Felix est non aliis qui videtur, sed sibi <https://www.theguardian.com/us-news/2021/feb/09/texas-lawyer-zoom-cat-filte…> he coronavirus has been responsible for a series of video-call stumbles and mishaps, and the phenomenon seemingly reached its zenith this week, when a Texas lawyer appeared before a judge as a cat, after being unable to change a video filter. “I’m not a cat,” Rod Ponton was forced to clarify during a hearing in Presidio county, south-west Texas, as he and his assistant scrambled to remove the filter. The filter, which displayed a kitten instead of Ponton’s face, was able to capture the lawyer’s horror and confusion, its eyes flitting across the screen as Ponton scrambled to remove it. The coronavirus has prompted many computer mishaps, as many of the world’s workers adapt to working from home in the face of the pandemic. They have ranged from the inadvertently hilarious to the career-ending. Faced with hearing legal debate from a kitten, Judge Roy Ferguson of Texas’s 394th judicial district told Ponton: “I believe you have a filter turned on in the video settings. You might want to …” The Ponton/kitten entity then interrupts Ferguson in a panicked drawl: “Can you hear me, judge?” Ferguson responds: “I can hear you. I think it’s a filter …” “It is,” the cat-faced Ponton responds. “And I don’t know how to remove it. I’ve got my assistant here, she’s trying to, but I’m prepared to go forward with it … I’m here live. I’m not a cat.” Ferguson deadpans: “I can see that.” Ponton was representing the state of Texas in the hearing, which reportedly centered on a person who had attempted to leave the US with contraband and illegally-obtained cash. Presidio county is on the US-Mexico border and includes the town of Marfa and much of Big Bend national park. In an interview with the New York Times, Ponton said he was using his secretary’s computer during the incident. Ponton told the newspaper he was “mortified”, although he appeared to see the funny side. “If I can make the country chuckle for a moment in these difficult times they’re going through, I’m happy to let them do that at my expense,” Ponton said. Ponton’s accidental morphing into a wide-eyed baby cat is not the first pandemic-inspired video call mishap – and likely won’t be the last. [...]

Accused murderer wins right to check source code of DNA testing kit used by police

A New Jersey appeals court has ruled that a man accused of murder is entitled to review proprietary genetic testing software to challenge evidence presented against him. Attorneys defending Corey Pickett, on trial for a fatal Jersey City shooting that occurred in 2017, have been trying to examine the source code of a software program called TrueAllele to assess its reliability. The software helped analyze a genetic sample from a weapon that was used to tie the defendant to the crime. The maker of the software, Cybergenetics, has insisted in lower court proceedings that the program's source code is a trade secret. The co-founder of the company, Mark Perlin, is said to have argued against source code analysis by claiming that the program, consisting of 170,000 lines of MATLAB code, is so dense it would take eight and a half years to review at a rate of ten lines an hour. The company offered the defense access under tightly controlled conditions outlined in a non-disclosure agreement, which included accepting a $1m liability fine in the event code details leaked. But the defense team objected to the conditions, which they argued would hinder their evaluation and would deter any expert witness from participating. With the two sides unable to reach an agreement, the lower court judge hearing the case denied the defense's motion to vet the source code, without sufficiently addressing the defense arguments. That prompted the defense to appeal. Those arguing on behalf of the defense cited past problems with other genetic testing software such as STRmix and FST (Forensic Statistical Tool). Defense expert witnesses Mats Heimdahl and Jeanna Matthews, for example, said that STRmix had 13 coding errors that affected 60 criminal cases, errors not revealed until a source code review. They also pointed out, as the appeals court ruling describes, how an FST source code review "uncovered that a 'secret function ... was present in the software, tending to overestimate the likelihood of guilt.'" On Wednesday, the appellate court sided with the defense [PDF] and sent the case back to a lower court directing the judge to compel Cybergenetics to make the TrueAllele code available to the defense team. "Without scrutinizing its software's source code – a human-made set of instructions that may contain bugs, glitches, and defects – in the context of an adversarial system, no finding that it properly implements the underlying science could realistically be made," the ruling says. Kit Walsh, senior staff attorney for the Electronic Frontier Foundation, hailed the appellate ruling. "No one should be imprisoned or executed based on secret evidence that cannot be fairly evaluated for its reliability, and the ruling in this case will help prevent that injustice," she said in a blog post. Lo scontro Viminale-Garante della privacy sul riconoscimento facciale in tempo reale

