Il Registro delle Opposizioni: perché non c'è un'API gratuita?

Cari Amici, da parecchio tempo mi scontro, come cittadino, con la relativamente limitata efficacia del Registro delle Opposizioni (eufemismo, nel mio caso, ma forse sono sfortunato io: non ho evidenza statisticamente rilevante)... (Per chi non avesse familiarità col tema, il Registro è un servizio a tutela del cittadino, dove sono presenti i numeri di chi "decide di non voler più ricevere telefonate per scopi commerciali o di ricerche di mercato e, in pari tempo, è uno strumento per rendere più competitivo, dinamico e trasparente il mercato tra gli Operatori di marketing telefonico": http://www.registrodelleopposizioni.it/) Inizialmente, pensavo l'efficacia modesta del Registro fosse dovuta ad un problema di enforcement da parte del Garante: insomma, credevo che violare la norma costasse troppo poco. Forse questo elemento c'è (stando al sito del Garante, dal febbraio 2011 all'aprile 2015, il Garante stesso ha contestato sanzioni per 2.500.000 euro... non è una cifra enorme, considerando l'apparentemente smodato numero di violazioni; per inciso, le segnalazioni sono state "solo" 18.000). Tuttavia, la mia attenzione è stata recentemente richiamata sull'altro lato dell'equazione: il costo della compliance, del rispetto della norma. Guardando questa tabellina http://www.registrodelleopposizioni.it/it/operatori/home-operatori potrete facilmente appurare che chi volesse controllare un bel database della maggior parte dei numeri di telefono italiani dovrebbe spendere più di 200.000 euro! Forse il caso di cui sopra non si dà o non dovrebbe darsi. Ma i costi sono comunque ingenti, se pensate che anche un "normale" operatore che debba verificare molti meno numeri deve rifarlo ogni 15 gg., sicché i costi lievitano. Insomma, temo sia più conveniente rischiare una multa che pagare. Ma c'è di peggio. Come mostra questo (http://registro-opposizioni.blogspot.it/) blog post, era già chiaro nel 2011 che la scelta, per alcuni tipi di operatori, è tra pagare e chiudere, ergo uno si prende il rischio, e spera bene. Perché scrivo in lista? Da una parte, perché forse qualcuno ho studiato meglio di me il problema e può mostrarmi che il sottoscritto ed il blogger citato si sbagliano: il registro funziona (sono solo sfortunato io) ed i costi non sono così proibitivi (per gli operatori che lavorano in modo "serio"). D'altro canto, mi chiedevo anche cosa osti a mettere su un servizio che, tramite API, risponda "0" o "1" quando viene inviato un singolo numero di telefono: a mio, poco informato, parere, questa cosa fatta in modo furbo potrebbe star su col PC del mio ufficio, e permetterebbe ad una serie di più o meno piccoli call center che vivono nell'illegalità o quasi di non avere più alibi. L'operatore, prima di chiamare, dovrebbe solo pigiare un tastino e aspettare mezzo secondo per avere la luce verde del Registro in tempo reale e per le sole chiamate che deve fare. Inoltre, sto prendendo delle cantonate, oppure non si giustificano tecnicamente i costi della tabella http://www.registrodelleopposizioni.it/it/operatori/home-operatori ? Insomma, il Registro è gestito da un soggetto no-profit, e dovrebbe avere costi limitati, per incentivare alla compliance. Com'è possibile che sia percepito come proibitivamente caro? Blocking Orders due to Copyright Reasons violate Art. 16 of the Charter of Fundamental Rights of the European Union, as well as Art. 11, on freedom of expression and information.

Judgment of the OLG Cologne on network blocking (18 July 2014, 6 U 192/11) The decision of the Appellate Court of Cologne represents the first further development of principles laid down by the CJEU in UPC Telekabel Wien GmbH v. Constantin Film Verleih GmbH. The close assessment of various EU Directives is of particular interest. The close assessment of the various European Directives as well as the well considered balancing of fundamental rights is particularly remarkable. This judgment might pave the way for limiting an over emphasis on copyright to the detriment of the freedom of information and the economic freedom of copyright providers. The Claimants, leading music publishers, requested that the Defendant, a telecommunication service and access provider, block access to certain internet services which allow file sharing, alleging multiple violations of their copyrights. The Defendant denied any liability at which point the Claimants initiated an action to seek a blocking order. The Court Stated that: While the Defendant could be qualified as an intermediary in the sense of Art. 8(3) of Directive 2001/29/EC this would be limited by Art. 15(1) of Directive 2000/31/EC of the European Parliament and of the Council of 8 June 2000 on certain legal aspects of information society services, in particular electronic commerce, in the Internal Market, which provided that Member States should not impose a duty on ISPs to actively examine information which is transmitted through their services and to search for illegal acts Moreover, any such measure would be incompatible with Art. 3 of Directive 2004/48/EC which stipulates that any measures to protect copyrights has to be fair and just. The attempt to harmonise the economic freedom of access providers according to Art. 16 of the Charter of Fundamental Rights of the European Union as well as Art. 11 of the Charter, namely the freedom of information with copyright, which is protected under Article 17 of the Charter, had to also be based on the fact that the copyright did not constitute a complete right. In addition, the Member States had to ensure that in case of conflicting fundamental rights a balance is struck and the principle of proportionality met. To request that the Defendant block access violated this principle, particularly as it would be difficult to effectively avoid copyright violations by way of introducing such blocking measures. We conceive big data as constituted by three components: the automatic generation of very large and diverse data sets which are mainly the result of the digitisation of modern societies, their processing by algorithms and their use for decision-making and regulation, in the private or public sector. This includes purposes such as profiling, monitoring, predictive analysis and risk calculation. Mayer-Schönberger & Cukier claim that big data is a “revolution that will transform how we live, work, and think” (2014). But whereas revolutions imply a profound shift in power relations, there is little scientific evidence about whether and, if so, how big data affects power relations. We understand power as the production, in and through social relations, of effects that shape the capacities of actors to determine their fate. Power opens up or closes off options to act for parties involved and it is multi-dimensional: it is influence over