Among these measures were the December 12 1980 passage of the Bayh-Dole Act in the US, and the subsequent amendments that enabled and expanded the ability of private parties to patent and hold exclusive rights to inventions developed with federal funds. The changes in patent law were accompanied by increases in the numbers of patents filed and granted by the USPTO. The number of patents granted to universities increased at an even higher rate. From 1980 to 1990, there was a 46% increase in all utility patent grants, and a 263% increase in utility patents with an assignment to a university. From 1990 to 2013, the number of utility patents granted increased by 207%. The rate of increase for patents with university in the assignment was 673%. The changes in domestic and foreign laws relating to IP rights are designed to induce investments in the commercialisation of inventions and, to some extent, this occurs. However, the proliferation of patents, trade secrets and the restrictive licensing of patents, materials, data, know-how and knowledge in general also has negative effects. For example, Gilead recently told KEI that its development efforts for new treatments for hepatitis C were delayed for years by the patent thickets on the hepatitis C virus, a concern predicted by Baruch Blumberg in 1996 in litigation over the overly broad scope of patents on the virus. Sir John Sulston, a joint winner of the 2002 Nobel Prize in Physiology or Medicine, once told KEI that research that is open to everyone is at least nine times more valuable to society than research that is closed. At present, there are very significant financial incentives to make research closed and proprietary, and the asymmetry of incentives leads to an under supply of open research. The bias toward closed research, either due to secrecy or restrictive licensing of intellectual property rights, is not only a drag on the advancement of science, but it raises the costs to businesses of acquiring the rights in knowledge-based goods and services that they need to create and sell new products. In 2007, during work by MSF on a new innovation inducement prize for low-cost point-of-care diagnostics for tuberculosis, concerns about the negative impact of inducement prizes on secrecy were addressed by a proposal for an open source dividend (OSD). The initial proposal was for a percentage of inducement prize money to be allocated to persons who openly shared knowledge, data, materials and technology that was considered significant and useful in the development of the winning diagnostic test. This proposal was later incorporated in a series of legislative proposals by Senator Bernie Sanders for innovation inducement prize funds, and in several developing country and NGO proposals for delinking R&D costs from product price at the WHO. More recently the US Senate and the National Academies have expressed interest in further evaluating the OSD idea. The concept of the OSD has more general application than innovation inducement prizes. One could implement the OSD as part of more traditional business models for drug or software development. For example, if even 1% of patented drug sales in the United States were set aside into a fund for the OSD, there would be about $2.5 billion each year in rewards to persons who openly shared knowledge, data, materials and technology to drug developers. At 2% of sales, it would be almost $5 billion each year. The availability of the OSD would revolutionize university licensing policies, and also the policies of businesses that were holding as secrets research that was no longer under development. It would become a business decision to go open or closed. The new OSD market incentives to share knowledge could easily be extended to software development, with even small fees on the sale of licensing of proprietary software, or devices that used software, such as computers or mobile computer devices. The companies that sold drugs or mobile computing devices would arguably benefit the most, if the OSD induced more royalty-free sharing of inventions, data, materials and source code for software. This is because it would lower the costs of licensing these inputs, and also because the overall products would improve at a faster rate, creating more valuable products for end users. The US Congress should fund the request by the National Academies to study the feasibility and benefits of implementing the OSD in drug development, and possibly expand the study to consider the implementation in other fields, such as the development of new energy storage technologies, software, and medical diagnostic devices. The OSD is a long-overdue mechanism to reconcile the value society places on open source research, and the lack of pecuniary incentives to make research open source. -- James Love. di Carlo Lottieri *A internet non serve una costituzione* /Il documento aderisce a quel socialismo del «politicamente corretto» che rischia di comprimere ancora di più gli spazi di libertà/ Internet è un