by Giuseppe Futia Feb. 1, 2016

Feb. 1, 2016

U.S. Judge Rules Microsoft Must Produce Emails Held Abroad
by Alessandro Mantelero Sept. 14, 2015

Sept. 14, 2015

U.S. Judge Rules Microsoft Must Produce Emails Held Abroad Judge Rules Company Must Comply With a U.S. Warrant for Email Stored at Data Center in Ireland Microsoft must comply with a U.S. warrant for customer email stored in a company data center in Ireland, a federal judge ruled Thursday. The search warrant was issued as part of a criminal investigation whose details remain secret. It is unclear whether the customer targeted by the Justice Department is located in the U.S. The company's lawyers had argued that the Justice Department needed to obtain the emails through a legal treaty with Ireland, and that forcing Microsoft to retrieve them without the country's consent violated Irish sovereignty and international law. But Chief U.S. District Judge Loretta Preska in Manhattan federal court ruled that the location of the email was irrelevant, because Microsoft controlled it from the U.S. Microsoft General Counsel Brad Smith said Thursday, "The only issue that was certain this morning was that the District Court's decision would not represent the final step in this process. "We will appeal promptly and continue to advocate that people's email deserves strong privacy protection in the U.S. and around the world," he added. continua qui: http://online.wsj.com/articles/u-s-judge-rules-microsoft-must-produce-email… -- Avv. LA PROCURA DI GENOVA DECAPITA POPCORNTIME, IL NETFLIX DEL DIRITTO D'AUTORE NON AUTORIZZATO.
by Fulvio Sarzana Aug. 31, 2015

Aug. 31, 2015

OECD: "Enquiries into Intellectual Property's Economic Impact"
by J.C. DE MARTIN Aug. 29, 2015

Aug. 29, 2015

(h/t Quinta) OECD*: **Enquiries into Intellectual Property's Economic Impact* http://www.oecd.org/sti/ieconomy/intellectual-property-economic-impact.htm Download the full report: http://www.oecd.org/sti/ieconomy/KBC2-IP.Final.pdf *Contents* Chapter 1: Synthesis Chapter 2: Measuring the Technological and Economic Value of Patents Chapter 3: Approaches to the Protection of Trade Secrets Chapter 4: An Empirical Assessment of the Economic Implications of Protection for Trade Secrets Chapter 5: Copyright in the Digital Era: Country Studies Chapter 6: Design and Design Frameworks: Investing in KBC and Economic Performance Chapter 7: Legal Aspects of Open Access to Publicly Funded Research Chapter 8: Summary of the Expert Workshop, "Society's Gain from the Intellectual Property Exchange" Chapter 9: IP-Based Financing of Innovative Firms *Background* Investment and growth in OECD economies is increasingly driven by investment in intangible assets, also known as knowledge-based capital (KBC). In many OECD countries, firms now invest as much or more in KBC as they do in physical capital such as machinery, equipment and buildings. This shift reflects a variety of long-term economic and institutional transformations in OECD economies. The rise of KBC creates new challenges for policymakers, for business and for the ways in which economic activity is measured. Many policy frameworks and institutions are still best suited to a world in which physical capital drove growth. New thinking is needed to update a range of policy frameworks – from tax and competition policies to corporate reporting and intellectual property rights. Two key findings of phase one of the Knowledge-based capital project were that business investment in KBC is linked to growth and higher productivity, and KBC has become more prevalent in OECD economies, spreading across many different industries, growing over time in the aggregate, and developing into the largest form of business investment in an increasing number of countries. Because so much KBC is protected by intellectual property rights, IP-protected capital has taken on an increasingly prominent and extensive role in economic activity as KBC has grown. As part of phase two of the KBC project, this report takes a closer look at IP’s role in OECD economies while examining some of the most significant changes to the landscape in which it is operating, including digitisation and the growth of the Internet.

diritti di esclusiva su digitalizzazione documenti PA
by Simone Aliprandi Aug. 28, 2015

Aug. 28, 2015

IS via web?("a lifetime of supervised release and monitoring of his internet activities" http://www.justice.gov/opa/pr/virginia-man-sentenced-more-11-years-providin…) f.

