The newest of these is the so-called law enforcement sensitive privilege, now regularly invoked to shield new (and sometimes not so new) techniques and methods used to investigate and prevent crime. In one notable recent criminal case, a federal judge in Arizona invoked this privilege to justify withholding evidence about an electronic device known as the “Stingray”, which the FBI had used to track down a suspect accused of identity theft and tax fraud. Until now, the paternity of this privilege has been obscure, although bits and pieces of the story are well-known and documented. This article attempts to assemble those pieces into a coherent genealogy. Our tale begins with three fascinating protagonists: a Barnard College alumna recruited as a Soviet spy while working under the government’s nose in the Justice Department; the most brilliant and influential federal judge never to sit on the Supreme Court; and the famously secretive law enforcement icon who built the FBI into the nation’s foremost crime-fighting force. All three came together at a seminal moment in the McCarthy Era, with a combustive force whose impact lingers to this day. This was the moment of conception for the law enforcement privilege. The balance of the article traces this doctrine’s growth to maturity, including (ironically) the passage of the Freedom of Information Act; subsequent DOJ-sponsored FOIA amendments exempting investigative files; early court decisions adopting a limited surveillance location privilege; and later decisions recognizing a qualified privilege for law enforcement “sensitive” information. Along the way we pause to relate a personal encounter with the FOIA exemption for law enforcement techniques. Rustad * Today, 6.00 pm Webcast live: http://cyber.law.harvard.edu/interactive/webcast http://nexa.polito.it/berkman-webcast-live Based on the authors’ recent Harvard Journal of Law and Technology article, Reconceptualizing the Right to be Forgotten to Enable Transatlantic Data Flow, Sanna Kulevska and Michael Rustad will lay out the legal dilemmas that flow from the European Union’s far-reaching right to be forgotten (RTBF). Google Spain v. AEPD (May 2014) and Article 17 of the General Data Protection Regulation (GDPR), which will go into effect in 2018, are already driving a significant legal, economic and cultural wedge between the U.S. and its EU trading partners. In October 2015, the European Court of Justice (CJEU) struck down the U.S./EU Safe Harbor agreement that enabled data to be freely transferred from Europe to the United States and in February 2016, the EU/U.S. Privacy Shield was proposed as a replacement. Sanna and Michael will lead the discussion of the legal dilemmas that policymakers face in walking the tight rope between the Scylla of constraining the right of expression and the Charybdis of diminishing an individual’s right to control their personal data. The authors will use current case studies of takedown requests from Google to provide context for their discussion of how a Safe Harbor 2.0 might achieve the proper balance between expression and privacy. The FBI Now Says It May Crack That iPhone Without Apple’s Help

Just as the FBI’s standoff with Apple seemed to be coming to a head, the government has abruptly changed course. And it may be backing down altogether from the most public battle in the growing war between law enforcement and tech firms over encryption. On Monday afternoon, the Justice Department filed a motion for a continuance on a hearing set to happen tomorrow in Riverside, California, where it would have argued its case that Apple must help it to crack the iPhone 5C of dead San Bernardino killer Syed Rizwan Farook. The FBI hasn’t given up on accessing the data in Farook’s phone. But it now says it may not need Apple’s assistance to crack the device after all, which it had previously told a judge it could legally compel using the 1789 law known as the All Writs Act. “On Sunday, March 20, 2016, an outside party demonstrated to the FBI a possible method for unlocking Farook’s iPhone,” the Justice Department’s lawyers wrote in a court filing. “Testing is required to determine whether it is a viable method that will not compromise data on Farook’s iPhone. Il potenziale sta tutto nella loro ragione d’essere: veicoli di informazioni, strumenti che accelerano e semplificano il processo di creazione e condivisione della conoscenza, abilitando le persone a compiere le scelte in maniera più consapevole e aiutandole a diventare protagoniste dell'evoluzione (rivoluzione) desiderata. Senza cadere nei facili entusiasmi e nel tecno-ottimismo, è tuttavia opportuno considerare che non è il loro possesso a determinarne l’impatto, quanto l’intenzione popolare e non elitaria che sta alla base del loro utilizzo - che deve essere il più sostenibile, indigeno, resiliente ed etico possibile. La sfida per le ong e, più in generale, per tutti gli attori pubblici o privati della cooperazione internazionale è duplice: sul campo, usare le ICT per valorizzare la conoscenza locale, fare advocacy, supportare i germi del cambiamento e dell'emancipazione; nei quartier generali, rendere i processi organizzativi più efficienti, aprirsi alla condivisione e alla trasparenza. Due sfide che, perlopiù, richiedono l'umiltà di mettere da parte lo sviluppo tecnologico per porre al centro la persona umana e il contesto in cui vive. Come diventare, allora, "ICT4D champion"?
