Policy making in Governing the Internet: comparing novel approaches and rising challenges Chair: Andrea Calderaro, European University Institute Discussant: Carr Madeline, Aberystwyth University Deadline: 15th January The spreading of Internet practices worldwide is increasingly putting the debate and the negotiations concerning Internet Policy at the centre of international disputes. As result, we are witnessing to a growing scholarly oriented body of research addressing the fast developing debate concerning contentions clustered around internet policy challenges. Here, particular attention concerns how to enhance inclusiveness in Internet Governance decision making processes, in order to represent the multiple dimensions characterizing the Internet itself. Given its nature, multiple actors including Governments, representative of the private sectors, as well as civil society organizations are called to establish a so-defined multistakeholder policy making approach. With this, the governance of the internet is supposed to be run with the coordination of all parts involved to work for the good of the internet infrastructure. However, while a multistakeholder approach has been advocated for over 10 years, i.e. since the launch of the Internet Governance negotiations with the first United Nations World Summit of Information Society (WSIS) in 2003, we still lack evidence of the empirical outcomes of this approach. It is still unclear whether or not this policy making approach is successful in establishing an international and multidisciplinary policy capability and decision making processes able to react efficiently and as fast as the internet challenges develop. This panel calls for papers exploring the increasing centrality of Internet Governance negotiations in international disputes, with a particular focus on how internet policy making processes influence this discourse. Within this framework, this panel will include papers that address theoretical or empirically grounded research providing (1) evidence on successful and failing cases in the field of internet policy clustered around a multistakeholder approach; (2) methodological approaches able to frame novel policy network research strategy; and (3), research leading us to answer to the key question whether and how the multistakeholder decision making processes influence the capability of institutions to provide policy response in the fast developing Internet Governance debate. By addressing these questions, this panel aims to frame the policy challenges attached to the Internet Governance debate, and expand our understanding of the decision making process concerning internet policies. Finally, with the scope to establish clear lines of dialogues between scholarly relevant empirical research and innovative approach, this panel calls for papers combining novel research and empirical cases that capture the policy making challenges attached to the broader Internet Governance debate, as an emerging topic with long-term implications. Their call for interoperability in the education system (Appel pour l’intéropérabilité dans l’Education Nationale) is supported by 100 teachers, as well as employees and school trade unions.* “To work together better and more efficiently; and to improve the teaching quality, we are asking for the implementation of a simple and clear rule: documents provided by the public service of Education Nationale and all documents that are exchanged, including texts, spreadsheets, presentations and videos, have to be saved in open and interoperable formats”, April writes on its <http://formatsouverts.education> campaign website <http://formatsouverts.education>: “For example, DOCX and XLSX formats are not open compared to ODT or ODS formats”. The group adds that schools should not accustom pupils to the lock-in strategy of dominant software vendors. In 2013, the French parliament lowered the priority for the use of free software and open formats in educational. Don’t Fear Artificial Intelligence Ray Kurzweil http://time.com/3641921/dont-fear-artificial-intelligence/ Stephen Hawking, the pre-eminent physicist, recently warned that artificial intelligence (AI), once it surpasses human intelligence, could pose a threat to the existence of human civilization. Elon Musk, the pioneer of digital money, private spaceflight and electric cars, has voiced similar concerns. If AI becomes an existential threat, it won’t be the first one. Humanity was introduced to existential risk when I was a child sitting under my desk during the civil-defense drills of the 1950s. Since then we have encountered comparable specters, like the possibility of a bioterrorist creating a new virus for which humankind has no defense. La prima sentenza italiana sulle licenze Creative Commons

Ho pubblicato qui http://aliprandi.blogspot.it/2014/12/prima-sentenza-italiana-creative-commo… il testo di una sentenza che ho ottenuto non come legale ma come parte, in quanto autore del libro “Apriti standard. Interoperabilità e formati aperti per l’innovazione tecnologica” che ha avuto una brutta esperienza con la casa editrice Franco Angeli. La sentenza, pur nel suo piccolo (è una decisione di primo grado) e pur non trattando strettamente questioni di proprietà intellettuale (è infatti di fronte al Tribunale ordinario e non alla sezione specializzata), rappresenta un primo storico caso giurisprudenziale in cui un giudice italiano si occupa dell'applicazione delle licenze Creative Comomons. Lascio eventuali commenti (ne avrei molti) ad una seconda fase e ad autonomi post; ma intanto mi premeva condividere con tutti il testo. Ovviamente, condivisioni e commenti saranno graditi. Notizie dettagliate sull'attività dovranno essere preventivamente diffuse anche su Internet e presso i luoghi di interesse. Dovranno essere resi riconoscibili i "trekker" che trasportano le apparecchiature fotografiche sullo zaino. Lo ha stabilito il Garante privacy [doc. web n. 3633473] <http://www.garanteprivacy.it/garante/doc.jsp?ID=3633473>in seguito alla decisione della multinazionale di voler lanciare anche in Italia il servizio "Google Special Collects", che consentirà di registrare immagini a 360 gradi in ambienti non raggiungibili dalle tradizionali vetture di "Google Street View", come siti archeologici, parchi nazionali, musei e spiagge. Le apparecchiature fotografiche saranno trasportate a piedi da operatori (trekker), o installate su mezzi alternativi, come imbarcazioni o treni. Nella richiesta al Garante, Google ha affermato che nei musei e in altri luoghi ad accesso limitato, al