pezzo (importante) del nostro mondo: e non è strano che lì, come nelle strade o nelle abitazioni, succeda di tutto e si abbiano violazioni di diritti. Partendo da questo dato, su iniziativa del presidente della Camera Laura Boldrini una commissione guidata da Stefano Rodotà ha stilato una «magna charta» del web in 14 punti, con l’obiettivo di favorire il varo di norme a migliore tutela delle vittime. La cosa suscita perplessità. In primo luogo, il diritto ha una natura semplice e l’emergere di nuove tecnologie non è sufficiente a giustificare documenti che invochino altra regolazione. Pensare a nuove leggi comporta che a qualcuno venga dato questo potere di legiferare in campi già tutelati dal diritto. Le truffe in Internet sono illegali anche senza norme specifiche e non saranno meglio sventate soltanto grazie a un’inflazione di provvedimenti ad hoc. In secondo luogo, che cosa si vuole proteggere con i punti elaborati da Rodotà? Il documento aderisce a quel socialismo del «politicamente corretto» che rischia di comprimere ancora di più gli spazi di libertà. Come ho già detto a Micucci via Twitter, confesso di non trovare corrispondenza tra il modo in cui usa i termini "socialismo", "capitalismo", ecc. e quanto pensavo di aver capito io - mero ingegnere - leggendo Bobbio e tanti altri pensatori. Tutto questo, ha osservato il Commissario, riflette la paura dell’Europa d’essere superata dagli Stati Uniti in settori chiave dell’economia digitale. “C’è la sensazione che le aziende europee (ricorrenti nda) siano in ritardo nei confronti di questi grandi player (americani), non solo Google, (ma) Amazon, Facebook, Apple, Microsoft”. In Italia c’è qualcuno che pensa a ben altro che ad una ragionevole normativa anti trust e vuole istituire un “Leviatano” pubblico contro quello presunto privato. Il risultato è chiaro: i fautori dell’internet libera e gratuita sono ormai fautori dell’Internet socialista di stato. Alcuni a loro insaputa, molti coscientemente. I promotori del gruppo per la carta dei diritti di Internet sono stati Laura Boldrini e Stefano Rodotà. Secondo la dichiarazione, una lunga serie di encomiabili e sacrosanti diritti individuali e “qualche” libertà, dovrebbero essere “garantiti, difesi, implementati” da questa Magna Charta. Come? Con la ”very hard law“ della recente sentenza della Corte di Giustizia Europea a proposito del diritto all’oblio. Network neutrality is the principle that phone and cable companies shouldn't create an unequal Web—one with new Internet “slow lanes” for (almost all) websites and special fast lanes sold to billion-dollar giants like Facebook and Apple. Network neutrality is also something that Obama’s controversial appointee to head the Federal Communications Commission—Tom Wheeler—proposed, in May, to end. That was when Wheeler issued one of American history’s more unpopular legal proposals, which would give cable and phone companies substantial room to discriminate among websites, cut exclusive deals, and to impose new tolls on sites. Having eroded privacy for decades, shady, poorly regulated data miners, brokers and resellers have now taken creepy classification to a whole new level. They have created lists of victims of sexual assault, and lists of people with sexually transmitted diseases. Lists of people who have Alzheimer’s, dementia and AIDS. Lists of the impotent and the depressed. There are lists of “impulse buyers.” Lists of suckers: gullible consumers who have shown that they are susceptible to “vulnerability-based marketing.” And lists of those deemed commercially undesirable because they live in or near trailer parks or nursing homes. Not to mention lists of people who have been accused of wrongdoing, even if they were not charged or convicted. Alla luce della recente lettera pubblica che il Garante Privacy ha rivolto al Primo Presidente della Cassazione, ho provato a ricostruire il quadro giuridico del problema "diffusione delle sentenze vs tutela dei dati personali delle persone menzionate nelle sentenze"... E il risultato è stato che il quadro non è affatto chiaro. Le osservazioni del Garante sull'art. 10 della dichiarazione (oblio) mi paiono pertinenti. Aggiungo che l'articolo tratta la materia in maniera un po’ frettolosa, sovrapponendo diversi piani (oblio, diritto alla cancellazione, de-indicizzazione); piani che hanno già avuto modo di essere invece tenuti distinti nella letteratura, in giurisprudenza e nell’ampio dibattito sul tema. Il punto sull’anonimato invece nella ricostruzione del Garante mi sembra molto debole. Forse il Garante teme di essere privato dei poteri giustiziali su questi temi , dal momento che una rigida applicazione dei principi di riserva di legge e di giurisdizione porterebbe logicamente ad escludere che un’Autorità Indipendente possa amministrare la giustizia e quindi intervenire su temi quali anonimato e diritto all’oblio. La formulazione della Carta sul diritto all’anonimato garantito in via mediata, prevista dall’art 9, mi sembra invece una soluzione di grande rilievo.
