Forse qualcuno necessita un riepilogo delle puntate precedenti. Il 1° febbraio 2011 annunciai su Internet (attraverso vari canali come mailing lists, social network, articoli...) l'apertura di una web survey su alcuni aspetti di carattere sociologico relativi al diritto d'autore nell'era digitale. Si trattava di un questionario abbastanza consistente che ho realizzato come parte della mia ricerca di dottorato e che ho appunto promosso online sia in versione italiana che in versione inglese. Fin dall'inizio ho sempre promesso "solennemente" che tutti i risultati della ricerca (ovvero i dati e le opere scientifiche e divulgative basate su di essi) sarebbero stati diffusi con un approccio "open", utilizzando licenze di libera distribuzione. Adesso che il mio dottorato si è concluso e ho discusso la tesi, è giunto il momento di tener fede a questa promessa. Questo sito, quindi, è una sorta di estratto/derivazione della mia tesi di dottorato intitolata "Il diritto d'autore nell'era digitale. Una ricerca empirica su comportamenti, percezione sociale e livello di consapevolezza tra gli utenti della rete" e discussa nel gennaio 2012 presso il dottorato in Società dell'informazione dell'Università di Milano Bicocca. The use of copyrighted materials for educational purposes is, indeed, at the core of fair use. Yet, the high level of uncertainty regarding the particular scope of permissible uses prevents universities and colleges from exercising fair use on behalf of their students. Codes of Best Practices aim at reducing this chilling effect by offering some guidance on the implementation of fair use in particular contexts. The challenge in drafting such guidelines is to provide a safe harbor for educational use, and at the same time make sure that minimal standards of fair use do not become a ceiling. Drafting a code of best practices is a type of social activism which could inform users of their rights, facilitate communities of users and reshape copyright discourse. The legal status of such codes, however, is less clear: What are the legal consequences of complying with such guidelines? Should courts defer to such norms in its fair use analysis? And if so, under what circumstances? These questions have become especially important, in the legal aftermath of the recent GSU fair use decision on e-reserves (Cambridge University Press v. Becker (N.D. Scadenza: 19 novembre. juan carlos Telecomunicazioni internazionali: consultazione regolamento prorogata di un mese http://www.sviluppoeconomico.gov.it/index.php?option=com_content&view=artic… Il Dipartimento per le Comunicazioni, in collaborazione con l'Istituto Superiore delle Comunicazioni e delle Tecnologie dell'Informazione, ha avviato una consultazione aperta a tutti i soggetti interessati sulle proposte di revisione normativa del trattato internazionale delle telecomunicazioni, firmato a Melbourne nel 1988 da tutti i paesi del mondo nell'ambito dell'Unione Internazionale delle Telecomunicazioni. È possibile esprimere le proprie valutazioni, anche plurime, sull'intero testo del trattato, utilizzando il file da scaricare. La chiusura della consultazione, inizialmente prevista per il 19 ottobre 2012, è prorogata di un mese, fino al *19 novembre 2012.* La consultazione s'inserisce nel corso della Conferenza Mondiale sulle Telecomunicazioni Internazionali, che si terrà a Dubai, dal 3 al 14 dicembre 2012, in seno all'Unione Internazionale delle Telecomunicazioni, l'organismo ONU competente in materia. Like many Supreme Court cases, though, there's more than meets the eye. It's not merely a question of whether the Thai-born Kirtsaeng will have to cough up his profits as a copyright infringer; the case is a long-awaited rematch between content companies seeking to knock out the "first sale" doctrine on goods made abroad (not to mention their many opponents). That makes /Wiley v. Kirtsaeng/ the highest-stakes intellectual property case of the year, if not the decade. It's not an exaggeration to say the outcome could affect the very notion of property ownership in the United States. Since most consumer electronics are manufactured outside the US and include copyrighted software in it, a loss for Kirtsaeng would mean copyright owners could tax, or even shut down, resales of everything from books to DVDs to cellphones. The Harvard Library contains a wealth of special collections, and is dedicated to providing open access to them, where possible, through digitization and online dissemination. Through its collaboration with the DPLA, Harvard will contribute to global access to knowledge by linking to select digitized special collections. Robert Darnton, Harvard University Librarian and DPLA Steering Committee member, noted, "By making their special collections available to the public through the DPLA, research libraries can contribute mightily to the democratization of access to knowledge. Harvard's collections, built up since 1638, form the largest university library in the country. By supporting the DPLA, we will make the choicest items in them accessible to everyone in America---and eventually, we hope, to everyone in the world." In response to the DPLA's call, the Harvard Library is actively exploring what collections it could contribute. Work remains to be done on various fronts before a final decision is made about specific collections, but the Harvard Library looks forward to making a number of its collections available to the DPLA. Among them, the following have already been digitized and could be available to the DPLA before its launch in April 2013: * /Colonial Harvard/. An online guide and an expanding digital data base with thousands of items---diaries, commonplace books, correspondence, legal documents, University records, drawings, maps, student notebooks, scientific observations and lecture notes---that form the documentary history of Harvard and serve as one of the great social history collections on the evolving United States. * /Daguerreotypes/. Harvard's 3,500 daguerreotypes gathered in an online collection. The images include some of the earliest photographs of the moon, views of the first use of ether and rare portraits of African-born slaves. * /Digital Scores and Libretti/. First and early editions and manuscripts of works by J.S. Bach (and family), Mozart, Schubert and others. * /Zoology/. The Jacques Burkhardt