Covering 60 countries, the project examines how these changes affect the core democratic service that any media system should provide: news about political, economic, and social affairs./ Digital terrestrial television was introduced in Italy in 2001. The switch-off of analog broadcasting started in 2009 and is based on the progressive "digitization" of regional areas. The deadline for the definitive switch-over from analog to digital broadcasting is set for December 31, 2012. The television set remains the most common media device in Italian households. National television news and traditional newspapers are the media sources most used by Italians to obtain news about politics and daily events. However, the percentage of Italians whose sole source of information was television decreased from 46.6 to 26.4 percent between 2006 and 2009. Newspaper sales have been in long-term decline, fuelling concerns over whether professional journalism is financially sustainable in the long term. Digitization appears to be weakening local broadcasters, who have played an important role historically in safeguarding freedom of information. The multiplication of the national channels, especially RAI and Mediaset, has caused an important decrease in terms of audience and advertising income of local and regional broadcasters. This report calls on civil society, NGOs, and international organizations to urge the reform of legislation on conflicts of interest between political/institutional roles on one hand and media ownership on the other, as well as to monitor the last stage of digital switch-over, the final allocation of the digital spectrum, and the resulting state of media pluralism, in order to verify that parliament and government actions do not privilege the existing RAI--Mediaset duopoly or favor companies close to the prime minister. After much reluctance, the conservative (EPP) group has finally agreed to endorse a call for a timely assessment of further regulation on Net neutrality. However, the text still includes a major loophole allowing operators to implement Internet access restrictions on the pretext of managing congestion. *** The negotiations of “compromise amendments” to a Net Neutrality resolution at the EU Parliament have come to a close. La Quadrature du Net publishes its voting recommendations on the proposed amendments [1], sent to the members of the Industry (ITRE) committee, ahead of tomorrow's vote [2]. In a last minute move, the conservative (EPP) group finally agreed to endorse an amendment asking the EU Commission to promptly assess the need for “further regulatory measures” on Net neutrality after the body of telecom regulators concludes its forthcoming study [3] on Internet service providers' traffic management practices (ISPs) [4]. However, the resolution still includes a major loophole favouring telecom operators, supported by the conservatives (EPP), namely the ITRE chair, Herbert Reul, and the social-democrats (S&D), represented by Catherine Trautmann. According to the draft, operators may implement access restrictions [5] in cases of “congestion” of their networks. Such wording allows ISPs to use the excuse of radio spectrum scarcity to create permanent congestion and legitimize widespread violations of Net neutrality in mobile Internet access. To avoid such deviation from the Net neutrality principle, ISPs should only be allowed to practice discriminatory traffic management in cases of unforeseen congestion, in which case traffic management should be proportionate and time-limited. [6] The compromise amendments must be amended to include the notion of “unforeseen” congestion to correct this major flaw in the current wording. Failing this, the European Parliament might let operators create an artificial scarcity of bandwidth and business models based on discrimination, detrimental to investment in networks, competition and citizens' freedoms online. “The draft resolution amended with compromise amendments is overall weak, yet brings useful elements and slightly increases pressure on the Commission to take action. However, it also contains one major loophole. The Parliament can still fix the resolution to send a stronger signal to the Commission and the EU body of regulators: no restriction of Internet access harmful to competition and freedoms should be tolerated”, says Jérémie Zimmermann, spokesperson and co-founder of La Quadrature du Net. * References * 1. If the deployment of very high broadband networks takes longer than expected and operators face a durable saturation of their network, then the available bandwidth should be shared equally between all the subscribers and all service providers, until operators invest to upgrade their infrastructure”. Cari tutti, qualche giorno fa alla Corte Suprema degli Stati Uniti e' stato discusso il caso Golan v. Holder (http://en.wikipedia.org/wiki/Golan_v._Holder) Audio dell'oral argument: http://www.supremecourt.gov/oral_arguments/argument_audio_detail.aspx?argum… Op-ed NY Times: http://www.nytimes.com/2011/10/05/opinion/keep-works-in-the-public-domain-p… E' un caso importante per il pubblico dominio negli USA. Il punto fondamentale e' la costituzionalità (o meno) di togliere opere dal pubblico dominio con leggi che retroattivamente ne modifichino lo status. A quanto pare, infatti, non era mai successo prima negli USA. Ora, in Europa e' successo piu' e piu' volte, l'ultima volta con la sciagurata Direttiva sull'estensione dei termini di protezione per fonogrammi, etc. Da non-giurista e' qualcosa che mi sembra profondamente ingiusto, un vero vulnus a diritti fondamentali. Mi chiedo e vi chiedo: non e' che abbiamo finora trascurato dei profili giuridici che forse ci potrebbero aiutare a contrastare questo tipo di "barbarie" legislativa anche in Europa? http://www.repubblica.it/tecnologia/2011/10/18/news/open_data-23405552/ Luna è ottimista... staremo a vedere ("il ministro Renato Brunetta è pronto a lanciare anche il governo italiano su questo tema."). L'esperienza sul campo dice che non è tutto molto semplice, ma certo una potenziale "competizione" far le amministrazioni su questo trend potrà essere utile. Rimangono ancora insoluti diversi aspetti del quadro giuridico, specie in relazione alla commerciabilità correlata alle finalità originarie del trattamento dati da parte della PA, ed occorre anche prestare attenzione alle modalità di rilascio (licenze). Direi che siamo all'inizio; adesso occorrerà ragionare nello specifico, come per altro stiamo facendo a Nexa e nel gruppo di ricerca EPSI, ma forse dovrebbero intervenire anche altri soggetti a far chiarezza (Garante, legislatore).
