Qualche mia riflessione post-Pisanu (incrociando le dita), con la proposta di un'Agenda Digitale Italia (il titolo, come al solito, non l'ho scelto io). juan carlos 30/12/2010 *Le tre zavorre che frenano l'Internet tricolore* JUAN CARLOS DE MARTIN Il mattino del 1° gennaio 2011 l'Italia che naviga e innova in Rete si sveglierà un po' più libera. Dando, infatti, seguito ad una promessa del ministro Maroni del novembre scorso, affiancata da molteplici iniziative sia della maggioranza sia delle opposizioni, il governo ha inserito nel decreto Milleproroghe di fine anno l'abrogazione di quasi tutto l'articolo 7 del decreto Pisanu. Ciò in concreto significa che da inizio 2011 non sarà più necessario mostrare un documento d'identità prima di accedere alla Rete da un punto di accesso pubblico. Inoltre, chi offre l'accesso - caffè, albergo, biblioteca, università, eccetera - non dovrà più né fotocopiare i documenti degli utenti, né conservare i registri delle loro attività online. Rimane l'obbligo di richiesta di una licenza al questore per gli Internet café, come anche altri eventuali obblighi previsti dalla normativa sulle telecomunicazioni. Dopo cinque lunghi anni, dunque, l'Italia finalmente abbandona una norma unica tra i Paesi sviluppati e torna alla normalità. E' una buona notizia, di cui bisogna dare credito al governo, il quale è come se avesse tolto, con ampio consenso politico, una palla di ferro dalle caviglie dell'innovazione digitale italiana. Tutto a posto, dunque? Dal primo gennaio possiamo aspettarci Wi-Fi per ogni dove e una popolazione improvvisamente connessa? Ovviamente no, non esageriamo. Tolto il decreto Pisanu, infatti, alle caviglie rimangono diverse altre palle di ferro e, come non bastasse, le gambe del corridore sono molto gracili. E', quindi, giusto rallegrarsi per il fatto che tra pochi giorni sarà più facile offrire accesso alla Rete a chi partecipa a convegni, va in biblioteca o visita le nostre città, ma dobbiamo guardare avanti e più in grande, definendo quella che potremmo chiamare un'agenda digitale per l'Italia. Una strategia di ampio respiro che porti il nostro Paese, nell'arco di qualche anno, a camminare sicuro sulle proprie gambe, confrontandosi con le nazioni che meglio stanno affrontando il secolo della Rete. The goal has been to use threats against their other trade activities to force them to introduce laws that summarily restrict the freedom of their citizens to use the Internet - without judicial involvement, if possible. The bullying is distasteful, but it may be that you've not considered what's really wrong with the laws themselves. Bad Law What /is/ wrong with these laws? The problem is that USTR is being used as a puppet by powerful US-based multinational companies to protect their businesses against the inevitable gravity of the three technology laws <http://www.jimpinto.com/writings/techlaws.html>. It's not just that companies who built their business by freely using the contents of our collective cultural commons now want to strangle it (although they hypocritically do want that). It's not just that those same companies want their faltering business models shored-up by chilling effects, framing the celebration /by their customers/ of the culture /they are trying to create/ as akin to murder, rape and theft ("piracy"). It's not /even/ that the new laws give a bunch of businesses who have shown themselves to have severely asymmetric morals the power to simply accuse without proof to get results. Cultural Conduit No, the problem is much deeper than some of the campaigns against Internet restrictions laws designed around the idea of "Guilt Upon Accusation" would suggest. Our society has changed fundamentally in the last decade. The emergence of the world-wide web pushed the Internet from research curiosity into endemic facility, present in every office, then every home and now every pocket. It is now the medium for culture, for education, for finance, for politics, for engagement with government services. We will increasingly see the Internet be the /only/ way things can be done - it's already getting close to that way in some areas (airline bookings, tax filings, event tickets all being easy examples).