Collection comprising 976 scientific drawings of fish and miscellaneous vertebrates and invertebrates. The collection also includes field notes, correspondence, diaries, photographs and specimen records from Louis Agassiz's 15-month Brazil expedition in 1865-66. * /Digital Maps/. Over 1,000 maps and atlases, many georeferenced for use in GIS. Includes maps of New England towns, London, China, pictorial maps by Ernest Dudley Chase, fire-insurance and real-property atlases and maps from the Revolutionary War. * /Trial Narratives/. More than 450 pamphlets and chapbooks printed in the United States and the United Kingdom during the first half of the nineteenth century. They recount trials for murder, rape, divorce, domestic violence, adultery, bigamy, breach of promise to marry and the custody of children. * /Medieval and Renaissance Manuscripts/. More than 75 rare works in English, French, German, Italian, and Greek. From the collection of Houghton Library, these manuscripts reflect a broad range of subjects in history, literature, religion, science and geography. This selection also includes richly illuminated books of hours used for private devotion. Harvard holds the largest collection of the original manuscripts of poems by Emily Dickinson. It is now assembling these manuscripts and other material into a digital Emily Dickinson Archive, which it could make available to the DPLA as well. And as it pursues other digitization initiatives and reviews its digital holdings, it may make additional material available. Projects that could fall in this category include collections of North American manuscripts from the 17th and 18th centuries, rare Chinese works and materials from the Library's Open Collections Program. "The Harvard Library is committed to collaboration and open access. Earlier this year, the Library made more than 12 million of its records publically available, and is actively pursuing additional collaborative and open access projects. We hope this contribution is one of many steps toward sharing the vital cultural knowledge in libraries with all," said Mary Lee Kennedy, Senior Associate Provost for the Harvard Library. The DPLA is still taking shape, and Harvard's collaboration with it is contingent upon working out satisfactory arrangements on a range of matters. Segnalo questo seminario sperando sia di interesse a questa ML. ================================================================== PRIVACY CHALLENGES FOR DATABASE SYSTEMS November 7th, 2012 Wednesday 2:30 pm EIT conference room, Northern Bldg, Fondazione Bruno Kessler, Via Sommarive 18 - Povo Speaker: Prof. Johann-Christoph Freytag - Humboldt Universität zu Berlin Abstract: Over the last years the means to collect personal data implicitly or explicitly over the Web and by various kinds of sensors and to combine data for profiling individuals has dramatically increased. These improved abilities have a dramatic impact on the privacy of every individual. This talk focuses on presenting and discussing different approaches how to prevent privacy breaches when personal data is either stored or individuals are at risk to reveal which data they access. In the first part of the talk we introduce several examples of privacy breaches that help us to better understand what is at risk and to categorize the kind of privacy threads and privacy attacks. They show that privacy is at risk in different fields such as in the field of communication and in the field of database systems. The latter will be the focus for the rest of the presentation. To begin with, we first discuss the principles of Hippocratic database systems that should guide any privacy solution for database systems. These principles rest in part on various requirements coming from the privacy (non computer science) community and from the legal world. They will help us in better understand the different solutions and concepts to protect the privacy of individuals when storing personal data in a database system. We then turn to the notion of data privacy. The challenge of data privacy is to prevent the linkage of stored data to individuals. For example, if we store patient and disease data, it should be impossible to find out which individual has which disease when the data is released. As a first step we introduce the notion of k-anonymity as a way to release data without revealing the identity of the individual they belong to. We show that the basic notion of k-anonymity does not suffice; it must be improved in various ways due to the different kind of privacy leakages (or possible attacks) that might occur. Based on the notion of access privacy we describe a solution how protect the user’s privacy when accessing a database such that one cannot detect/observe which data is accessed in the database. The presentation ends by discussing how to model the knowledge an adversary gains by the results of a series of queries to the database – here the goal is to detect when the database should not provide any more results in order to protect privacy. Short Bio: Johann-Christoph Freytag is currently full professor for Databases and Information Systems (DBIS) at the Computer Science Department of the Humboldt-Universität zu Berlin, Germany. Before joining the department in 1994, he was a research staff member at the IBM Almaden Research Center (1985-1987), a researcher at the European Computer-Industry-Research Centre (ECRC, in Munich, Germany, 1987-1989), and the head of Digital's Database Technology Center (also in Munich, 1990- 1993). He holds a Ph.D. in Applied Mathematics/Computer Science from Harvard University, MA. Prof. Freytag's research interests include all aspects of query processing and query optimization in object-relational database systems, new developments in the database area (such as semi-structured data, data quality, databases and security), privacy in database systems, and applying database technology to applications such as GIS, genomics, and bioinformatics/life science. In the last years he received the IBM Faculty Award four times for collaborative work in the areas of databases, middleware, and bioinformatics/life science. He organized the VLDB conference in Berlin in 2003 and was a member of the VLDB Endowment (2001-2007) and in the head of the German database interest group of the GI (Fachbereich DBIS, Gesellschaft für Informatik).
