Non-market sharing should not be “compensated for”, the “creative contribution” has other aims

The commons thread to my work on the non-market sharing of digital works between individuals is to defend that when carefully delineated, this sharing is a right whose definition lies outside the realm of copyright. As such it can not be the object of copyright-based compensation. I developed this point in Internet & Creation (in French, 2008), though the point was blurred because the amount of the new financing scheme I suggested remained based on a compensatory reasoning. In Sharing (February 2012), I separated the recognition of non-market sharing and the detailed design of the creative contribution. The latter was explictly based on the needs of creative and expressive activities of individuals and on providing a new source of support to production and added-value intermediaries. This separation became even more explicit in my recent elements for the reform of copyright and related cultural policies. A new form of resource pooling is useful and needed to reward and support the creative activities that fuel digital culture. It can be socially accepted, provided one starts by recognizing that the right to non-market sharing is a primary condition of existence for digital culture, and only if one makes sure that the collected sums are truly received by contributors (authors, artists, technicians) and creative projects. There are many reasons to abstain from basing the amount of this new financing on a compensatory reasoning. Since most independent studies conclude that the non-market sharing of digital works between individuals is only responsible for a very limited part of the cultural industry problems in the digital world, adopting a compensatory viewpoint could ironically lead to very small amounts or to an unfounded capture of funds by media interests. In this post, I focus on another reason for rejecting a compensatory assessment of needs for a new financing source, which is how it would impact the cultural economy. Da un certo punto di vista, la fondazione fa benissimo a imporsi dei limiti finanziari per i costi di pubblicazione. La tendenza più preoccupante nel mondo dell'OA è quella legata alla via cosiddetta rossa - che è un modo ulteriore per perseguire rendite parassitarie: io editore ti concedo graziosamente di pubblicare ad accesso aperto, ma tu autore (o la tua istituzione) mi dai *un sacco di soldi*. Se deve essere così, allora è addirittura preferibile, come dice Harnad, la strada verde (l'articolo esce in riviste ad accesso chiuso, ma l'autore conserva il diritto di archiviare una versione del suo testo, dopo un eventuale periodo di embargo, in un archivio aperto, istituzionale o disciplinare). Ci sarebbero soluzioni ancora migliori, ma richiederebbero un ripensamento profondo e della funzione della pubblicazione e dello stesso concetto di eccellenza scientifica. Cari tutti, giro volentieri una segnalazione (da me ricevuta nell'ambito del progetto MedOAnet): la Fondazione Cariplo ha reso pubblica dal 1 settembre 2012 la propria policy sull'accesso aperto: http://www.fondazionecariplo.it/portal/upload/ent3/1/policy_5.pdf Si noti la possibilità, per ogni lavoro pubblicato, di "distribuire lavori da esso derivati in ogni formato digitale per ogni scopo responsabile, soggetto all'attribuzione autentica della paternità intellettuale" (insomma, una - limitata - possibilità di creare opere derivate, oltre all'accesso e redistribuzione liberi) [N.B.: "la Fondazione ritiene comunque opportuno sostenere i costi (fee) per la pubblicazione degli articoli in modalità Open Access. La copertura di tali costi, tuttavia, non sarà garantita da risorse addizionali"]; inoltre, la Fondazione "ritiene opportuno che i dati grezzi, i dati e metadati scientifici e le rappresentazioni digitali grafiche, prodotti nell'ambito delle ricerche finanziate siano resi anch'essi disponibili dai beneficiari nella modalità ad accesso aperto (open data) attraverso la loro autoarchiviazione in appositi depositi digitali". Indeed, with the current multiplication of devices, sensors, robots, and applications, and these emerging technologies, we have entered a new phase of the information age, a phase where the *hybridization between bits and other forms of reality is so deep that it radically changes the human condition* in at least four ways: - by blurring of the distinction between reality and virtuality; - by blurring of the distinction between human/machine/nature; - by reversing from scarcity to abundance, when it comes to information; - by reversing from the primacy of entities over interactions to the primacy of interactions over entities. She studied applied physics, engineering and economics at the University of Louvain, operations research at the University of California (Berkeley) and philosophy at the Free University of Brussels (ULB). She became a member of the Central Advisory Group and then the Forward Study Unit, dealing with strategic analysis of research and industrial policy for the President of the Commission (1986-1992). But four months and 28 views later, the musician's recording company, Universal, howled that the 29-second "performance" infringed its copyright and demanded that YouTube take it down. That was in 2007. Since then computers, smartphones and the internet have made copyright law look even more obsolete. But the response so far has been not to update the laws but to widen their scope and stiffen the penalties. In January websites including Wikipedia briefly shut down in protest against tough anti-piracy laws promoted by the entertainment industry in America and elsewhere. Now the tide is turning. For many politicians, property rights for media moguls are taking second place to attempts to boost growth by making life easier for technology companies.
