Il Governo Italiano esprime, in un documento di 6 pagine, suddiviso in 7 Capitoli, la sua posizione ufficiale alla Commissione Europea sul digital single Market. Il documento, recapitato alla DG Connect venerdi scorso contiene molte sorprese. La posizione sembra avere due facce. E un ottimo documento per quanto riguarda le prospettive in tema di diffusione dellInternet. LItalia propone ambiziosi obiettivi di diffusione delle nuove tecnologie, cita il piano di sviluppo ultrabroadband, propone di seguire con attenzione le regole nella ridefinizione delle regole globali relative allICANN. Il Bel Paese propone soluzioni innovative per la cd internet of Thing, sposa il concetto di privacy By default, ovvero la punta più avanzata della tutela della riservatezza nelle reti telematiche. Il Governo propone anche di potenziare il settore della sicurezza informatica in ambito Comunitario. Lesecutivo usa termini quali nativi digitali, presenta il suo progetto La Buona scuola. Insomma un documento molto avanzato. Radical is something that federal agencies rarely achieve because radical in the context of the large machinery of government is often a sign that a particular group has been given too much unchecked power. Critics of the new net neutrality rules will certainly be making that argument: that the rules represent unchecked government power grabbing; bureaucrats imposing themselves on the free market. Agcom censura Nowvideo: la giustizia sulla rete la fanno i funzionari

LAutorità per le garanzie nelle comunicazioni prosegue nella sua opera di ripulitura della rete internet. <http://www.agcom.it/documents/10179/3039728/Comunicazione+16-03-2015+142652 5565212/6ffa9932-4b6f-4540-9b4b-8618361ddd58?version=1.0> Lultimo procedimento attivato riguarda un sito denominato Nowvideo. Non si discute ovviamente di quello che fa il sito in sé, perché quello è già oggetto, come è giusto che sia, di procedimenti di fronte alla Magistratura, ma di quello che fa lAutorità. Agcom agisce per rimuovere contenuti su diverse estensioni dello stesso sito e avvia il procedimento nei confronti di più domini riconducibili ad un unico sito: Considerata lidentità del soggetto istante e considerato che siti sopraindicati, benché caratterizzati da estensioni diverse del medesimo dominio, conducono di fatto allo stesso sito, circostanza questa confermata dalla riconducibilità degli stessi ad un unico indirizzo Ip. Agcom dice finalmente una cosa vera e cioè che tutte le estensioni di unico sito del medesimo dominio sono in verità un sito solo. Una cosa evidente a tutti e per prima allAutorità. Quindi Nowvideo.chè uguale a Nowvideo.sx che è uguale a Nowvideo.co e aNowvideo.ch, come Nowdownload.ch è uguale aNowdownload.ag, a Nowdownload.ec e a Nowdownload.eu. Ora le piattaforme Nowvideo, come Nowdonwload, ovvero i siti sui quali è maggiormente intervenuta Agcom nelle loro diverse estensioni, sono attualmente oggetto di procedimenti di fronte a diversi giudici della Repubblica. E come loro decine di altri domini, sui quali Agcom ha agito sia chiedendo la rimozione di opere sia disponendo lordine di inibizione al sito, e che sono pendenti di fronte ai giudici, sui quali evidentemente la magistratura sta indagando, e che hanno diverse estensioni ma che appartengono agli stessi soggetti. E Agcom lo sa, altrimenti non avrebbe aperto un procedimento unico per tutte le estensioni, come nel caso di Nowvideo. Per fatti diversi? No, per gli stessi fatti per i quali Agcom avvia i suoi procedimenti, ovvero linserimento su internet di file protetti daldiritto dautore e per gli stessi possibili esiti, ovvero lordine di inibizione allaccesso al sito. Basta leggere le relazioni di polizia giudiziaria dei procedimenti che ho citato e si vede che gli accertamenti compiuti dal funzionario dellAutorità sui domini Nowvideo e Nowdownload, nelle diverse estensioni, sono gli stessi identici della polizia giudiziaria, per gli stessi identici siti, sugli stessi server. Agcom sta quindi agendo sostituendosi alla Magistratura ordinaria nellintervenire su domini sui quali sono in corso indagini di polizia giudiziaria e sui quali esistono provvedimenti della Magistratura per la violazione del diritto dautore, ed in particolare per quel che riguarda Nowvideo i provvedimenti del luglio 2014, del novembre 2013, dellaprile 2013, tutti aventi ad oggetto lo stesso sito e tutti ovviamente aventi lo stesso Ip. http://www.ilfattoquotidiano.it/2015/03/17/agcom-censura-nowvideo-giustizia- rete-fanno-i-funzionari/1513085/ --- Questa e-mail è stata controllata per individuare virus con Avast antivirus. http://www.avast.com

But a team of researchers has shown that—at least in New York City—there are plenty of times when a regular old yellow taxi is cheaper than an Uber. A group of computer scientists from the University of Cambridge and Belgium’s University of Nanmur calculated that Uber is more expensive than a yellow cab for a trip in New York City that costs less than $35, the MIT Technology Review reports. As the research paper says, “human mobility tends to be characterised by a vast majority of short trips” and “Uber’s economical model exploits this trend of human mobility in order to maximise revenue.” The argument is that Uber’s model skews more expensive for shorter rides. Emory Law Journal, 2015. http://law.emory.edu/elj/elj-online/data-nationalism-its-discontents.html Data localization or data nationalism, which terms I will use synonymously here, has received growing attention. Numerous commentators (including myself) have raised questions about efforts at the national or regional level to regulate the flow of data across borders or to create incentives to localize data processing and storage. This is the topic of the important new article Data Nationalism by Anupam Chander and Uyê P. Lê published in the Emory Law Journal. Chander and Lê provide a thoughtful and useful analysis of regulatory initiatives that promote data nationalism. They have cast their net widely to include examples from around the world (including citation of materials in languages such as Russian and Vietnamese). The Article’s careful consideration of numerous data localization initiatives, the motivations behind them, and their social, economic, and legal implications fills an important need in the literature on Internet regulation. In this short piece I will both respond to the Article and comment on some important overarching issues that it raises.