others, empowerment, the capacity to act and to self-discipline. SCOPE OF THE SPECIAL ISSUE The aim of the special issue in the Internet Policy Review is to explore the extent to which big data shapes society by influencing power relations and, in return, how the development of big data-related phenomena is itself shaped by power relations. We welcome proposals that address power relations linked to big data phenomena in various fields, as long as they bear a relevance to European societies and highlight policy implications or make a reference to regulatory debates. Papers can have both a more conceptual or a more empirical focus. This call for papers is open to researchers from the fields of policy studies, sociology, law, philosophy, data, information and technology studies, economics and management and related fields. Emerging scholars are particularly encouraged to submit a proposal. FOCUS OF THE PAPERS As stated above, scientific knowledge about which power relations shape the big data society is still scarce. Yet much has been said about the many promising and worrying aspects of a society built on predictive analysis, machine learning and algorithmic regulation, and various implicit and explicit hypotheses about the power effects of big data have emerged in the academic and public debate. * Empowerment of users/citizens/patients: Will big data empower users, citizens and patients through applications and services (tailored services, e-participation, e-health)? * Power shifts and conflicts over power between actors: o Does big data alter the power relation between states and citizens (‘surveillance society’, ‘governing the poor’, manipulation of voters by individualised election campaigns)? o Do personalised marketing and the monitoring of staff affect the power relations between companies and users or employees? o Do new power relations between companies, political candidates/parties or states arise due to unequal access to big data applications? o Does big data influence the relative importance of scientific disciplines or professions (data analysts versus lawyers and economists)? * Different modes of decision-making and knowledge production: Are current norms and practices threatened by ‘algorithmic regulation’ and the ‘end of theory’? * Power relations shaping big data: How do power relations shape the development of big data and the precise big data related practices, modes of production and application fields? * Narratives: How are big data related power relations addressed, problematized or, on the contrary, masked? * Regulation of big data: What regulations are relevant for big data related power relations? http://useu.usmission.gov/st-09282015.html Safe Harbor Protects Privacy and Provides Trust in Data Flows that Underpin Transatlantic TradeStatement | Brussels, Belgium | September, 28 2015 The United States Government and the European Commission have been engaged in a very productive and substantial dialogue to improve and strengthen the Safe Harbor Framework. The framework has been critically important to the protection of individual privacy and the conduct of commerce on both sides of the Atlantic; it has served and continues to serve as a model around the world for the protection of individual privacy and flow of data across national borders. We are optimistic that our discussions will conclude soon with a positive outcome for both sides. The future of the Safe Harbor Framework, however, has now been called into question by the Advocate General's recent opinion in Maximillian Schrems v. Data Protection Commissioner. We fully respect the European Union's legal process; however, we believe that it is essential to comment in this instance because the Advocate General's opinion rests on numerous inaccurate assertions about intelligence practices of the United States. The Advocate General's opinion notes that it was required to accept the facts as found by the Irish High Court. There was, however, no actual fact-finding in this case; instead, the Irish High Court concluded, on the basis of exhibits to plaintiff's affidavits that the accuracy of his allegations regarding U.S. intelligence practices "is not in dispute." But that is simply not the case, as the public record made clear at the time, and as has been made even clearer in the subsequent two years. The United States does not and has not engaged in indiscriminate surveillance of anyone, including ordinary European citizens. The PRISM program that the Advocate General's opinion discusses is in fact targeted against particular valid foreign intelligence targets, is duly authorized by law, and strictly complies with a number of publicly disclosed controls and limitations. Moreover, the Advocate General's opinion fails to take into account that -- particularly in the last two years - President Obama has taken unprecedented steps to enhance transparency and public accountability regarding U.S. intelligence practices, and to strengthen policies to ensure that all persons are treated with dignity and respect, regardless of their nationality or place of residence. The Advocate General's opinion also errs in inviting the European Court of Justice to conclude that the current Safe Harbor Framework is inadequate because the United States and the European Commission are positively engaged in an effort to strengthen it. On the contrary, the Framework was conceived as a living document, and this is not the first time that the two sides have engaged to improve its operation. On both sides, there has been a strong desire to make sure that we improve the Framework, and these efforts should be encouraged. Moreover, the underlying issue here also goes far beyond the Safe Harbor Framework. The Advocate General's reasoning would undercut the ability of other countries, businesses and citizens to rely upon negotiated arrangements with the European Commission. Given the important privacy and trade benefits that Safe Harbor provides to EU and US citizens and businesses, we will continue to work closely with the European Commission to improve the Safe Harbor Framework. Gli Ordini di blocco allaccesso attraverso i DNS, a protezione del diritto dAutore, vìolano gli Art 16 ed 11 della Carta Fondamentale dellUnione Europea, sono contrari alla Direttiva sul Commercio Elettronico, e si pongono in diretta violazione dei principi stabiliti dalla Carta Costituzionale Tedesca. E netta la condanna dei Tribunali Tedeschi sugli ordini di inibizione allaccesso per i propri cittadini a protezione del diritto dautore. Secondo la Corte dappello di Colonia, nel caso 18 july 2014, 6 U 192/11, che riprende integralmente la pronuncia Telekabel della Corte di Giustizia dellUnione Europea, gli ordini di blocco di questo tipo si risolvono in realtà nella violazione dell'art. 15 (1), della direttiva 2000/31/CE.
