Mi pare abbiate ragione entrambi. Il problema non è ACTA in se, (almeno, non per le sanzioni penali- non fraintendetemi) ma come sarà attuato. E' probabile che sarà la UE a implementare ACTA nell'Unione con la IPREDII e bisognerà capire se sarà direttiva di secondo pilastro, ovvero sul mercato, o se sfrutterà Lisbona inserendosi nel 4° pilastro sui diritti fondamentali. E' vero che nessun accordo commerciale ha mai inciso con scelte vincolanti per gli stati sul settore penale,( le stesse Direttive dell'unione hanno sempre evitato di incidere) sebbene a livello di convenzioni molte hanno disciplinato reati specifici, imponendo nuove fattispecie (penso recentemente a Budapest sul Cibercrime). Non erano accordi commerciali, ma certo incidevano sulle scelte criminali dei singoli firmatari. Il problema è che con ACTA tutto è incerto, compresa la forma dell'accordo. Comunque, paolo, scriverei senza tema che è la prima volta che accade una previsione vincolante e dettegliata in accordi commerciali. Verifica pene detentive in accordi commerciali

Salve! Stiamo preparando un nuovo pezzo su ACTA. Una frase cruciale che abbiamo intenzione di inserire sarebbe: "Per la prima volta nella storia delle democrazie occidentali, la definizione dei reati penali e le pene di carcerazione vengono negoziate in un accordo multilaterale commerciale fra rappresentanti dei governi ed esponenti delle industrie, al di fuori di qualsiasi processo democratico e dello scrutinio dei parlamenti nazionali". Proprio per scrupolo mi è venuto il dubbio di verificare se la prima parte è vera (la seconda è pacificamente vera, purtroppo). Cioè, è vero che è la prima volta nella storia che si negoziano reati e pene detentive in un accordo commerciale? Mi sembra di si, ma se avete controesempi per favore informatemi appena potete. "Collective management is indispensable because broadcasters can't go individually to rights holders for a lot of mass use," said Ingrid Deltenre, Director General of the European Broadcasting Union . She went on to say, " For our Nordic Members, the extended collective licensing system, which has been in place for the past 50 years, has significantly simplified the process of clearing rights for archive content, including orphan works . However, our Members still have a total of approximately 28 million hours of unused radio and TV content, representing an enormous part of Europe's cultural heritage." The EBU pointed out that this situation creates unnecessary administrative costs, and is not in the interests of copyright users, consumers or creators. This is why, in addition to proposals on books in a directive on orphan works, solutions must also be found for audiovisual archives. As part of a coherent set of proposed measures, the EBU highlighted another of its key points: the country of origin principle***. This would facilitate EU-wide licensing avoiding multi-territorial application of 27 national copyright rules, on the basis of the principle of technological neutrality, where a policy should not favour a particular technology. "The more you facilitate the system, the more likely it is that you will have content available on all platforms nationally and across borders," concluded Ms Deltenre. The EBU stressed that its proposals respect the contractual freedom of producers of premium content, e.g. films.
