ITU/WCIT - a digital cold war?

Dec 14th 2012, 7:28 by L.S. | DUBAI THE International Telecommunication Union (ITU) has always prided itself on being one of the most pragmatic organisations of the United Nations. Engineers, after all, speak a similar language, regardless where they come from. Even during the cold war they managed to overcome their differences and negotiate the International Telecommunication Regulations (ITR), a binding global treaty that even today governs telecommunications between countries. But the internet seems to be an even more divisive than cold-war ideology. The World Conference on International Telecommunications (WCIT) in Dubai, where the ITU met to renegotiate the ITR, ended in failure in the early hours of November 14th. After a majority of countries approved the new treaty, Terry Kramer, the head of the American delegation, announced that his country is “not able to sign the document in its current form.” Shortly thereafter, at least a dozen countries—including Britain, Sweden and Egypt—signalled that they would not support the new treaty either. The main issue was to what extent the internet should feature in the treaty. America and its allies wanted to keep it from being so much as mentioned—mainly out of fear that any reference to it whatsoever would embolden governments to censor the internet and meddle with its infrastructure. For some time a compromise among the more the 600 delegates, who were confined to an oppressive convention hall, seemed possible: the binding ITR would indeed hardly make any mention of the internet, but China, Russia and many Arab countries would get a non-binding resolution on the internet (with the awkward title “To foster an enabling environment for the greater growth of the Internet”). Yet this package did not fly—because for America both the ITR and the resolution crossed several red lines. One section of the draft treaty calls for the regulation of “unsolicited bulk electronic communication”, commonly known as “spam”. But prohibiting spam in an international treaty, the Americans argue, would require some definition of the kind of content intended—which could thereby limit the freedom of expression. Russia also insisted that the relevant entities in the treaty be defined as “operating agencies”, which would include internet services providers (ISPs) and other internet firms. (America wants the entities to be classed as “recognised operating agencies”, code for old-style telecommunication carriers.) America’s willingness to stand up for the internet should be welcomed. But it has to be said that in doing so it is also defended its interests: no other country benefits as much from the status quo in the online world. Since much of the internet’s infrastructure is based in America and most of its traffic zips through it, America is in a unique position to eavesdrop, should it be so inclined. America’s internet firms also capture most of the profit pool of the online industry. Only the host country had a larger delegation than America, which sent more than 120 people to Dubai. The American representatives included officials from the department of defence as well as from internet firms like Facebook and Google. It was not just for fear that it might have a chilling effect on freedom of expression that America did not want the word “security” included in the treaty—it also has a stake in keeping other countries from catching up in such matters. And America’s negotiators were not just worried about a digital divide when they pushed back hard against any attempts by European telecoms operators to introduce language about internet charges. The proposed changes could have helped the European firms in their efforts to get big internet firms to pay them for passing on their traffic. The immediate impact of the WCIT’s failure will be minor. Despite the opposition from America and its allies, the ITU will have the remaining countries sign the new treaty on Friday—in the hope that the other member states will come around eventually. What is more, the treaty may be binding, but a new version will have to be ratified by the ITU’s member states, which can take a couple of years. And it is not clear how it can be enforced. In the medium term, however, the outcome of the conference in Dubai will weaken the ITU—which may not be such a good thing. Among all the controversy it was forgotten that the organisation actually does very useful work, for instance in managing the international radio-frequency spectrum and developing technical standards. And some of the good ideas about which the delegations could agree may now fail to come to fruition. The WCIT reached consensus on a resolution to create a worldwide emergency number (although this would take years to