It’s Finally Legal To Hack Your Own Devices (Even Your Car)

Last Friday, a new exemption to the decades-old law known as the Digital Millennium Copyright Act quietly kicked in, carving out protections for Americans to hack their own devices without fear that the DMCA’s ban on circumventing protections on copyrighted systems would allow manufacturers to sue them. One exemption, crucially, will allow new forms of security research on those consumer devices. Another allows for the digital repair of vehicles. Car insurance industry to disappear by 2030?

His report: ‘A Perfect Storm in Insurance: How to survive the looming waves of disruptive technology’ aims to help insurers prepare for a very different future. Naylor says the car insurance industry will probably be the first to sector to face major disruption. “Once networked, autonomous cars are widely available. It’s been predicted that car crashes will reduce by 80 to 90%. This development is not as far away as you might think – Volvo, for example has an aim of eliminating car crashes by 2020.” * *Naylor believes car theft will largely become a thing of the past as voice and face recognition technology will make them nearly impossible to steal, leaving insurance only for damage caused by things bumping into the car or extreme weather events. The result is car insurance premiums will fall drastically, probably by as much as 90% by 2030, says Naylor. He says that while many might view his report as speculation, there are plenty of examples of innovative insurers overseas who are using technology to change their business models. British insurer Drive Like A Girl monitors the drivers it insures via a telemetric device that sends real-time reports, including alerts of any crashes. The company is popular with young drivers who can prove they shouldn’t have to pay the high rates generally imposed on them. “New Zealand and Australian insurers are probably a few years behind those in the US and Europe, but they need to start grappling with these changes now. If they don’t, new disruptors will emerge to take their business from them,” he says. He explains that insurers need to change their view of their business as a provider of insurance products to being a data company with real-time links to customers, specialising in personal services. “Any organisation that is not a big data house now, or is unable to become one soon, is already a legacy company,” he says. Naylor’s vision of the future also has many implications for consumers. He predicts that in the future all insured objects will give constant, real-time feedback to the insurer’s data centre, and that includes people. “Wearable technology can provide minute-by-minute blood pressure readings and tell if your blood chemistry indicates an illness,” he says. “Through the connection of objects to the internet it will be possible for insurers to know how healthy the food in your fridge is or how often you exercise. Imagine how accurately they can then predict your health risk for insurance purposes.” If a person agrees to sharing information and they are healthy their insurance premiums would plummet but if they refuse they would be classed as high-risk, says Naylor. *Can Smartphones and Privacy Coexist?** * /Assessing Technologies and Regulations Protecting Personal Data on Android and iOS Devices// / As smartphones become more ubiquitous around the globe, policymakers inevitably have to grapple with issues related to the security and privacy of these devices. To aid in this understanding, in 2015, the Defense Advanced Research Projects Agency (DARPA) commissioned a team of researchers from the Massachusetts Institute of Technology (MIT) Lincoln Laboratory and the RAND Corporation to assess smartphone users' privacy from both technical and regulatory perspectives. This report documents the team's approach and findings. On the technical side, it describes a literature review and experiments performed by MIT Lincoln Laboratory investigating the state of privacy of the two major smartphone platforms in 2015: Google's Android and Apple's iOS. On the regulatory side, this report describes a review by RAND of major federal regulatory mechanisms for protecting privacy in the United States and provides a tool to understand both privacy regulation and technology. While privacy-preserving technology is improving, users' privacy concerns have not been fully addressed by the technology itself. Appropriate regulatory protections also play a role in protecting smartphone users' privacy. Currently, many gaps exist between regulation and technology: The two are not adequately paired to provide the desired protections. We believe that many of these gaps can be identified using a tool that the project team developed for policymakers. By combining technical and regulatory components associated with smartphone privacy, this matrix-based tool will help policymakers guide directions for future research and assess the impact of technical and regulatory solutions that have been or will be implemented. In *Metric Power*, David Beer examines the intensifying role that metrics play in our everyday lives, from healthcare provision to our interactions with friends and family, within the context of the so-termed data revolution. This is a book that illustrates our growing implication in, and arguable acquiescence to, an increasingly quantified world, but, *Thomas Christie Williams* asks, where do we locate resistance? *Metric Power. David Beer. Palgrave Macmillan. 2016. * My initial reaction to Metric Power was that, for an essay on the challenges of big data, there was remarkably little of it throughout the book. As David Beer shied away from drawn-out case studies, figures and concrete examples, I found myself getting more and more irritated. How could I trust what he was saying without evidence to back it up? But as I progressed, I realised that this is probably part of his point. As a ‘neoliberal subject’, Beer argues, people like me have a ‘cultural interest in numbers, and a culture that is shaped and populated with numbers’ (149). If something cannot be quantified, our trust and interest in it diminishes. There is indubitably more data in the world than there has ever been before. In my field, medicine, genomes are being sequenced at an exponential rate, and many institutions have legitimate concerns about where this data will be stored – indeed, some scientists are trying to store data in DNA itself. Companies like Apple and Google have moved into health metrics and are storing tens of thousands of physiological measurements about people who use their health apps. The entirety of Scotland’s computer-based medical records are being made accessible to researchers, who are using machine learning to try and decipher patterns in the relationship between demographics and disease. Can, or will, this data be used to increase our understanding of basic biological processes, improve health or reduce inequality? And is the metricisation of everyday life leading to changes in ways that we construct social values, live our everyday lives and even how we relate to our bodies? Beer would argue that it is, and he spends Metric Power dissecting the challenges that big data poses both methodologically to the social sciences and to us as individuals. Beer frames his analysis about the causes and effects of metric power around three key themes: ‘Measurement’, ‘Circulation’ and ‘Possibility’. In ‘Measurement’, we learn about the history of assessing social entities quantitatively. Beer argues that this mode of thinking shapes the social world, quoting Heidegger: ‘calculation refuses to let anything appear except what is calculable’ (235). ‘Circulation’ examines the processes by which metrics about social subjects circulate and a ‘social life of data’ is created. In ‘Possibility’, metrics are related to power, and how they are used to ‘maintain, strengthen, or justify new types of inequality, to define value or worth, and to make the selections central to affording visibility or invisibility’. The EU-U.S. Privacy Shield was agreed earlier this year after the European Union's highest court struck down the previous Safe Harbour agreement over the transfer of Europeans' personal data to the United States, on concerns about intrusive U.S. surveillance. The new agreement gives businesses moving personal data across the Atlantic - from human resources information to people's browsing histories to hotel bookings - an easy way to do so without falling foul of tough EU data transferral rules. Digital Rights Ireland has challenged the adoption of the Privacy Shield pact by the EU executive in front of the second-highest EU court because it does not contain adequate privacy protections, people familiar with the matter said on Wednesday.
