The participants will be required to prepare a 4,000-6,000 word paper in response to one of five questions relating to the governance of cyberspace. The 16 experts selected will get supported travel to The Hague in May 2014 for a 3-day conference. The authors of the best papers will also be sent to a conference in New Delhi, India. They are not only soliciting academics but also people from business, international organizations, civil society and national governments. The deadline for submission of applications is 31 January. Esclusiva : il Documento Confidenziale della Commissione Europea su Regolamento AGCOM e copyright, mai mostrato in precedenza. La Commissione UE contesta formalmente allAGCOM il pericolo di violazione dei diritti fondamentali, chiedendo garanzie. Ma lAutorità approva il Regolamento. Roma, 17 dicembre 2013 La vicenda del regolamento AGCOM su diritto dautore, già incredibile per quanto accaduto sin qui, si arricchisce di giorno in giorno di fatti allapparenza inspiegabili. La Commissione Europea, chiamata ad emettere osservazioni al regolamento sul diritto dautore notificatole ad inizio settembre, in base alla direttiva 34/98, riempie un documento di 6 pagine di osservazioni, di contestazioni, alcune delle quali appaiono in grado di sconvolgere limpianto stesso del regolamento dalle fondamenta, e lo invia al Governo Italiano, alla fine di novembre di questanno. Il documento classificato come riservato, è firmato dal Vicepresidente della Commissione Maros Sefcovic, Commissario alle relazioni istituzionali, e arriva alla rappresentanza diplomatica italiana di Bruxelles il 2 dicembre, per essere poi inoltrato al Governo Italiano, ma i canali diplomatici sono lunghi ed il documento arriva in realtà al Governo Italiano solo in questi giorni. Si tengano bene presente le date, perché nei giorni precedenti la emissione del regolamento il 12 dicembre si diffondono notizie sulla stampa di approvazioni e via libera da parte della Commissione alla bozza di delibera Agcom <http://www.corrierecomunicazioni.it/tlc/24759_copyright-e-internet-e-quasi- fatta.htm> http://www.corrierecomunicazioni.it/tlc/24759_copyright-e-internet-e-quasi-f atta.htm Dunque si diffonde la voce di un via libera quasi totale da parte dellUE, e di piccole modifiche richieste dalla Commissione. Altrochè approvazione e piccole modifiche, il documento della Commissione è durissimo, e contesta allAGCOM anche luso stesso delle parole utilizzate, e le definizioni adottate. Si comincia con le critiche puntuali alle stesse definizioni adottate da AGCOM sulle definizioni di gestore della pagina internet ed uploader. Il punto 8 della lettera cosi si esprime: In merito alla definizione di gestore di pagina internet allarticolo 1, lettera h, del progetto di notifica la Commissione ritiene che lattuale formulazione possa dare origine ad incertezza giuridica. E ancora non è chiaro perché le autorità italiane propongono di introdurre lulteriore concetto di gestore di pagina internet, il quale non è usato né dalla direttiva sul commercio elettronico né più in generale dalla rilevante legislazione dellUE. La Commissione contesta quindi allAgcom di utilizzare un terminologia che non rientra nella legislazione UE, introducendo figure inesistenti, che fra l altro lo sono anche nellordinamento italiano. Una solenne bocciatura. E che cosa fa quindi lAGCOM? LAutorità non ha il tempo di valutare con attenzione le osservazioni ed è ovvio che sia cosi, non ne ha il tempo, deve correre ad approvare, dopo una manciata di giorni,il provvedimento il 12 dicembre. E, infatti tra le definizioni del regolamento pubblicato permane al punto h dellarticolo 1, anche la figura del gestore della pagina internet, nonostante la solenne bocciatura. Ma i fatti più imbarazzanti devono ancora venire. La Commissione contesta punto per punto le definizioni adottate dallAGCOM,sul punto relativo allopera digitale a quello di uploader, sulla rimozione selettiva in caso di disabilitazione, su tutto insomma. In a scathing 68-page opinion <http://legaltimes.typepad.com/files/obamansa.pdf> peppered with exclamations of incredulity, United States District Judge Richard Leon, of the Federal District Court of the District of Columbia, found that the seven-year-old phone-data collection program --- which was established under the Patriot Act and has been repeatedly reauthorized by a secret intelligence court --- "almost certainly" violates the Fourth Amendment's prohibition against unreasonable searches. Reaching into the 18th century from the 21st, the judge wrote that James Madison "would be aghast" at the degree of privacy invasion the data sweep represents. The ruling by Judge Leon, who was nominated to the bench by President George W. Bush on Sept. 10, 2001, was remarkable for many reasons, but mainly because there were real people sitting in open court challenging the government's lawyers over the program's constitutionality. The report highlights key events and recent trends in the digital space. To mirror the collaborative spirit of the initiative, we compile---based on an open invitation to the members of the extended Berkman community---nearly two dozen short essays from friends, colleagues, and collaborators in the United States and abroad. The result is intended for a general interest audience and invites reflection and discussion of the past year's notable events and trends in the digitally networked environment. ABSTRACT: This article presents an analysis based on data from an open dataset made available by an independent empirical research on the topic of "Copyright in the digital age". The original data includes information about attitudes, social perceptions and levels of awareness. After describing the initial objectives of the research and presenting the set of variables considered, an in-depth analysis is here discussed, focusing on the similarities and differences encountered in distinct categories of respondents. The main objective of this analysis is to test the soundness and the descriptive power of the classification proposed in the original study, which divided respondents into the four categories of "Generic", "Active", "Creative" and "Professional creative" users. Other possible clusters are identified here, and their possible associations with those groups is discussed. Results indicate that the views of authors of digital content about the practice of illegal download tend to differ from those of non producers. Non publishers of digital content seem to be almost equally distributed between those who are against download, and those who tolerate it. Grazie. The basic pillar of democracy is the inviolable integrity of the individual. Human integrity extends beyond the physical body. In their thoughts and in their personal environments and communications, all humans have the right to remain unobserved and unmolested. This fundamental human right has been rendered null and void through abuse of technological developments by states and corporations for mass surveillance purposes. A person under surveillance is no longer free; a society under surveillance is no longer a democracy. To maintain any validity, our democratic rights must apply in virtual as in real space. * Surveillance violates the private sphere and compromises freedom of thought and opinion. * Mass surveillance treats every citizen as a potential suspect. It overturns one of our historical triumphs, the presumption of innocence. * Surveillance makes the individual transparent, while the state and the corporation operate in secret. As we have seen, this power is being systemically abused. * Surveillance is theft. This data is not public property: it belongs to us. When it is used to predict our behaviour, we are robbed of something else: the principle of free will crucial to democratic liberty. WE DEMAND THE RIGHT for all people to determine, as democratic citizens, to what extent their personal data may be legally collected, stored and processed, and by whom; to obtain information on where their data is stored and how it is being used; to obtain the deletion of their data if it has been illegally collected and stored. WE CALL ON ALL STATES AND CORPORATIONS to respect these rights. WE CALL ON ALL CITIZENS to stand up and defend these rights.