<https://irpimedia.irpi.eu/viminale-garante-privacy-riconoscimento-facciale-…> Mentre in tutto il mondo si discute dei rischi etici del riconoscimento facciale, della necessità di sospendere queste tecnologie fino a quando non saranno correttamente regolate, o persino di introdurre dei divieti totali al loro utilizzo, la Direzione Centrale Anticrimine della Polizia di Stato ha invece l’esigenza di potenziare le due componenti del Sistema Automatico Riconoscimento Immagini (SARI) acquistato nel 2017 <https://medium.com/@ORARiccardo/anche-litalia-si-%C3%A8-munita-di-un-sistem…>: SARI Enterprise e SARI Real-Time. Nel 2016 la Commissione Europea aveva proposto di utilizzare il riconoscimento facciale per contenere la crisi migratoria, aggiungendo la possibilità di sfruttare i dati biometrici dei volti da includere in EURODAC, l’European Asylum Dactyloscopy, un database usato per raccogliere le impronte digitali di richiedenti asilo e migranti. La proposta aveva subito portato alla mente scenari da Minority Report e nel 2019 uno studio dell’Agenzia europea per i diritti fondamentali (FRA) ha sottolineato i rischi del riconoscimento facciale, in particolare quando usato in tempo reale proprio su migranti e richiedenti asilo ignari di essere ripresi. Quella proposta ancora non si è concretizzata ma l’Italia sembra disposta a procedere per conto proprio: a novembre 2020 il Ministero dell’Interno ha infatti chiuso un bando di gara per individuare il miglior sistema il riconoscimento facciale da utilizzare in tempo reale sui migranti. La società che ha fornito il sistema nel 2017 è la leccese Parsec 3.26 S.r.l.. A giugno il Ministero ha da prima avviato un’indagine esplorativa per capire se esistono altre aziende sul mercato o se, in assenza di alternative, deve ricorrere alla procedura negoziata senza pubblicazione del bando affidando il potenziamento alla stessa Parsec 3.26. A novembre è stata avviata la procedura negoziata ma non è chiaro se l’unica partecipante sia effettivamente l’azienda leccese. Il riconoscimento facciale sui migranti Nell’avviso esplorativo il Ministero sottolinea gli obiettivi di questo potenziamento: utilizzare SARI Enterprise anche per verificare l’autenticità delle foto nei documenti e usare SARI Real-Time come «sistema tattico per monitorare le operazioni di sbarco e tutte le varie tipologie di attività illegali correlate, video riprenderle ed identificare i soggetti coinvolti». Il sistema Enterprise permette il confronto di una foto con quelle raccolte nel database AFIS, una sorta di ricerca automatica della corrispondenza dei volti. In precedenza questo tipo di confronto veniva fatto manualmente immettendo i termini di ricerca come ad esempio colore degli occhi, segni particolari, e genere. Italy Case Study: Data & Society — Digital Identity in the Migration & Refugee Context

Da EDRI <https://datasociety.net/library/digital-identity-in-the-migration-refugee-c…> For migrants and refugees in Italy, identity data collection processes can “exacerbate existing biases, discrimination, or power imbalances.” /Digital Identity in the Migration & Refugee Context/ analyzes the challenges arising from this digital ecosystem and identifies three major areas of concern: bureaucratic bias in identity systems; privacy and mistrusted systems; and organizational data responsibility. The report is co-authored by Mark Latonero (Principal Investigator), Keith Hiatt, Antonella Napolitano, Giulia Clericetti, and Melanie Penagos. One key struggle is obtaining meaningful consent. Often, biometric data is collected as soon as migrants and refugees arrive in a new country, at a moment when they are vulnerable and overwhelmed. Language barriers exacerbate the issue, making it difficult to provide adequate context around rights to privacy. Identity data is collected inconsistently by different organizations, all of whose data protection and privacy practices vary widely. While /Digital Identity/ is grounded in the Italian context, it has implications for refugees and migrants’ data privacy globally. The authors offer recommendations for stakeholders—including international organizations, policymakers, civil society, technologists, and funders—seeking to build stronger data protections. Report findings are based on interviews in Italy with refugees and migrants, local NGOs, government agencies, and international organizations. Segnalo una nuova iniziativa che prova a rispondere a una esigenza generale spesso discussa su questa lista: la necessità di promuovere una adeguata competenza digitale di base. Cosa sono i dati digitali (e non) e a cosa servono? Quando i dati diventano una finestra sporca e opaca sul mondo, come facciamo a curarli? Qual’è il valore e il disvalore dei dati? Quale il loro potere? A chi appartengono? Così come nel passato l’alfabetizzazione linguistica dei testi letti e scritti è stata un obiettivo sociale considerato prioritario per la crescita delle persone e della società, l’alfabetizzazione in tema di dati digitali è diventata oggi un obiettivo politico fondamentale per dotare tutti coloro che possiedono le conoscenze di base della scuola dell’obbligo di strumenti critici per l’interpretazione della realtà rappresentata per mezzo di dati digitali. *Dal 23 febbraio al 15 giugno*, 9 lezioni e 2 approfondimenti costituiscono la prima edizione della *Scuola pop sui dati digitali, *organizzata dalla Scuola critica del digitale del CRS e dal Forum Disuguaglianze e Diversità.
