A queste ed altre domande tenteranno di rispondere le due giornate di dibattito e formazione previste a Bologna per il 18 e 19 novembre 2015 presso il Centro Congressi CNR, via Gobetti 101. *Open research data: creating bridges for Open Science* (18 novembre) e’ il primo appuntamento, dedicato in particolare ai docenti e ai giovani ricercatori, con la partecipazione di Peter Murray-Rust <http://blogs.ch.cam.ac.uk/pmr/>, professore emerito di Chimica a Cambridge, attivo sostenitore della Open Science e ideatore di strumenti per l'uso dei dati aperti, ed Erin McKiernan <https://emckiernan.wordpress.com/>, giovane ricercatrice in neuroscienze che ha fatto dell'openness il paradigma della sua ricerca. Sono previste due relazioni e due momenti di condivisione e confronto sui temi della scienza aperta. Il pomeriggio sara' invece dedicato a come fare Open Access e Open Science in pratica, con largo spazio alle domande dei ricercatori presenti. La giornata del 18 novembre e' un evento satellite della Conferenza internazionale OpenCon 2015 <http://www.opencon2015.org/>, “Empowering the next generation to advance. Open Access, Open Education and Open data”. La seconda giornata, *Data Management Plans: principles and practice* (19 novembre) è dedicata ai tecnici che si occupano della gestione e metadatazione dei set di dati, in particolare bibliotecari e personale degli uffici ricerca. Alle due brevi introduzioni di Peter Murray-Rust ed Erin McKiernan seguira' un corso pratico di quattro ore a cura di Sarah Jones <http://www.dcc.ac.uk/about-us/dcc-staff-directory/sarah-jones>, del Digital Curation Centre di Glasgow, punto di riferimento europeo. Il Parlamento Europeo rilancia sulla risoluzione sulla sorveglianza di massa e quindi anche su Safe Harbor. on the follow-up to the European Parliament resolution of 12 March 2014 on the electronic mass surveillance of EU citizens (2015/2635(RSP)) <http://www.europarl.europa.eu/sides/getDoc.do?type=MOTION&reference=B8-2015…> [] EU-US umbrella agreement 11. Notes that since the adoption of the resolution the negotiations with the US on the EU-US framework agreement on the protection of personal data when transferred and processed for law enforcement purposes (hereinafter the ‘umbrella agreement’) have been completed and the draft agreement has been initialled; 12. Welcomes the efforts by the US administration to rebuild trust through the umbrella agreement, as well as the fact that the Judicial Redress Act of 2015 has been put before Congress; considers it of paramount importance to ensure the same rights in all the same circumstances of effective judicial redress for EU citizens/individuals whose personal data are processed in the EU and transferred to the US, without any discrimination between EU and US citizens; calls on Congress to pass legislation guaranteeing this; underlines that one prerequisite for signature and conclusion of the umbrella agreement is the adoption of the Judicial Redress Act in the US Congress; Safe Harbour 13. Recalls that the resolution calls for the immediate suspension of the Safe Harbour Decision as it does not provide adequate protection of personal data for EU citizens; 14. Recalls that the Commission addressed 13 recommendations to the US in its communications of 27 November 2013 on the functioning of the Safe Harbour, in order to ensure an adequate level of protection; 15. Welcomes that in its ruling of 6 October 2015 the CJEU declared invalid the Commission Adequacy Decision 2000/520 on the US Safe Harbour; stresses that this ruling has confirmed the long-standing position of Parliament regarding the lack of an adequate level of protection under this instrument; calls on the Commission to immediately take the necessary measures to ensure that all personal data transferred to the US are subject to an effective level of protection that is essentially equivalent to that guaranteed in the EU; 16. Objects to the fact that Parliament has not received any formal communication from the Commission regarding the state of implementation of the 13 recommendations, despite the Commission’s announcement that it would do so by summer 2014; underlines that, following the CJEU’s decision to invalidate Decision 2000/520, it is now urgent that the Commission provide a thorough update on the negotiations thus far and the impact of the judgment on the further negotiations that were announced; invites the Commission to reflect immediately on alternatives to Safe Harbour and on the impact of the judgment on any other instruments under Directive 1995/46/EC for the transfer of personal data to the US, and to report on the matter by the end of 2015; 17. Notes that the suspension of the Safe Harbour Decision has been presented by the Commission as an ‘option’ to be considered if there is no satisfactory solution to the problems identified; invites the Commission to reflect on alternatives to Safe Harbour, and to report on the matter by the end of 2015;

*UN Special Rapporteur Presents Report on the Impact of Patent Law on the Right to Science and Culture** *Posted by REPOST on October 26, 2015 http://infojustice.org/archives/35216 Farida Shaheed, United Nations Special Rapporteur in the field of cultural rights, presented her report on patents and access to culture to the General Assembly. The report’s summary is below, and the full report is available here. Summary: In the report, the Special Rapporteur addresses the implications of patent policy for the human right to science and culture. She reaffirms the distinction to be made between intellectual property rights and human rights, emphasizing that the right to the protection of the moral and material interests of authors does not necessarily coincide with the prevailing approach to intellectual property law. There is no human right to patent protection. The right to protection of moral and material interests cannot be used to defend patent laws that inadequately respect the right to participate in cultural life, to enjoy the benefits of scientific progress and its applications, to scientific freedoms and he right to food and health and the rights of indigenous peoples and local communities. Patents, when properly structured, may expand the options and well-being of all people by making new possibilities available. Yet, they also give patent-holders the power to deny access to others, thereby limiting or denying the public’s right of participation to science and culture. The human rights perspective demands that patents do not extend so far as to interfere with individuals’ dignity and well-being. Where patent rights and human rights are in conflict, human rights must prevail. Whereas from the perspective of trade law, exclusions, exceptions and flexibilities under international intellectual property law, such as the World Trade Organization Agreement on Trade-Related Aspects of Intellectual Property Rights, remain optional, from the perspective of human rights, they are often to be considered as obligations.
