On Wednesday, in an open letter to members, Roy Blount <http://www.authorsguild.org/advocacy/articles/roy-blount-on-google-orphans.…>, the president of the Authors Guild, argued that such criticism was unwarranted. “I would generally rather be a dissenter, myself, than not,” he wrote. But, he added: “I can’t see any reason to dissent from the settlement over the matter of orphan books.” These books, he said, are being given an opportunity with the Google settlement — the chance to see the light of day and find readers again. “Google is essentially being accused of cornering the market on the unmarketable,” Mr. Blount, the author of “Longtime Leaving” and “Alphabet Juice.” “To prevent a monopoly of the orphans, the dissenters would undo a wide range of benefits to authors, publishers and readers,” he concluded, appending a list of benefits of the settlement. The Google settlement is currently the subject of a Justice Department inquiry and is also subject to court review.

Ma come sono gestiti i diritti che vanno oltre quelli "rilasciati" gratuitamente? L'esempio più tipico è quello delle licenze "creative commons non commerciali". Se incontro ad esempio una foto pubblicata in Internet con questo tipo di licenza e voglio sfruttarla commercialmente, cosa debbo fare? Finora lo schema di gestione delle CC non forniva risposte a questa domanda. Oggi le cose si modificano, grazie ad una iniziativa della società di gestione diritti USA CCC-Copyright Clearing Center (con la quale AIDRO collabora attraverso lo scambio di repertori), denominata OZMO, presentata nei giorni scorsi a Madrid durante l'incontro del "Digital Issue Forum" di IFRRO. Qualsiasi produttore di contenuti digitali che utilizza licenze CC plus può creare in modo semplice, tramite un editor web, una propria licenza di utilizzo delle proprie opere non limitata agli usi gratuiti. Per quelli commerciali gli utilizzatori interessati possono acquisire tramite CCC i diritti d'uso, secondo i termini e le condizioni fissate dall'autore, che riceve i redditi derivanti sulla base di rendiconti periodici. Le licenze sono associate ai contenuti tramite un semplice link, analogo a quanto avviene con le licenze CC, così che se incontrano il logo di OZMO a fianco di quello CC gli utenti sono immediamente messi in grado di raggiungere tutte le informazioni necessarie per un riutilizzo anche commerciale del contenuto. L'iniziativa dimostra come le licenze CC ribadiscano l'importanza dei diritti degli autori, in primis e da sempre quelli morali, ma - a partire da questa iniziativa - anche quelli patrimoniali. Se taluno ha giocato sull'inglese copyright per proporre le CC come copyleft, si potrebbe forse dire che con le Creative commons l'author's right, il diritto d'autore, è ribadito come the author is right, l'autore ha ragione, dal momento che mantiene il giusto controllo della propria opera. 08/06/2009

New Harvard Business School working paper "File Sharing and Copyright"

The paper, which includes a helpful survey of the prior economic studies on the impact of file sharing, includes the following: 1. The data indicates that file sharing has not discouraged creativity, as the evidence shows significant increases in cultural production. The authors note that: Overall production figures for the creative industries appear to be consistent with this view that file sharing has not discouraged artists and publishers. While album sales have generally fallen since 2000, the number of albums being created has exploded. In 2000, 35,516 albums were released. Seven years later, 79,695 albums (including 25,159 digital albums) were published (Nielsen SoundScan, 2008). Even if file sharing were the reason that sales have fallen, the new technology does not appear to have exacted a toll on the quantity of music produced. Obviously, it would be nice to adjust output for differences in quality, but we are not aware of any research that has tackled this question. Similar trends can be seen in other creative industries. For example, the worldwide number of feature films produced each year has increased from 3,807 in 2003 to 4,989 in 2007 (Screen Digest, 2004 and 2008). Countries where film piracy is rampant have typically increased production. This is true in South Korea (80 to 124), India (877 to 1164), and China (140 to 402). During this period, U.S. feature film production has increased from 459 feature films in 2003 to 590 in 2007 (MPAA, 2007). Given the increase in artistic production along with the greater public access conclude that "weaker copyright protection, it seems, has benefited society." This is consistent with the authors' view that weaker copyright is "uambiguously desirable if it does not lessen the incentives of artists and entertainment companies to produce new works." 2. The paper takes on several longstanding myths about the economic effects of file sharing, noting that many downloaded songs do not represent a lost sale, some mashups may increase the market for the original work, and the entertainment industry can still steer consumer attention to particular artists (which results in more sales and downloads). 3. The authors' point out that file sharing may not result in reduced incentives to create if the willingness to pay for "complements" increases. They point to rising income from performances or author speaking tours as obvious examples of income that may be enhanced through file sharing. In particular, they focus on a study that concluded that demands for concerts increased due to file sharing and that concert prices have steadily risen during the file sharing era. Moreover, the authors' canvass the literature on the effects of file sharing on music sales, confirming that the "results are decidedly mixed." The authors were one of the first to challenge the early claims about the effects of file sharing. Years later, many other economists have followed suit (including the study funded by Industry Canada). This latest paper does a nice job of expanding the discussion, by using the data to examine incentives for creativity and the effects on aggregate creator and industry income.