Paper: "The spectrum of control: A social theory of the smart city"

*The spectrum of control: A social theory of the smart city* /by Jathan Sadowski and Frank Pasquale/ First Monday, Volume 20, Number 7 - 6 July 2015 http://firstmonday.org/ojs/index.php/fm/article/view/5903/4660 doi: http://dx.doi.org/10.5210/fm.v20i7.5903 This paper is licensed under a Creative Commons Attribution-NonCommercial-NoDerivatives 4.0 International License. *Abstract* There is a certain allure to the idea that cities allow a person to both feel at home and like a stranger in the same place. That one can know the streets and shops, avenues and alleys, while also going days without being recognized. But as elites fill cities with “smart” technologies — turning them into platforms for the “Internet of Things” (IoT): sensors and computation embedded within physical objects that then connect, communicate, and/or transmit information with or between each other through the Internet — there is little escape from a seamless web of surveillance and power. This paper will outline a social theory of the “smart city” by developing our Deleuzian concept of the “spectrum of control.” We present two illustrative examples: biometric surveillance as a form of monitoring, and automated policing as a particularly brutal and exacting form of manipulation. We conclude by offering normative guidelines for governance of the pervasive surveillance and control mechanisms that constitute an emerging critical infrastructure of the “smart city.” *Contents* I. Smartwatch or spyware? Considering privacy & IoT
by Alessandro Mantelero Aug. 21, 2015

Aug. 21, 2015

Smartwatch or spyware? Considering privacy & IoT The spread of Internet-enabled gadgets means that more data is collected about our daily lives than ever before. Smartwatches track locations and health conditions while in-home devices learn our daily habits. Combined with big data, this information reveals an intimate portrait. And with the number of connected things expected to hit 25 billion by 2020, tech companies are poised to have incredible insight into consumer behavior. Yet all of this innovation raises privacy concerns. Policymakers are already urging companies to safeguard this data, which is already being used in lawsuits. And if consumers feel their privacy is threatened, they may turn their backs on the Internet of Things. Pasquale: "Digital Star Chamber: Algorithms are producing profiles of you. What do they say? You probably don’t have the right to know"
by J.C. DE MARTIN Aug. 18, 2015

Aug. 18, 2015

*DIGITAL STAR CHAMBER** **Algorithms are producing profiles of you. What do they say? You probably don’t have the right to know** * Frank Pasquale is a professor of law at the University of Maryland and a specialist on challenges posed to information law by technology. His book, The Black Box Society (2015), develops a social theory of reputation, search, and finance. In a recent podcast series called Instaserfs, a former Uber driver named Mansour gave a chilling description of the new, computer-mediated workplace. First, the company tried to persuade him to take a predatory loan to buy a new car. Apparently a number cruncher deemed him at high risk of defaulting. Second, Uber would never respond in person to him – it just sent text messages and emails. This style of supervision was a series of take-it-or-leave-it ultimatums – a digital boss coded in advance. Strickling: "An Update on the IANA Transition"
by J.C. DE MARTIN Aug. 18, 2015

Aug. 18, 2015

*An Update on the IANA Transition** * August 17, 2015 by Assistant Secretary for Communications and Information and NTIA Administrator Lawrence E. Strickling http://www.ntia.doc.gov/blog/2015/update-iana-transition The Internet’s global multistakeholder community has made tremendous progress in its work to develop a proposal to transition the historic stewardship role NTIA has played related to Internet’s domain name system (DNS). When we announced <http://www.ntia.doc.gov/press-release/2014/ntia-announces-intent-transition…> our intent in March 2014 to complete the privatization of the DNS, we noted that the base period of our contract with ICANN to perform technical functions related to the DNS, known as the IANA functions, expired on September 30, 2015. However, it has become increasingly apparent over the last few months that the community needs time to complete its work, have the plan reviewed by the U.S. Government and then implement it if it is approved. Accordingly, in May we asked the groups developing the transition documents how long it would take to finish and implement their proposals. After factoring in time for public comment, U.S. Government evaluation and implementation of the proposals, the community estimated it could take until at least September 2016 to complete this process. In response to their feedback, we informed Congress on Friday that we plan to extend our IANA contract with ICANN for one year to September 30, 2016. Beyond 2016, we have options to extend the contract for up to three additional years if needed. This one-year extension will provide the community with the time it needs to finish its work. The groups are already far along in planning the IANA transition and are currently taking comments on their IANA transition proposals. As we indicated in a recent Federal Register notice <http://www.ntia.doc.gov/files/ntia/publications/fr_iana_transition_comment_…>, we encourage all interested stakeholders to engage and weigh in on the proposals. In preparation for the implementation phase of the IANA stewardship transition, NTIA also asked Verisign and ICANN to submit a proposal detailing how best to remove NTIA’s administrative role associated with root zone management, which the groups working on the transition were not asked to address. We asked Verisign and ICANN to submit a proposal detailing how best to do this in a manner that maintains the security, stability and resiliency of the DNS. Under the current root zone management system, Verisign edits and distributes the root zone file after it has received authorization to do so from NTIA. Verisign and ICANN have developed a proposal <http://www.ntia.doc.gov/files/ntia/publications/root_zone_administrator_pro…> that outlines a technical plan and testing regime for phasing out the largely clerical role NTIA currently plays in this process. The testing will occur in a parallel environment that will not disrupt the current operation of the root zone management system. These developments will help ensure that the IANA transition will be done in a manner that preserves the security and stability of the DNS.

