*Hear, O Internet. * It has been sixteen years since our previous communication <http://www.cluetrain.com>. In that time the People of the Internet — you and me and all our friends of friends of friends, unto the last Kevin Bacon — have made the Internet an awesome place, filled with wonders and portents. From the serious <http://en.wikipedia.org/> to the lolworthy <http://lolcatbible.com> to the wtf <http://www.truthforhumanity.com/>, we have up-ended titans, created heroes, and changed the most basic assumptions about How Things Work and Who We Are. But now all the good work we've done together faces mortal dangers. When we first came before you, it was to warn of the threat posed by those who did not understand that they did not understand the Internet. These are The Fools, the businesses that have merely adopted the trappings of the Internet. Now two more hordes threaten all that we have built for one another. The Marauders understand the Internet all too well. They view it as theirs to plunder, extracting our data and money from it, thinking that we are the fools. But most dangerous of all is the third horde: Us. A horde is an undifferentiated mass of people. But the glory of the Internet is that it lets us connect as diverse and distinct individuals. We all like mass entertainment. Heck, TV's gotten pretty great these days, and the Net lets us watch it when we want. Terrific. But we need to remember that delivering mass media is the least of the Net's powers. The Net's super-power is connection without permission. Its almighty power is that we can make of it whatever we want. It is therefore not time to lean back and consume the oh-so-tasty junk food created by Fools and Marauders as if our work were done. It is time to breathe in the fire of the Net and transform every institution that would play us for a patsy. Make no mistake: with a stroke of a pen, a covert handshake, or by allowing memes to drown out the cries of the afflicted we can lose the Internet we love. We, the People of the Internet, need to remember the glory of its revelation so that we reclaim it now in the name of what it truly is. Caro Juan Carlos, allora vale la pena ricordare che questo aprile avremo il parere dell'antitrust sui software di registro elettronico in dotazione alle scuole. Una questione che a me sta a cuore è quella di capire che fine fanno i dati degli studenti che gli insegnanti ora inseriscono nei sfw della Axios ( https://www.sissiweb.it/Secret/REStart.aspx?Customer_ID=80025650658) Qualcuno si è occupato di questo aspetto del problema? Basti pensare a Google, Facebook, Amazon ed Apple, ma anche ad Alibaba, Tencent e Baidu. La struttura e la strategia di queste imprese è interamente funzione dell'ambiente digitale in cui operano -caratterizzato da considerevoli esternalità di rete- ed in particolare della *nuova infrastruttura centralizzata di distribuzione digitale in cloud*. Sotto questo profilo, la disponibilità di massicce quantità di dati relativi alle preferenze ed abitudini di consumo del pubblico non solo pone questioni di primo piano relative all'equilibrio di forze tra piattaforme e utenti, sia dal punto di vista della *tutela della privacy*, sia per quanto riguarda la possibilità di *gestione della propria /digital footprint/*, ma comporta anche un *vantaggio competitivo* difficilmente colmabile da altri operatori. For mainland Chinese, Wechat is one of the only options available, due to frequent blockage of apps like Viber, Line, Twitter and Facebook. However, outside of China, fueled by a massive marketing campaign and the promise of "free calls and texts", overseas Chinese students and family, Tibetan exiles, and Bollywood celebrities also use the app as their primary mobile communications service. It is this phenomenon that might be called an inversion of the Great Firewall. Instead of Chinese users scaling the wall to get out, people around the world are walking up to the front gate, and asking to be let in. Combined with the rise of attractive, low-cost mobile handsets from Huawei and Xiaomi that include China-based cloud services, being sold in India and elsewhere, the world is witnessing a massive expansion of Chinese telecommunications reach and influence, powered entirely by users choosing to participate in it. Due to these systems being built upon proprietary protocols and software, their inner workings are largely opaque and mostly insecure. Like most social media apps, the WeChat app has full permission to activate microphones and cameras, track GPS, access user contacts and photos, and copy all of this data at any time to their servers. Recently, it was discovered that Xiaomi MIUI phones sent all text messages through the companies cloud servers in China, without asking the user (Though, once this gained broad coverage in the news, the feature was turned off by default). The fundamental question is do the Chinese companies behind these services have any market incentive or legal obligation to protect the privacy of their non-Chinese global userbase? Do they willingly or automatically turn over all data to the Ministry of Public Security or State Internet Information Office? Will we soon see foreign users targeted or prosecuted due to "private" data shared on WeChat? Finally, from the Glass Houses Department, is there any fundamental diffence in the impact on privacy freedom for an American citizen using WeChat versus a Chinese citizen using WhatsApp or Google? About Nathan Nathan Freitas leads the Guardian Project, an open-source mobile security software project, and directs technology strategy and training at the Tibet Action Institute. His work at the Berkman Center focuses on tracking the legality and prosecution risks for mobile security apps users worldwide.

Last April, the Court of Justice of the EU (CJEU) invalidated the EU Data Retention Directive <https://www.accessnow.org/blog/2014/04/11/a-closer-look-at-eu-courts-ruling…> due to several violations of human rights, in particular the fundamental rights to privacy and data protection. Adopted in 2006, the Data Retention Directive required all telecommunications data – including mobile, landline phones, fax, and email – to be indiscriminately collected and retained by providers for a minimum of six months and up to two years. The CJEU’s landmark decision was broadly welcomed by civil society groups and activists from all around the world.
