You won't guess the answer in a month of Sundays. While there are plenty of candidates, my vote goes not to the banks, the oil companies or the health insurers, but -- wait for it -- to academic publishers. Theirs might sound like a fusty and insignificant sector. It is anything but. Of all corporate scams, the racket they run is most urgently in need of referral to the competition authorities. Everyone claims to agree that people should be encouraged to understand science and other academic research. Without current knowledge, we cannot make coherent democratic decisions. But the publishers have slapped a padlock and a "keep out" sign on the gates. You might resent Murdoch's paywall policy, in which he charges £1 for 24 hours of access to the Times and Sunday Times. But at least in that period you can read and download as many articles as you like. Reading a single article published by one of Elsevier's journals will cost you $31.50. Springer charges EUR34.95, Wiley-Blackwell, $42. Read 10 and you pay 10 times. And the journals retain perpetual copyright. You want to read a letter printed in 1981? That'll be $31.50. [...] The knowledge monopoly is as unwarranted and anachronistic as the corn laws. Released Neubot 0.4.1 http://www.neubot.org/neubot-0.4.1 Version 0.4.1 is the sixth generally-available stable release of Neubot, distributed for Ubuntu >= 10.04, MacOSX >= 10.6 and Windows >= XP SP3. It is also available in source format (.tar.gz and .zip). This release contains 92 patches. The diffstat says: 92 files changed, with 4851 lines inserted and 522 lines deleted. Here are the most relevant changes: o new installer for Mac that (i) installs Neubot as a daemon so that it runs at startup and (ii) shows privacy policy and asks for privacy permissions; see also <http://www.neubot.org/install-mac-os-x>; o new neubot/www/lang/en.js to start from in order to translate the web user interface to other languages; o more code rationalizations, bug fixes and unit tests. The release candidates have been tested on Ubuntu 10.04, Windows XP SP3, Windows 7 and MacOSX 10.6. We've not been able to find a MacOSX 10.5 machine to test the new package, so we don't know whether the new installer has issues with such version. Cari Tutti, colgo al balzo la richiesta di Marco Blengino per postare la premessa al contributo mio e di Giuseppe Vaciago. Vi chiedo di perdonare in tono che mi è venuto un po' troppo accademico-trombonesco - l'unica consolazione è il mio essere trombone non può più essere aggravato dall'aggettivo "giovane" :) AR ************** Vorrei proporre alcune osservazione di carattere generale ai commenti che stiamo cercando di proporre ad AGCOM - ciò che scrivo non pretende affatto di essere nuovo, ma lo dico con il mio linguaggio. In primo luogo, c'è una questione di φρόνησις, ossia di buon uso della ragione pratica: anche se può essere tatticamente opportuno contribuire a questa consultazione, lo è anche strategicamente? Ossia,non stiamo aiutando AGCOM a rendere più difficilmente attaccabile dal punto di vista giuridico il regolamento proposto? Non sarebbe più opportuno aspettare la prima decisione e poi sollevare un problema di costituzionalità? In secondo luogo, ci due questioni di ontologia giuridica: (i) deve essere chiaro che il provvedimento è volto a tutelare un modello di proprietà intellettuale che non descrive più né le parti né gli interessi in gioco e che dovrebbe essere il legislatore a ridefinire l’ontologia giuridica della proprietà intellettuale, con una legge ad hoc che abbia non solo un contenuto, ma anche una forma logica diversa da quella attuale; nella legge attuale sul diritto d’autore, tutto ciò che non è esplicitamente permesso è vietato, nella nuova legge tutto che non è esplicitamente vietato dovrebbe essere permesso; ossia, bisogna passare da norme che hanno questa forma logica: - Pp > Vp a norme che abbiano una forma logica del tipo: - Vp > Pp -- entrambe le implicazioni sono derivabili da un sistema minimale di logica deontica; la scelta della forma è una questione politica: la maggior parte degli autori sostiene che in uno stato liberale dovrebbero prevalere le norme del tipo - Vp > Pp (Georg H. von Wirght, Uberto Scarpelli) / e poi c'è chi dice che la logica deontica non serva a nulla :); (ii) deve essere chiaro che nei sintagmi “proprietà immobilare” , “proprietà mobiliare”, “proprietà intellettuale” non abbiamo abbiamo a che fare con un’unico concetto di “proprietà”. Benché vi sia una wittgensteniana aria di famiglia tra i tre concetti (che consiste probabilmente nell’ascrizione di un titolo valido ad un oggetto materiale o sociale), una cosa è essere proprietari di un campo, una cosa è essere proprietari di un’automobile, una cosa è essere proprietari di un libro. Gli scrittori liberali (a partire da John Locke) che pongo alla base della società il diritto di proprietà (per Locke è il primo dei diritti naturali dell’uomo) hanno in mente la proprietà terriera: solo attraverso processi analogici e metonimici l'idea di è dapprima estesa a oggetti mobili e poi a oggetti immateriali (Paolo Grossi, Andrea Bottani). In terzo luogo, deve essere chiaro che il provvedimento non è di natura semplicemente tecnico-giuridica, ossia non è solo uno strumento per dare maggior enforcement ad una legge già esistente. Infatti, l’art. 2 del regolamento proposto da AGCOM recita: 1. Il presente regolamento disciplina le attività dell’Autorità in materia di tutela del diritto d’autore sulle reti di comunicazione elettronica e, in particolare, quelle finalizzate allo sviluppo dell’offerta legale di contenuti e della loro corretta fruizione nonché quelle relative alla vigilanza, accertamento e cessazione delle violazioni del diritto d’autore, comunque realizzate, poste in essere sulle reti di comunicazione elettronica, fatte salve le eccezioni di cui agli articoli 65 e 70 della Legge sul diritto d’autore. 2. Nell’espletamento delle attività di cui al comma 1, l’Autorità opera nel rispetto dei diritti e delle libertà di espressione del pensiero, di cronaca, di commento, critica e discussione. e pone un ordine tra due diritti fondamentali nelle democrazie liberali moderne: il diritto alla libertà di espressione e il diritto di “proprietà intellettuale”, privilegiando il diritto di “proprietà intellettuale”. Credo che in una società liberale il diritto alla libertà di espressione (quello che Jean Paul Sarte chiamava “libertà” tout court) non possa, non debba essere limitato in nome di nessun interesse economico (perquanto generale possa essere l’interesse). Infine, si potrebbe proporre un emendamento che di fatto svuoti il senso del regolamento, trasformarmando l'art. 3 da così: 3. Trascorsi quattro giorni dalla richiesta di cui al comma 1, senza che il contenuto sia stato rimosso, il soggetto segnalante di cui al comma 1 può trasmettere la richiesta all’Autorità che provvede secondo quanto previsto alla Sezione II del presente Capo, impregiudicato il diritto di rivolgersi all’Autorità giudiziaria. a così: 3.Trascorsi quattro giorni dalla richiesta di cui al comma 1, senza che il contenuto sia stato rimosso, il soggetto segnalante di cui al comma 1 può trasmettere la richiesta all’Autorità giudiziaria. ++++++++++++ prof.
