I server di Outlook all'estero sono salvi per il momento/ venerdì 15 luglio 2016 di Alfonso Maruccia Roma - La Corte di Appello del Secondo Circuito ha emesso una sentenza in favore di Microsoft, chiudendo (per il momento) una vicenda che si trascina da anni e che riguarda il tentativo di accesso a un account utente gestito dalla corporation su server stranieri. I giudici hanno ribaltato la sentenza di primo grado che costringeva Microsoft a tirare fuori i dati, stabilendo che il Governo americano non può costringere un'azienda privata a consegnare le informazioni gestite per conto terzi: le norme dello Stored Communications Act (SCA) non valgono fuori dalla giurisdizione USA, e men che meno per il territorio irlandese come nel caso in oggetto. Given those constraints, I still want to discuss something which has altered “the game” so much that the existing guidebook needs to be significantly revised. I am not a military strategist, but I have lived through a couple coups here in Thailand, so I have some first hand experience of what they look like. The guide book to running a coup is still Luttwak’s Coup d’État, but it needs to be revised to reflect the use of cyberpower. The focus of those provisions is protection of a user’s privacy interests. Accordingly, the SCA does not authorize a U.S. court to issue and enforce an SCA warrant against a United States‐based service provider for the contents of a customer’s electronic communications stored on servers located outside the United States. The SCA warrant in this case may not lawfully be used to compel Microsoft to produce to the government the contents of a customer’s e‐mail account stored exclusively in Ireland. Because Microsoft has otherwise complied with the Warrant, it has no remaining lawful obligation to produce materials to the government. We therefore REVERSE the District Court’s denial of Microsoft’s motion to quash; we VACATE its order holding Microsoft in civil contempt of court; and we REMAND this cause to the District Court with instructions to quash the warrant insofar as it demands user content stored outside of the United States." -- Prof. Avv. La richiesta di sorveglianza traina il riconoscimento facciale. I francesi del gruppo Safran, i giapponesi di NEC e Ayonix, i tedeschi di Cognitec, gli olandesi di Gemalto, le statunitensi Animetrics, Aware, 3M Cogent, i britannici di Cybula, e gli italiani di Eurotech sono alcuni dei nomi ricorrenti in questi report. Oltre a ciò, un sottobosco di startup che si stanno specializzando in funzioni o settori specifici. L’Italia e il taggare i terroristi Il nome dell’udinese Eurotech era circolato anche quando il presidente del Consiglio Renzi, lo scorso 21 novembre, aveva parlato di riconoscimento facciale in funzione di controterrorismo e di voler “taggare” (presumibilmente: identificare) tutti i sospetti <http://www.lastampa.it/2015/11/21/tecnologia/renzi-litalia-pu-diventare-il-…>. Principio ribadito anche dal ministro dell’Interno Angelino Alfano, secondo il quale il governo aveva un piano di potenziamento del sistema di sicurezza del Paese anche attraverso il riconoscimento facciale, che non includeva soltanto gli aeroporti. Come sarebbe avvenuto in pratica, dove, con quali tecnologie e aziende non era però affatto chiaro. «Non mi risulta che siamo stati contattati in relazione a quel progetto», commenta oggi alla Stampa Roberto Siagri, ad di Eurotech. «Non so neanche se tale progetto sia mai partito». Il bando italiano È partita però una gara pubblica, indetta proprio il 26 novembre scorso. L’obiettivo è la “fornitura di sistemi di videosorveglianza sia per gli edifici in uso alle pubbliche amministrazioni sia per il territorio”. I sistemi realizzati dovranno poter integrare funzionalità avanzate di analisi video in tempo reale “come il riconoscimento facciale” e dovranno essere uno strumento significativo “per la realizzazione dei progetti del Governo in merito alla sorveglianza e alla sicurezza del territorio”, è scritto nel bando. Valore della fornitura: 56 milioni di euro in tre anni. Il termine per la ricezione delle offerte è stato il primo marzo 2016, ma del suo esito ancora non si sa nulla. []