http://www.laquadrature.net/fr/lettre-ouverte-aux-pro-hadopi Suite à la décision du Conseil Constitutionnel neutralisant la loi HADOPI <http://www.laquadrature.net/fr/hadopi-le-conseil-constitutionnel-censure-la…>, les co-fondateurs de La Quadrature du Net ont envoyé une lettre ouverte aux députés qui l'ont votée : ---------------------- Madame la députée, Monsieur le député, Le coeur du dispositif de « riposte graduée » instauré par la loi « Création et Internet », dite « HADOPI », que vous avez votée le 12 mai dernier était, selon le Conseil constitutionnel dans sa décision datée du 10 juin 2009, contraire aux principes de séparation des pouvoirs et de présomption d'innocence, mais également restrictive des libertés d'expression et d'information et du droit à un procès équitable. Nous vous avions alerté à de multiples reprises sur ces points au cours des mois qui ont précédé son examen. Vous étiez naturellement libre de ne pas suivre notre avis pour vous forger le vôtre. Mais au-delà de nos propres inquiétudes, ce sont des centaines, sinon des milliers de citoyens, dont nombre de vos électeurs, qui vous ont également alerté sur ces aspects extrêmement préoccupants pour le bon équilibre de notre démocratie. Nous savons que de nombreux députés qui ont approuvé le projet de loi avaient de profonds doutes sur la compatibilité du dispositif proposé avec les droits fondamentaux. Mais les instructions de « silence dans les rangs » relayées par divers responsables ont eu temporairement raison de ces doutes. Il est très inquiétant pour l'avenir des libertés individuelles en France qu'il ait pu en être ainsi malgré les critiques émises par tant d'institutions, d'analystes et de citoyens contre le projet, et malgré l'importance des enjeux dont témoigne la sévérité de la décision du Conseil constitutionnel. Ainsi, pour le Conseil constitutionnel, *« Considérant qu'aux termes de l'article 11 de la Déclaration des droits de l'homme et du citoyen de 1789 : " La libre communication des pensées et des opinions est un des droits les plus précieux de l'homme : tout citoyen peut donc parler, écrire, imprimer librement, sauf à répondre de l'abus de cette liberté dans les cas déterminés par la loi " ; qu'en l'état actuel des moyens de communication et eu égard au développement généralisé des services de communication au public en ligne ainsi qu'à l'importance prise par ces services pour la participation à la vie démocratique et l'expression des idées et des opinions, ce droit implique la liberté d'accéder à ces services »*. C'est cet attachement aux valeurs fondamentales de notre démocratie et à son bon fonctionnement que nous avons été des milliers à vous rappeler. Nous avons sans cesse souligné que la régulation d'Internet, ce formidable moteur de croissance économique et sociale, pouvait emprunter d'autres voies, respectueuses des libertés autant que soucieuses des conditions d'existence de la création. Les libertés individuelles des citoyens connectés en réseau seront de nouveau, prochainement, menacées. Nous espérons sincèrement que les logiques de parti et les pressions de lobbies ayant un intérêt à restreindre les libertés fondamentales pèseront à l'avenir moins que la mission de protection de nos concitoyens qu'implique votre mandat électif. Giu 9th, 2009 by admin. http://www.guidoscorza.it/?p=821 L’Ansa