proprietà intellettuale e assegnisti di ricerca

Discutendo con ex colleghi di dottorato si parlava della proprietà intellettuale sui loro scritti e in alcuni casi anche degli applicativi sviluppati. Mi si è accesa la lampadina del dubbio sull'applicabilità dell'art. 12 bis legge 633/1941 al caso degli assegnisti: "salvo patto contrario, il datore di lavoro è titolare del diritto esclusivo di utilizzazione economica del programma per elaboratore e della banca dati creati dal lavoratore dipendente nell'esecuzione delle sue mansioni o su istruzioni impartite dallo stesso datore di lavoro." La norma si riferisce espressamente ai casi di lavoro subordinato... tuttavia gli assegnisti sono equiparati più a dei collaboratori a progetto che a dei parasubordinati. A conferma di ciò c'è varia giurisprudenza in materia di diritto del lavoro e la varie circolari in materia previdenziale (basti vedere che gli assegnisti fanno capo alla gestione separata INPS, al pari dei lavoratori autonomi). Non solo: normalmente i bandi precisano che gli assegnisti prestano il loro contributo al progetto di ricerca in piena autonomia e senza vincoli di orari. Conosco personalmente assegnisti che fanno "largo suo" di questa possibilità e svolgono buona parte del loro lavoro "lavorando da casa" e senza interfacciarsi costantemente con il responsabile del progetto di ricerca. Dunque, come distinguere ciò che può essere inteso come opere realizzate ai sensi dell'art. 12 bis (e quindi con diritti di utilizzazione "avocati" all'ente di ricerca) da ciò che invece è realizzato come attività intellettuale/creativa autonoma dell'assegnista? E' un aspetto che secondo me prima o poi andrebbe chiarito e su cui bisognerebbe fare divulgazione; credo che - salvo tra i ricercatori in ambito giuridico - ci sia davvero poca consapevolezza su questo aspetto. Google says it’s showing us the most relevant results, and Facebook aims to show us what’s most important. But what’s relevant? What’s important? Unlike other forms of automation or algorithms where there’s a definable right answer, we’re seeing the birth of a new era, the era of judging machines: machines that calculate not just how to quickly sort a database, or perform a mathematical calculation, but to decide what is “best,” “relevant,” “appropriate,” or “harmful.” It’s one thing to ask a computer the answer to a factoring problem, or the quickest driving path from point A to point B — it’s another to have a computer decide for us who among our friends is most “relevant” to us, or what piece of news is of most importance, or who should be hired (or fired). With nothing more technologically advanced than a phone, you can arrange to have delivered to your doorstep, often in less than an hour, takeaway food, your weekly groceries, alcohol, cigarettes, drugs (over-the-counter, prescription, proscribed), books, newspapers, a dozen eggs, half a dozen eggs, a single egg. I once had a single bottle of Coke sent to my home at the same price I would have paid had I gone to shop myself. The same goes for services. When I lived there, a man came around every morning to collect my clothes and bring them back crisply ironed the next day; he would have washed them, too, but I had a washing machine. These luxuries are not new. I took advantage of them long before Uber became a verb, before the world saw the first iPhone in 2007, even before the first submarine fibre-optic cable landed on our shores in 1997. In my hometown of Mumbai, we have had many of these conveniences for at least as long as we have had landlines—and some even earlier than that.
