qualche tempo fa la rivista della University of Canterbury, NZ, ha pubblicato un articolo intitolato "Using AI to write essays isn't cheating, student says" https://www.canta.co.nz/canta/newsarticle/115524?newsfeedid=1453013 l'argomento portato dagli studenti riprende temi già comparsi qui: trattiamo l'IA come strumento o come soggetto personale? > “I looked through the [UC] rules and it says you can’t get > _/somebody/_ else to [do the assessment]. Well it’s not somebody, it’s > AI. I know there are people in my class paying people to write essays. > I think that’s wrong. This is not the same thing ...This is using > _/tools/_ that are there." poiché è un tool e non una persona, dicono gli studenti, allora l'University of Canterbury non può punire chi lo usa nella scrittura dei compiti. nella linea "l'IA è un tool" ci dovremmo orientare ad ammettere l'uso di software di IA nella scrittura scientifica, come se fosse "ammettere la presentazione di domande sia compilate a mano sia scritte al computer?" Asleep at the Keyboard? Assessing the Security of GitHub Copilot's Code Contributions

<https://arxiv.org/abs/2108.09293> Comments: Accepted for publication in IEEE Symposium on Security and Privacy 2022 There is burgeoning interest in designing AI-based systems to assist humans in designing computing systems, including tools that automatically generate computer code. The most notable of these comes in the form of the first self-described `AI pair programmer', GitHub Copilot, a language model trained over open-source GitHub code. However, code often contains bugs - and so, given the vast quantity of unvetted code that Copilot has processed, it is certain that the language model will have learned from exploitable, buggy code. This raises concerns on the security of Copilot's code contributions. In this work, we systematically investigate the prevalence and conditions that can cause GitHub Copilot to recommend insecure code. To perform this analysis we prompt Copilot to generate code in scenarios relevant to high-risk CWEs (e.g. those from MITRE's "Top 25" list). *We explore Copilot's performance on three distinct code generation axes -- examining how it performs given diversity of weaknesses, diversity of prompts, and diversity of domains. In total, we produce 89 different scenarios for Copilot to complete, producing 1,689 programs. **Of these, we found approximately 40% to be vulnerable. * * * * *

AI Ethics (2022). https://doi.org/10.1007/s43681-022-00233-w (accesso aperto) Uno dei migliori articoli che ho letto finora sul tema, almeno per quanto riguarda la parte analitica e per il c.d. “framing” della questione. La parte propositiva conclusiva (3 linee guida per l’uso del ML nei processi decisionali) è un po’ meno dettagliata, ma l’ho trovata valida e molto ragionevole. Nota di merito per gli autori che hanno scritto con un linguaggio accessibile a tutti, e non solo agli addetti ai lavori. Un caro saluto A.

noyb win: Personalized Ads on Facebook, Instagram and WhatsApp declared illegal

As reported by The Wall Street Journal (https://www.wsj.com/articles/metas-targeted-ad-model-faces-restrictions-in-…) the EDPB has decided that Meta cannot force users to agree to personalized ads. In May 2018, when the GDPR came into force in the EU, Meta Ireland Ltd. believed it could "bypass" the requirement to get opt-in consent from users, by simply adding a provision in the terms and conditions. On 25 May 2018, the digital rights organization noyb filed complaints with the relevant Data Protection Authorities (DPAs). Now, 4.5 years later, the European Data Protection Board (EDPB) found Meta's alleged "bypass" of the GDPR illegal. Pubblicate le previsioni del nuovo report di Ericsson (vi allego il documento completo) sul traffico dati della rete mobile nel mondo. La spinta arriva dai servizi di streaming, ma anche da piattaforme come YouTube, TikTok, Facebook e Instagram. Secondo lo studio "l'adozione di dispositivi e applicazioni di realtà aumentata e virtuale ha il potenziale per modificare in modo significativo questi volumi di traffico". Buongiorno, "To warrant or not to warrant, that is the Question" Quello che mi fa impressione non è tanto che abbiano sbagliato usando informazioni inaccurate di "Find My App" per le ricerche ma che - in puro stile action movie - abbiano fatto irruzione con la SWAT (ma che davero?!?) dopo che **un giudice** ha autorizzato la perquisizione (con la SWAT, ma che davero?!?) sulla **sola** base della localizzazione basata su Find My App, senza manco andare a guardare prima chi ci viveva in quella casa. Officers, some in tactical gear with rifles, used a battering ram on the rear garage door of Ms. Johnson’s home and also caused damage inside the house, court records say. Officers searched for stolen goods while Ms. Johnson, 77, waited in a police vehicle. After several hours, the police left. Their search was fruitless. In a lawsuit filed last week, Ms. Johnson, a retired U.S. Postal Service worker who lives alone, says that a detective, Gary Staab, sought the warrant based on inaccurate information from the Find My app. The mobile application, which helps track down missing or lost Apple products, such as iPhones, iPads and MacBooks, led him to believe that stolen goods were inside her home, the suit says. Mark Silverstein, a lawyer for Ms. Johnson and the legal director of the A.C.L.U. of Colorado, said on Monday that Detective Staab, the sole defendant named in the suit, should not have applied for the warrant. He was assigned on Jan. 4 to investigate a truck that had been reported stolen the day before, according to court documents. The detective interviewed the truck’s owner, Jeremy McDaniel, who told him that he had used the Find My app the day before to search for the iPhone and that it had placed the lost phone at an address, according to court documents. I termini d'uso sono generalmente qualificati come dei contratti standard; negli anni più recenti, la ricerca civilistica si è principalmente concentrata sulla loro conoscibilità, sulla presenza di clausole abusive e sull'adempimento degli obblighi informativi da parte del predisponente. Un'analisi approfondita degli sviluppi concreti dei *rapporti giuridici online* consente, però, di rivisitarne criticamente la qualificazione giuridica contrattuale e di dimostrare come non tutti i termini d'uso siano dei contratti. A questa conclusione, sono pervenute anche numerose corti di Stati membri dell'*Unione europea* e diverse corti statali degli *Stati Uniti*. Tuttavia, l'horror vacui generato dall'abbandono del perimetro contrattuale ha impedito di descrivere un nuovo inquadramento dei rapporti tra gestori del sito e internauti. L'intervento intende proporre una tassonomia che prende atto delle imponenti trasformazioni che accadono alla frontiera di *Internet*. I *mercati digitali*, di cui i termini d'uso costituiscono l'architrave, esistono anche in assenza di scambi e, di conseguenza, il commercio elettronico è soltanto uno degli ambiti regolati dal contratto. In questo complesso scenario, il superamento dei confini che separano il mondo analogico da quello digitale impone di studiare i *termini d'uso dei siti* per osservare i tratti inediti che il paradigma contrattuale assume in questo nuovo sistema di produzione, e per elaborare rimedi e tutele all'altezza delle trasformazioni che il *diritto privato* è chiamato ad affrontare.