battuta qualche minuto fa a proposito della fiducia che il Governo chiederà sul Maxi-emendamento in materia di intercettazioni ha un significato sinistro e preoccupante per la Rete: il testo maxi-emendato, infatti, introduce nel nostro Ordinamento l’obbligo di rettifica entro 48 ore a pena di una sazione pecuniaria tra i 15 ed i 25 milioni di vecchie lire per tutti i titolari di “siti informatici”. Ho già detto molto, se non tutto, qui e qui a proposito della questione e, per non ripetermi (troppo) credo debba solo aggiungere che il Governo sta mostrando, una volta di più, di non conoscere la Rete ma di temerla incredibilmente almeno fin tanto che sarà diversa da una televisione… Il maxi-emendamento rischia di cambiare molto nelle dinamiche dell’informazione in Rete ed è un inutile sacrificio della libertà di espressione che comprimerà i diritti di molti senza arrecare alcun vantaggio neppure a pochi. Parliamone, parliamone, parliamone…

Carissimi, in diversi hanno chiesto di spostare a ora un po' piu' tarda i mercoledi' di NEXA, ovvero dalle 18 alle 20, anziche' dalle 17 alle 19, in modo da facilitare coloro che lavorano con orari un po' rigidi. All'incontro di ieri, folto di participanti, c'e' gia' stato un sostanziale consenso preliminare. Possiamo quindi procedere? Già oggi pomeriggio avrei voluto sollevare la questione prima che arrivasse Pancini, ma non avevo ancora letto tutte le mail - e credo comunque di non essere ancora sufficientmente informato. posto che non sono ancora pacifici i limiti di applicazione del maxi-emendamento, mi sono chiesto se alcuni dei beneficiari privati di questa restrizione siano i social network. Ora, tralasciando - per quanto si possa - la censura di facebook, immagino il caso in cui un utente usi il suo account come una sorta di blog (per certi versi è un caso già abbastanza diffuso). Se prendiamo un blogger con un certo seguito, questi potrebbe creare un account o comunque trasferire su questo (gran) parte dell'attività che svolge. non proseguo su quelle che credo sarebbero le implicazioni (non credo che cambierebbe solo il cane da guardia), perchè magari il mio ragionamento è sbagliato alla radice e vi farei solo perdere tempo. è sensato, oppure la restrizione sarebbe applicabile anche agli account dei social network? potremmo pubblicare anche per Pancini un'intervista aperta di 10 domande... Between journalist calls, I am pleased to let you know that our Constitutional Court has censored the full sanction element of the HADOPI law. Even more remarkable if one believes the following news item, the Constitutional Court has created a wonderful case law that defines Internet access necessary to the practical exercise of fundamental rights (expression, communication), stating that it can not be restricted by sanction or imposition of technical means. It has taken language from both the Lambrinidis report and teh Bono-Cohn- Bendit-Roithova amendment. Cheers ! Ces pouvoirs pouvaient donc conduire à restreindre l’exercice, par toute personne, de son droit de s’exprimer et de communiquer librement. Dans ces conditions, le législateur ne pouvait, quelles que soient les garanties encadrant le prononcé des sanctions, confier de tels pouvoirs à une autorité administrative dans le but de protéger les titulaires du droit d’auteur. Ces pouvoirs ne peuvent incomber qu’au juge".

