<http://acta.ffii.org/?p=754> ACTA: Delicate matter of incompatibility with fundamental rights By Ante Wessels Letter to the European Parliament Legal Affairs Committee 2 September 2011 Dear Members of the Legal Affairs Committee, A new study on ACTA, commissioned by the Greens/EFA, concludes that ACTA is incompatible with fundamental European human rights instruments and - standards. [1] We believe the Parliament should ask the European Court of Justice an opinion on this delicate issue. Only the Court can decisively resolve the uncertainties. A second Greens/EFA study concludes ACTA increases the risks and consequences of wrongful searches, seizures, lawsuits and other enforcement actions against legitimate suppliers of generic medicines. [2] Furthermore, according to our own analysis, green innovation will partly inherit the issues in the software field. ACTA will hamper both green innovation and diffusion of green technology. [3] Apart from compatibility with the European Convention on Human Rights, the Charter of Fundamental Rights, general principles of Union law, the Treaties, current Union laws and existing international obligations, there are more issues to address. Whose monopolistic practices make Walmart look like a corner shop and Rupert Murdoch <http://www.guardian.co.uk/commentisfree/2011/aug/29/academic-publishers-mur…>a socialist? You won't guess the answer in a month of Sundays. While there are plenty of candidates, my vote goes not to the banks, the oil companies or the health insurers, but -- wait for it -- to academic publishers. Theirs might sound like a fusty and insignificant sector. It is anything but. Of all corporate scams, the racket they run is most urgently in need of referral to the competition authorities. Everyone claims to agree that people should be encouraged to understand science and other academic research. Without current knowledge, we cannot make coherent democratic decisions. But the publishers have slapped a padlock and a "keep out" sign on the gates. You might resent Murdoch's paywall policy, in which he charges £1 for 24 hours of access to the Times and Sunday Times. But at least in that period you can read and download as many articles as you like. Reading a single article published by one of Elsevier's journals will cost you $31.50. Springer charges EUR34.95, Wiley-Blackwell, $42. Read 10 and you pay 10 times. And the journals retain perpetual copyright. You want to read a letter printed in 1981? That'll be $31.50. [...] The knowledge monopoly is as unwarranted and anachronistic as the corn laws. Released Neubot 0.4.1 http://www.neubot.org/neubot-0.4.1 Version 0.4.1 is the sixth generally-available stable release of Neubot, distributed for Ubuntu >= 10.04, MacOSX >= 10.6 and Windows >= XP SP3. It is also available in source format (.tar.gz and .zip). This release contains 92 patches. The diffstat says: 92 files changed, with 4851 lines inserted and 522 lines deleted. Here are the most relevant changes: o new installer for Mac that (i) installs Neubot as a daemon so that it runs at startup and (ii) shows privacy policy and asks for privacy permissions; see also <http://www.neubot.org/install-mac-os-x>; o new neubot/www/lang/en.js to start from in order to translate the web user interface to other languages; o more code rationalizations, bug fixes and unit tests. The release candidates have been tested on Ubuntu 10.04, Windows XP SP3, Windows 7 and MacOSX 10.6. We've not been able to find a MacOSX 10.5 machine to test the new package, so we don't know whether the new installer has issues with such version.