fine di limitare eventuali riprese di visitatori, effettuerà le registrazioni negli orari di chiusura al pubblico. Nelle altre aree, come spiagge e spazi aperti, saranno invece scelti orari in cui sia meno probabile incontrare passanti. La multinazionale americana provvederà inoltre a oscurare i volti e altri particolari identificativi (ad esempio, le targhe dei veicoli), eventualmente memorizzati, prima di rendere disponibili le immagini sul servizio Google Maps. L'Autorità, nell'ambito del bilanciamento di interessi e in base alla peculiarità del servizio rispetto alla versione standard di Street View, ha imposto alla società l'adozione di adeguate cautele a tutela degli interessati e di misure semplificate per informarli delle riprese in corso. In particolare, Google dovrà pubblicare informazioni sui luoghi di ripresa sul proprio sito web in italiano nei tre giorni antecedenti l'inizio dei lavori. Informazioni dettagliate dovranno essere pubblicate già sette giorni prima dell'inizio delle riprese anche sui siti web e, se esistenti, sulle newsletter o altre pubblicazioni informative dei partners, cioè degli enti, strutture, soggetti privati, fondazioni etc. coinvolti nel programma. Nei luoghi ad accesso controllato, Google o i suoi incaricati dovranno provvedere a informare le persone interessate – anche attraverso appositi avvisi o cartelli affissi all'ingresso dei siti - della imminente registrazione delle immagini, in modo da consentire ai visitatori di esercitare il diritto a non venire inquadrati. La multinazionale americana dovrà inoltre garantire la formazione del personale coinvolto circa il rispetto della normativa sulla protezione dei dati personali. Posted on December 30, 2014 <http://www.communia-association.org/2014/12/30/leading-copyright-scholars-f…>by Paul Keller <http://www.communia-association.org/author/pkeller/> As part of thepublic consultation on a review of the EU copyright rules <http://ec.europa.eu/internal_market/consultations/2013/copyright-rules/inde…> the EU commission included two questions related to a single EU copyright title. These questions refer to the fact that in the current situation all member states of the EU have their own copyright laws. These laws need to meet the requirements established by an increasing number of EU directives (such as the InfoSoc directive, the Copyright term directive, and the orphan work directive). This has resulted in a certain level of harmonization, but this does not take away the fact that in the EU the a copyrighted work is protected by 28 different copyright laws that apply to 28 different jurisdictions. Compared to this situation a single European title would mean having one single EU copyright law that confers EU-wide rights to rights holders and establishes EU-wide exceptions and limitations. Inour answer to the public consultation <http://www.communia-association.org/2014/03/05/communia-responds-to-eu-cons…> we urged the EU commission to start working on a single European copyright title: *Question 78: Should the EU pursue the establishment of a single EU Copyright Title, as a means of establishing a consistent framework for rights and exceptions to copyright across the EU, as well as a single framework for enforcement?* The establishment of a single EU Copyright Title would be a positive step forward for both rightholders and users of copyrighted content. It would help to harmonize the currently disjointed limitations and exceptions and copyright duration schemes across the EU. *Question 79: Should this be the next step in the development of copyright in the EU? Does the current level of difference among the Member State legislation mean that this is a longer term project?* Pursuing the establishment of a single EU Copyright Title should be the next step. Work on this should begin immediately. One of the other organisations that also advocated taking steps towards a single EU copyright title is the European Copyright Society (ECS). Inits response <http://infojustice.org/wp-content/uploads/2014/03/ECS-answer-to-EC-consulta…> the ECS (which is made up of leading European copyright scholars and academics) argued for for the introduction of Union-wide copyright title and for the simultaneous abolishment of national copyright titles. Just before the holidays the European Copyright Society reaffirmed this position by sendinga letter to Commissioner Oettinger in which it once again advocates for a unification of EU copyright law <http://www.ivir.nl/syscontent/pdfs/78.pdf>. In their letter the members of the society briefly affirm the need to modernize the existing EU copyright rules (dryly noting that they “trust that [the European Copyright] Society’s opinions will be taken into account”) before they urge the Commissioner to go a step further: In this letter, however, we would like to go a step further and underscore the need for a more forward looking and further reaching reform of copyright in the EU – in the form of actual Union-wide unification (not further harmonization) of copyright. The Members of the European Copyright Society are convinced that the time is now ripe to start work on a European Copyright Law that would apply directly and uniformly across the Union. Further into the two-page letter <http://www.ivir.nl/syscontent/pdfs/78.pdf> they point to the fact that EU treaties already provide a mandate for the full unification of EU copyright law. While there are many septics such a step is not only needed to meet the requirements of a single digital market, but also probably inevitable: In the opinion of the European Copyright Society a more ambitious solution is now called for: true unification of copyright by way of a European Copyright Law (Regulation) that would replace national legal titles. Article 118 of the TFEU, introduced by the Lisbon Reform Treaty, creates a specific competence for the European legislature to establish intellectual property rights with direct Union-wide effect. While copyright unification may be considered undesirable, or perhaps too drastic, by certain stakeholders and national legislatures, this is in our opinion the only way a fully functioning Digital Single Market for copyright-based goods and services can ultimately be achieved. It is in fact the logical next step for the EU legislature to take in this field. As we have stated in our consultation response we could not agree more with the esteemed members of the ECS and we hope that Commissioner Oettinger and other lawmakers pay close attention to the advice provided by such a large number of pre-eminent copyright scholars.
