Consumers could simply switch providers whenever Netflix or YouTube started to get choppy. And that would give Netflix and YouTube more leverage in their deals with the ISPs. At the moment, this option---where ISPs are treated as "common carriers"---is on the table, but it seems like a remote possibility. Maybe it shouldn't be. Instead of railing against fast lanes, we should be pushing Washington to explore ideas like this that could actually promote competition among ISPs. "Knowledge commons" describes the institutionalized community governance of the sharing and, in some cases, creation, of information, science, knowledge, data, and other types of intellectual and cultural resources. It is the subject of enormous recent interest and enthusiasm with respect to policymaking about innovation, creative production, and intellectual property. Taking that enthusiasm as its starting point, Governing Knowledge Commons argues that policymaking should be based on evidence and a deeper understanding of what makes commons institutions work. It offers a systematic way to study knowledge commons, borrowing and building on Elinor Ostrom's Nobel Prize-winning research on natural resource commons. It proposes a framework for studying knowledge commons that is adapted to the unique attributes of knowledge and information, describing the framework in detail and explaining how to put it into context both with respect to commons research and with respect to innovation and information policy. Eleven detailed case studies apply and discuss the framework exploring knowledge commons across a wide variety of scientific and cultural domains. This seminar is organized in cooperation with the Joint Research Activity on "Governance, Regulation and Standards" of the EINS European Network of Excellence in Internet Science <www.internet-science.eu>. Biography of Brett Frischmann Brett Frischmann is Professor of Law at the Benjamin N. Cardozo School of Law, Yeshiva University, where he teaches intellectual property and Internet law. He is currently the Director of Cardozo's IP and Information Law Program, an Affiliated Scholar of the Center for Internet and Society at Stanford Law School, and an Affiliated Faculty Member of The Vincent and Elinor Ostrom Workshop in Political Theory and Policy Analysis, Indiana University. n March 2012, he published Infrastructure: The Social Value of Shared Resources <http://www.amazon.com/Infrastructure-Social-Value-Shared-Resources/dp/01999…>, with Oxford University Press. "Data is one of the few resources that is not only renewable and repurposable, it is also expandable and pervasive. While listening to oral arguments in April, Chief Justice John Roberts Jr. asked, with apparent sincerity, why anyone other than a criminal would carry two cellphones. Yet in a gratifyingly sweeping ruling on Wednesday, the court embraced a central reality of the digital age and protected such phones from being searched without a warrant during an arrest, except in rare circumstances. "Modern cellphones are not just another technological convenience," Chief Justice Roberts wrote for a unanimous court. Il problema è renderlo effettivo, utilizzabile. Un miraggio, argomenta unlungo e dettagliato studio <http://irissproject.eu/?page_id=9>coordinato dall'Università di Sheffield, e parte del progetto del progetto IRSS (Increasing Resilience in Surveillance Societies) finanziato dall'Unione Europea. Intitolato'Exercising Democratic Rights under Surveillance Regimes' <http://irissproject.eu/wp-content/uploads/2014/06/IRISS-WP5-Executive-Summa…>, il lavoro pubblicato in queste ore si addentra in tre problemi macroscopici: comprendere il quadro normativo all'interno dei singoli Paesi dell'Unione e darne un'analisi comparativa, studiare sul campo quanto è semplice o meno reperire chi è responsabile del controllo dei nostri dati (/data controller/), e da ultimo -- sempre dal punto di vista empirico -- osservare la effettiva capacità di risposta di questi soggetti alle richieste dei cittadini. Il risultato è deludente. Newly uncovered components of a digital surveillance tool used by more than 60 governments worldwide provide a rare glimpse at the extensive ways law enforcement and intelligence agencies use the tool to surreptitiously record and steal data from mobile phones. The modules, made by the Italian company Hacking Team, were uncovered by researchers working independently of each other at Kaspersky Lab in Russia and the Citizen Lab at the University of Toronto's Munk School of Global Affairs in Canada, who say the findings provide great insight into the trade craft behind Hacking Team's tools. Earlier this month, on the HBO comedy news show "Last Week Tonight," host John Oliver went on a 13-minute rant against the new set of internet rules proposed by the FCC. He warned that the rules would lead to a world where internet service providers like Comcast and Verizon can sell special treatment to web companies like Google and Netflix, charging extra fees to deliver their online videos and other content at fast speeds, and he urged viewers to bombard the FCC website with protests, saying the rules would end up hurting smaller web outfits that can't afford to pay the fees. The next day, the FCC site buckled under the traffic and went offline. It was just part of a sweeping effort to squash the proposed rules. When the rules first leaked out in May, protesters camped out in front of the FCC's Washington offices. Big tech companies such as Google, Amazon, and Netflix signed a letter asking the government communications agency to bar internet providers from discriminating "both technically and financially against internet companies." And last week, two big name Democrats on Capitol Hill unveiled a bill that seeks to undermine the new rules. Nearly everyone, it seems, wants to prevent the FCC from allowing some companies to have internet "fast lanes" while others toil at slower speeds.
