Suffolk University Law School, Professor Silbey was a litigator at the law firm of Foley Hoag LLP in Boston. She also served as a law clerk to the Honorable Robert E. Keeton on the United States District Court for the District of Massachusetts and to the Honorable Levin Campbell on the United States Court of Appeals for the First Circuit.
