Ballon d'essai di azione delle DP nazionali dopo SH? <http://www.cnil.fr/english/news-and-events/news/article/the-french-data-pro…> The French data protection authority publicly issues formal notice to FACEBOOK to comply with the French Data Protection Act within three months 08 February 2016 The Chair of the Commission Nationale de l’Informatique et des Libertés (CNIL) issued formal notice to FACEBOOK to fairly collect data concerning the browsing activity of Internet users who do not have a FACEBOOK account. FACEBOOK must also provide account holders with the means to object to the compiling of their data for advertising purposes. Following FACEBOOK statement regarding the amendment of its privacy policy, a working group, composed of the five data protection authorities that decided to investigate the matter (France, Belgium, The Netherlands, Spain and Hamburg), was set up in March 2015 among the Article 29 Working Party. In this context, the CNIL performed on site and online inspections, as well as a documentary audit, in order to verify that FACEBOOK was acting in compliance with the French Data Protection Act. This has revealed several failures: [...] FACEBOOK transfers personal data to the United States on the basis of Safe Harbor, although the Court of Justice of the European Union declared invalid such transfers in its ruling of October 6, 2015. [...] This notice is not a sanction and the procedure will be publicly closed if the companies comply with the French data protection Act within the time limit. On the contrary, if FACEBOOK Inc. and FACEBOOK Ireland Limited have not complied with the formal notice within the time limit, the Chair shall appoint a “rapporteur” who might refer the matter to the CNIL’s Select Committee with a view to deciding a sanction. The investigations conducted by the Belgian, German (Land of Hamburg), Spanish and Dutch data protection authorities are ongoing at the national level and within an international administrative cooperation framework. Una class action storica per il riconoscimento del digital labor

Una class action storica è stata intentata negli Stati Uniti contro il "lavoro dissimulato" rappresentato dai reCAPTCHA di Google (che come utilizzate per l'apprendimento degli algoritmi di riconoscimento di testi e immagini di Google Books et Street View). Per quanto non autorizzata da un giudice federale, questa class action rappresenta un importantissimo passo in avanti nella presa di coscienza delle forme attuali del digital labor, lavoro implicito degli utilizzatori di piattaforme digitali. Le motivazioni del giudice federale sono essenzialmente due: il ricorso era mal fatto; les Terms of service di Google autorizzano la piattaforma a richiedere questo tipo di contribuzione ai suoi utilizzatori. Il ricorso arriva dopo che simili vertenze erano state proposte da utilizzatori di Yelp e Huffinghton Post per il riconoscimento, rispettivamente, dei commenti e dei post come attività lavorative. Analoghe azioni legali avevano riguardato gli utilizzatori di AOL nel 1999, che avevano ottenuto la creazione dello statuto di community manager (e una compensazione di 15 milioni di dollari). Se vogliamo fare l'agenda digitale, magari non generando il pdf direttamente dal testo, che forse è troppo difficile, magari non la firma digitale, che è troppo sofisticata, ma almeno uno scanner che tenga i fogli dritti!
