U.S. Judge Rules Microsoft Must Produce Emails Held Abroad Judge Rules Company Must Comply With a U.S. Warrant for Email Stored at Data Center in Ireland Microsoft must comply with a U.S. warrant for customer email stored in a company data center in Ireland, a federal judge ruled Thursday. The search warrant was issued as part of a criminal investigation whose details remain secret. It is unclear whether the customer targeted by the Justice Department is located in the U.S. The company's lawyers had argued that the Justice Department needed to obtain the emails through a legal treaty with Ireland, and that forcing Microsoft to retrieve them without the country's consent violated Irish sovereignty and international law. But Chief U.S. District Judge Loretta Preska in Manhattan federal court ruled that the location of the email was irrelevant, because Microsoft controlled it from the U.S. Microsoft General Counsel Brad Smith said Thursday, "The only issue that was certain this morning was that the District Court's decision would not represent the final step in this process. Présidence de l'UMP : bug à l'ouverture du scrutin Moins d'une demi-heure après le début du vote électronique vendredi soir, le site a été piraté. Le parti a porté plainte. Les militants peuvent voter jusqu'à 20h. 8h30. Luc Chatel, secrétaire général de l'UMP, a affirmé ce samedi matin sur France Info que le parti a déposé une plainte contre des cyber-attaques. «Le vote se déroule de façon satisfaisante même si nous sommes victimes de cyber-attaques depuis le début du vote. Nous savions que nous allions être attaqué. Le site internet de l’UMP a été victime d’attaques depuis plusieurs jours comme si ceux qui ceux qui nous veulent du mal nous testaient. Cela a un peu ralenti le vote mais les choses ont repris», a déclaré Luc Chatel. Sur le même sujet La Haute Autorité chargée du bon déroulement du scrutin enregistrait 11 700 votants à 22h30. Samedi à 6h30, elle n’avait constaté «aucune attaque ou anomalie significative» nouvelle, recensant «plus de 35 000 votes». Press Release Brussels, 25 November 2014 Issued by the Article 29 Data Protection Working Party http://ec.europa.eu/justice/data-protection/article-29/press-material/press… The judgment of the Court of Justice of European Union (CJEU) of 13 May 2014 Google Spain SL and Google Inc. v Agencia Española de Protección de Datos (AEPD) and Mario Costeja González (C-131/12) sets a milestone for EU data protection in respect of search engines and, more generally, in the online world. It grants the possibility to data subjects to request to search engines, under certain conditions, the de-listing of links appearing in the search results based on a person’s name. On Wednesday 25 November, the European data protection authorities assembled in the Article 29 Working Party (WP29) have adopted guidelines on the implementation of the CJEU’s judgment. These guidelines contain the common interpretation of the ruling as well as the common criteria to be used by the data protection authorities when addressing complaints. The WP29 guidelines recall that the CJUE ruling confirmed the applicability of Directive 95/46/EC to a search engine insofar as the processing of personal data is carried out in the context of the activities of a subsidiary on the territory of a Member State, set up to promote and sell advertising space on its search engine in this Member State with the aim of making that service profitable. The judgment expressly states that the right only affects the results obtained from searches made on the basis of a person’s name and does not require deletion of the link from the indexes of the search engine altogether. That is, the original information will still be accessible using other search terms, or by direct access to the source. The WP29 considers that in order to give full effect to the data subject’s rights as defined in the Court’s ruling, de-listing decisions must be implemented in such a way that they guarantee the effective and complete protection of data subjects’ rights and that EU law cannot be circumvented. In that sense, limiting de-listing to EU domains on the grounds that users tend to access search engines via their national domains cannot be considered a sufficient means to satisfactorily guarantee the rights of data subjects according to the ruling. In practice, this means that in any case de-listing should also be effective on all relevant .com domains. Under EU law, everyone has a right to data protection. In practice, DPAs will focus on claims where there is a clear link between the data subject and the EU, for instance where the data subject is a citizen or resident of an EU Member State. The guidelines also contain the list of common criteria which the data protection authorities will apply to handle the complaints filed with their national offices following refusals of de-listing by search engines. The list contains 13 main criteria and should be seen as a flexible working tool to help DPAs during the decision-making processes. Criteria will be applied on a case by case basis and in accordance with the relevant national legislations. No single criterion is, in itself, determinative. Each of them has to be read in the light of the principles established by the Court and in particular in the light of the “the interest of the general public in having access to [the] information”. -- Avv. Gent.me/mi segnalo interessante consultazione pubblica on line in materia di open data promossa da Agid al seguente link http://www.agid.gov.it/notizie/consultazione-le-azioni-valorizzazione-del-p… Un caro saluto Mauro Alovisio AgID coordina le attività sugli open data, con l’obiettivo di promuovere le politiche nazionali per la valorizzazione del patrimonio informativo pubblico. L’Agenda nazionale è lo strumento attraverso il quale vengono indirizzate in modo specifico le azioni della PA riferibili alla disponibilità, fruibilità e riutilizzo dei dati pubblici, verso un processo teso a sviluppare anche ricadute economiche positive attraverso la realizzazione di servizi innovativi. L’Agenda nazionale 2014, oltre a delineare gli impegni delle amministrazioni verso l’apertura di specifici dataset, ha anche raccolto richieste, provenienti da associazioni rappresentanti la società civile e le imprese, per l’apertura di determinate tipologie di dati. Con l’intento di rafforzare ulteriormente il contributo dei portatori d’interesse e in coerenza con analoghe modalità adottate dalla Commissione Europea nel contesto di attuazione della direttiva PSI 2.0, l’Agenzia intende definire l’Agenda 2015 a partire dalle esigenze di cittadini, professionisti e imprese. Si invitano pertanto gli stakeholder a manifestare il proprio interesse e a segnalare (tramite la casella di posta dedicata opendata(a)agid.gov.it) le tipologie di dati per i quali viene maggiormente richiesta la disponibilità secondo i principi dell’open data. I successivi confronti tra le amministrazioni coinvolte e gli attori interessati saranno finalizzati alla definizione delle priorità dell’Agenda nazionale per la valorizzazione del patrimonio informativo pubblico per l’anno 2015. Sempre nel contesto di questo Gruppo di lavoro saranno avviate le attività finalizzate alla definizione delle Linee guida per il 2015 per le quali, come lo scorso anno, è prevista anche una consultazione pubblica con modalità che verranno in seguito definite.