New Report (Center for Media Justice): "The Digital Culture SHIFT: From Scale to Power"
by J.C. DE MARTIN Aug. 16, 2015

Aug. 16, 2015

*Center for Media Justice: How the Internet is Shaping Social Change, and Social Change is Shaping the Internet **Summary* As activism for police accountability, fair wages, just immigration, and more takes center stage — social justice movements of the 21st century are using technology to achieve greater scale and reach wider audiences. But are these digital strategies building power for long-term social change, or helping maintain the status quo? A new report from the Center for Media Justice says the answer depends on the strategy — and offers new approaches and recommendations, from a diverse cross-section of leaders, for building effective social movements in an age of big data and digital technology. *Key Takeaways* The strategies and approaches in the Digital CultureSHIFT report provide a path forward for addressing the way social movements integrate new approaches , or remain stuck in a cycle that limits our effectiveness. What We Learned 100% of those interviewed said that digital strategies and platforms provide a voice when mainstream media ignores issues. The vast majority of leaders interviewed widely use digital platforms to catalyze action, but say over-reliance on these tools can limit relationship-building. The Internet is helping to shift national organizations from centralized to decentralized, from geographically specific to geographically diverse, and from hierarchical leadership to multi-level leadership. Targeted surveillance is a top concern — but the vast majority of leaders of color interviewed felt that advocacy for digital privacy did not include their voices or their visions for change. Lemov: "On Not Being There: The Data-Driven Body at Work and at Play"
by J.C. DE MARTIN Aug. 16, 2015

Aug. 16, 2015

The Hedgehog Review/: Vol. 17 No. 2 (Summer 2015) On Not Being There: The Data-Driven Body at Work and at Play Rebecca Lemov The protagonist of William Gibson’s 2014 science-fiction novel /The Peripheral/, Flynne Fisher, works remotely in a way that lends a new and fuller sense to that phrase. The novel features a double future: One set of characters inhabits the near future, ten to fifteen years from the present, while another lives seventy years on, after a breakdown of the climate and multiple other systems that has apocalyptically altered human and technological conditions around the world. In that “further future,”1 <http://iasc-culture.org/THR/THR_article_2015_Summer_Lemov.php#endnotes> only 20 percent of the Earth’s human population has survived. Each of these fortunate few is well off and able to live a life transformed by healing nanobots, somaticized e-mail (which delivers messages and calls to the roof of the user’s mouth), quantum computing, and clean energy. For their amusement and profit, certain “hobbyists” in this future have the Borgesian option of cultivating an alternative path in history—it’s called “opening up a stub”—and mining it for information as well as labor. Flynne, the remote worker, lives on one of those paths. A young woman from the American Southeast, possibly Appalachia or the Ozarks, she favors cutoff jeans and resides in a trailer, eking out a living as a for-hire sub playing video games for wealthy aficionados. Recruited by a mysterious entity that is beta-testing drones that are doing “security” in a murky skyscraper in an unnamed city, she thinks at first that she has been taken on to play a kind of video game in simulated reality. As it turns out, she has been employed to work in the future as an “information flow”—low-wage work, though the pay translates to a very high level of remuneration in the place and time in which she lives. What is of particular interest is the fate of Flynne’s body. Before she goes to work she must tend to its basic needs (nutrition and elimination), because during her shift it will effectively be “vacant.” Lying on a bed with a special data-transmitting helmet attached to her head, she will be elsewhere, inhabiting an ambulatory robot carapace—a “peripheral”—built out of bio-flesh that can receive her consciousness. NYT: "AT&T Helped U.S. Spy on Internet on a Vast Scale"
by J.C. DE MARTIN Aug. 16, 2015

Aug. 16, 2015

*AT&T Helped U.S. Spy on Internet on a Vast Scale* By Julia Angwin, Charlie Savage, Jeff Larson, Henrik Moltke, Laura Poitras and James Risen AUG. 15, 2015 The National Security Agency’s ability to spy on vast quantities of Internet traffic passing through the United States has relied on its extraordinary, decades-long partnership with a single company: the telecom giant AT&T. While it has been long known that American telecommunications companies worked closely with the spy agency, newly disclosed N.S.A. documents show that the relationship with AT&T has been considered unique and especially productive. One document described it as “highly collaborative,” while another lauded the company’s “extreme willingness to help.” AT&T’s cooperation has involved a broad range of classified activities, according to the documents, which date from 2003 to 2013. AT&T has given the N.S.A. access, through several methods covered under different legal rules, to billions of emails as they have flowed across its domestic networks. It provided technical assistance in carrying out a secret court order permitting the wiretapping of all Internet communications at the United Nations headquarters, a customer of AT&T.
