Rojadirecta, decisione Trib. Milano

Non so se sia gia' girata in lista, mi pare di no e in rete non riesco a trovarla, ma qualcuno potrebbe girarmi una copia della decisione rojadirecta del Tribunale di Milano. Vorrei scrivere della vicenda per il blog del CIS di Stanford Law, dove da pochi giorni ho cominciato una residential fellowship, occupandomi in particolare di intermediary liability. La questione suscita parecchio interesse qui anche perche', tra l'altro, proprio Mark Lemley di Stanford aveva difeso Rojadirecta nella causa statunitense. Ogni aiuto sarebbe apprezzatissimo. Penso soprattutto a Fulvio che si occupa direttamente della vicenda. Magari, potrei anche includere un commento dei diretti interessati sullo stato del riesame. Questa tecnica ha sorretto il paradigma, basato sui contributi provenienti dalle organizzazioni di impresa e di ricerca pubbliche e private, che si è affermata in tutti i settori della proprietà intellettuale: nel campo delle invenzioni, delle opere dell'ingegno, dei segni distintivi. Da venti anni circa ci si chiede però se, in un'epoca nella quale gran parte delle creazioni ed innovazioni assume formato digitale e le piattaforme digitali aprono inedite possibilità di collaborazione nella creazione, condivisione e disseminazione delle innovazioni, il *paradigma "esclusivo-centrico"* non debba essere rivisto, corretto ed integrato. In occasione del 56° Mercoledì di Nexa questo tema verrà approfondito e discusso da *Marco Ricolfi*, co-direttore del Centro Nexa su Internet & Società e professore di Diritto della Proprietà Intellettuale all'Università di Torino. L'idea che si stesse affacciando un paradigma nuovo si è in un primo momento affermata nel campo del copyright: il software libero <http://en.wikipedia.org/wiki/Free_software> prima e Creative Commons <http://creativecommons.org/> dopo hanno aperto la strada ad un *profondo ripensamento dell'idea che non si dia creazione senza l'incentivo fornito dall'esclusiva*. Allargando lo sguardo agli altri settori, ci si accorge che a ben vedere la trasformazione può essere ancor più radicale di quanto non fosse in un primo momento parso ai teorici del Copyright 2.0 <http://www.communia-project.eu/node/110>: non solo l'esclusiva può non essere indispensabile, ma sempre più spesso risulta controproducente, e questo anche nel campo dell'innovazione tecnologica, come esemplificato dagli studi sulla tragedia degli anti-commons <http://en.wikipedia.org/wiki/Tragedy_of_the_anticommons>, cui si assiste in settori che vanno dai farmaci, alle biotecnologie all'ICT. D'altro canto, gli economisti e i tecnologi ci hanno insegnato che le risorse digitali sono non rivali non solo nel consumo, ma anche nella produzione. Questi elementi sono sufficienti per lavorare all'ipotesi che *al paradigma tradizionale dell'innovazione si sia affiancato un altro paradigma*, che si regge non sulla regola dell'esclusività ma su regole che forniscono incentivi (non all'appropriazione solitaria dell'esclusivista) ma alla *collaborazione* in rete e che quindi sono finalizzate alla salvaguardia dell'interoperabilità, delle infrastrutture e delle risorse comuni. He aims for something even bigger. They are a long way from proving their case Sep 7th 2013|AMSTERDAM AND BARCELONA|From the print edition <http://www.economist.com/printedition/2013-09-07> EVEN thieves, it seems, now have a smartphone app. Makkie Klauwe (it means something like "easy pickings" in Amsterdam slang) reveals the city's best places for pilfering---for instance Reestraat and Tuinstraat, where bicycles appear to be a good target. The app depends for its dark arts on pulling together publicly available data on disposable income, crime levels and other problems reported in a district. A good place to steal might, for instance, have high income, low reported crime and broken streetlights. Luckily for Amsterdam's citizens and tourists, Makkie Klauwe does not exist. Bram Fritz, a graphic-design student, thought it up for an app contest the city held in 2011 (it won first prize in the "safety" category). Although he says he might write the app one day, the main aim was to kindle a debate over the ever greater amount of easily available data that can change urban life. "I wanted to confront citizens with what could become a threat to their property," explains Mr Fritz. As they go about their business of producing most of the world's wealth, novelty and human interaction, cities also produce a vast amount of data. The people who run cities are ever more keen on putting those data to work. Hardly a week passes without a mayor somewhere in the world unveiling a "smart-city" project---often at one of the many conferences hailing the concept. At its core, the notion of network-neutrality determines the extent to which Internet trafﬁc management practices (TMP) may be regarded as legitimate, insofar as they do not qualify as discriminatory practices and they are consistent with the full enjoyment of human-rights. Yet, throughout the last decade, this polysemous formula has acquired different meanings, invading the province of telecommunications, content and security regulation. The Network Neutrality debate is gaining great political momentum. Indeed, many legislators are currently scrutinizing the opportunity of elaborating and adopting legislation on network neutrality. While everyone agrees that the fundamental rights of Internet users have to be safeguarded, the question remains as to how this end could be achieved, and what are the most effective means to achieve such an objective. CallThe Dynamic Coalition on Network Neutrality, created under the auspices of the United Nations Internet Governance Forum, invites researchers and practitioners to submit a position paper on the issue of net neutrality and human rights. Position papers should provide relevant background information together with one or more propositions on how to preserve fundamental human rights (such as the right to privacy or freedom of expression) on the Internet of tomorrow. Suggested topics include, inter alia:Implementation of the Network Neutrality principle:• How to approach network neutrality? Regulation or co-regulation? • Is fair competition a sufﬁcient safeguard for fundamental rights?• Can current examples of network-neutrality legislation be deemed as efﬁcient?• Is there a difference between “open Internet” and “neutral Internet”? Impact of Network Neutrality on human rights:• Analysis of network neutrality case-law: Current violations of the Net Neutrality principle and their impact on human rights• How to reconcile anti-network neutrality arguments with the protection of human rights ?• From gateways to gatekeepers: assessing the role of ISPs with regard to access to information.• Net Neutrality and global access to the Internet: a “digital divide” issue• Digital democracy: the impact of network neutrality regulation on civic participation • Beneﬁts and risks of Deep Packet Inspection as an Internet trafﬁc management technique Submission Guidelines:Research papers, including analytical and theoretical papers, position papers, or case studies will be considered for inclusion in the report, even if they have been previously published.The length of the submissions should be between 3000 and 6000 words. To facilitate the reviewing process, papers should not include author names or other information that would help identify the authors.All paper should be in English language, and formatted according to the HWPiL style template.Submissions are due on September 15th, 2013. We propose a model for thinking of Internet governance within the context of the Internet's layered model. We use the example of the negotiations in Dubai in 2102 at the World Conference on International Telecommunications as an illustration for why it is important for different institutions within the governance system to focus on their respective areas of expertise (e.g., the ITU, ICANN, and IGF). Several areas of conflict (a "tussle") are reviewed, such as the desire to promote more broadband infrastructure, a topic that is in the remit of the International Telecommunications Union, but also the recurring desire of countries like Russia and China to use the ITU to regulate content and restrict free expression on the Internet through onerous cybersecurity and spam provisions.