French Government hurries to put HADOPI law into application ============================================================ No sooner has the three strikes law been adopted that the French government issued CCAPs (special administrative specifications) and CCTPs (special technical specifications) which were sent by the Ministry of Culture to the candidate enterprises to put into function the information system of HADOPI. The call for tenders was sent since the beginning of the year even before the Hadopi law was adopted, the notification date having been set for 5 June 2009 with a deadline on 1 July 2009 for a first prototype of the graduate response system. A draft calendar foresees the application of the Hadopi law in stages starting with 5 June 2009 until 31 March 2010. In the beginning, Hadopi will send only written recommendations by e-mail at a rate of about 100 infringing cases per day after which, when the treatment is completely automatic probably in September 2009, the number of cases will increase to 1000 per day reaching 10 000 when the prototype is finalised in 2010. A calendar of actions is left however at the choice of the candidates, the CCTP mentioning that "the offers will be assessed in terms of the closeness of the proposed calendar as compared to the target calendar". The ministry is not concerned with costs or means but only with speed. The candidates will have a rather difficult task as the beta-test will last only two weeks before the first warnings and the blocking bugs will have to be corrected in one day, otherwise they will face sanctions. There is also the result obligation, the operator taking the responsibility in case of problems and having to compensate Hadopi in case of delays or malfunctions. There is no provision for the moment that Hadopi makes sure, before issuing a warning or a sanction, that illegal downloading has effectively taken place from the IP address of a suspected Internet subscriber. It appears that between the IP address collection phase and the warning or sanction phase there will be a "notarisation and sampling" phase. The notarisation phase means the "qualification of the data and the recording of essential elements of the transaction from a trustworthy third party" meaning the recording of all the elements proving the downloading or rather making copyrighted material available. "The content, origin, receiving date, the sender's identification key and the destination of the file are essential elements" says the CCTP. Sampling means Hadopi would retain only some of the complaints received in order to deal mostly with those of higher interest. An algorithmic system will allow targeting potential recidivists as a priority. Hadopi does not take into account the presumption of innocence and only needs to be certain of the reliability of the IP address lists on the basis of which it would give warnings and sanctions. Hence the provision of attaching a "chunk" of the file to every submission of a case in court which would be a material proof of the infringing. However, such a provision raises practical and economical problems. The CCAP and CCTP do not precise either the criteria based on which Hadopi will decide on recidivism in order to send another e-mail, registered letter or give sanctions. It is only mentioned that a "study of the reiterations is carried out so as to bring out the following elements for each subscriber: infringement stage (1st, 2nd, 3rd.); type of actions taken or sanctions given by the High Authority: time interval between each infringement; and type of works concerned". There are also very little details as to what are the means of appeal for the sanctioned Internet users. It is provided that an appeal can be made by means of an electronic form or by mail and that the appeal may lead to informing the ISP of the obligation to re-establish a suspended subscription. On the other hand, no observations can be brought by a subscriber before the sanction stage. For the time being, Hadopi continues to be criticised and contested. On 15 June, a concert evening against the graduate response will take place with several groups of artists supported by Numerama, co-organised by Réseau des Pirates and Owni.fr, in partnership with Vendredi Hebdo and International and supported also by Slate, Agoravox, LePost, Ivox, 22mars, Social Média Club, j'affiche and ZikNation. The evening will include the projection on films dealing with Hadopi, the new models to remunerate artists, the protection of numerical freedoms, a debate on the topics as well as music moments. "The problem with HADOPI is triple: it does not bring more money to artists, it touches the fundamental rights and finally it opens a breach into net neutrality allowing private interests to get hold of a judge in order to oblige an access provider to censure part of the net. This law stigmatises the Net which is however an incredible chance for the music to get renewed. (...) The spyware can be installed for a four-month period that can be renewed once. The examining magistrate's control would be a positive thing as the examining magistrates are independent from the Ministry of Justice and are free to take decisions, in terms of the gravity of the investigation. However, if the justice reform project of the French Government comes into being, the examining magistrates will disappear which means that the responsibility to authorize spyware will come to the prosecutor of the Republic. The law also obliges ISPs to block access, "without delay", to sites included on a list drafted under the authority of the Ministry of Internal Affairs. The list will not be made public and therefore it will be impossible to contest and this will create the risk of abuses. In order to prevent contestations, for the beginning, the law will target the paedophilic contents with the declared purpose to "protect the Internet users from child pornography images". The operators will have to introduce in their network software that will stop any connection to sites having a pedophile character that will be listed by the police. The French Government will always be able to extend the target by a simple decree. The police will be allowed to make use of these tools only in "the most severe cases" which however include "support given to the illegal entry and residence of a foreigner". Under the control of an examining magistrate (juge d'instruction), the investigating authority will have to justify the use of the technique by declaring the infringement investigated, the place where the investigation will take place and its duration. The spyware can be installed for a four-month period that can be renewed once. The examining magistrate's control would be a positive thing as the examining magistrates are independent from the Ministry of Justice and are free to take decisions, in terms of the gravity of the investigation. However, if the justice reform project of the French Government comes into being, the examining magistrates will disappear which means that the responsibility to authorize spyware will come to the prosecutor of the Republic. The law also obliges ISPs to block access, "without delay", to sites included on a list drafted under the authority of the Ministry of Internal Affairs. The list will not be made public and therefore it will be impossible to contest and this will create the risk of abuses. In order to prevent contestations, for the beginning, the law will target the paedophilic contents with the declared purpose to "protect the Internet users from child pornography images".