implement). It also agreed on wording to make it easier for landlocked countries and certain island states to get into international fibre-optical networks. The most important result of the conference has been to demonstrate that the world now splits into two camps when it comes to the internet: one is comprised of more authoritarian countries, which would like to turn back the clock and regain sovereignty over their own national bits of the internet; the other wants to keep the internet and its governance as it is (bearing in mind that some of its members’ motives may not always be as pure as they pretend). This sounds much like a digital version of the cold war. The funny thing is that the leading countries in the two camps are the same two that were at loggerheads until the iron curtain parted. One must hope that the failure of the WCIT is not a first step towards raising a digital one. -- -- I speak only for myself. Sometimes I do not even agree with myself. Keep it in mind. La comunicazione politica in tempi di crisi". *Durante le tre giornate del convegno i partecipanti si interrogheranno sul ruolo che la comunicazione riveste all'interno delle democrazie contemporanee, sulle trasformazioni che hanno investito i media e sull'esigenza della politica di rinsaldare il rapporto di fiducia con i cittadini. In un periodo in cui la classe dirigente è chiamata a compiere scelte difficili e impopolari, per partiti e governi la comunicazione diventa uno strumento strategico per raggiungere pubblici spesso distratti e distanti con narrazioni vincenti, convincenti e stabili. Dall'incontro tra la crescente esigenza di comunicare e le trasformazioni che hanno investito il panorama dei media nasce quella che è ormai nota come la politica pop, un fenomeno che coinvolge contemporaneamente politici, giornalisti e cittadini ridefinendo le forme della mediazione e delle relazioni reciproche. Il convegno è articolato in tre diverse sezioni: 1. La popolarizzazione Italian style (14 dicembre 2012, h. 9.00-13.00). Questa sezione è dedicata alla Pop politics ed ai celebrity politicians, agli approdi, alle derive ed ai naufragi della politica-spettacolo. La prospettiva d'interesse è duplice: se, infatti, i politici orientano sempre più la loro comunicazione verso una dimensione pop, questa strada appare sempre più battuta anche al mondo dell'informazione. Quale impatto ha, dunque, la "stretta" pop sulla formazione dell'opinione pubblica? Quali criticità, certo, ma anche quali punti di forza per la comunicazione e per l'informazione pop? Con la conversione in legge del decreto Crescita 2.0, si è aggiunta un'ulteriore modifica all'art. 68 CAD che rappresenta la norma cardine per l'open source nel sistema pubblico italiano (nb: ulteriore rispetto a quella già attuata con la legge 134 del 7 agosto scorso, ma anche rispetto alla versione comparsa due mesi fa nel decreto). Ci sono sostanziali modifiche. Ad esempio, nell'elenco di possibili soluzioni software presente al comma 1 è comparsa anche quella del "cloud computing"; e poi sono stati aggiunti un comma 1bis e 1ter in cui vengono dettagliati i criteri per la famosa "analisi comparativa delle soluzioni". They are the "cybertheorists", embedded reporters of the social network, dreaming of a perfectible electronic future and handing down oracular commandments about how the world must be remade. As did many religious rebels before them, they come to bring not peace, but a sword. Change is inevitable; we must abandon the old ways. The cybertheorists, however, are a peculiarly corporatist species of the Leninist class: they agitate for constant revolution but the main beneficiaries will be the giant technology companies before whose virtual image they prostrate themselves. Cybertheorists' jargon often betrays an adolescent hatred of the world in which they find themselves. Jay Rosen, a prominent "future of news" cyber-guru, takes care at every opportunity to sneer at publishing institutions by pasting to them the epithet "legacy": "legacy newsrooms", "legacy media". Another favourite cyber-adjective is "disruptive". For most of us, disruption is annoying, but for cyber-swamis the more disruptive of established practices technology becomes, the more exciting it is. Forse qualcuno necessita un riepilogo delle puntate precedenti. Il 1° febbraio 2011 annunciai su Internet (attraverso vari canali come mailing lists, social network, articoli...) l'apertura di una web survey su alcuni aspetti di carattere sociologico relativi al diritto d'autore nell'era digitale. Si trattava di un questionario abbastanza consistente che ho realizzato come parte della mia ricerca di dottorato e che ho appunto promosso online sia in versione italiana che in versione inglese. Fin dall'inizio ho sempre promesso "solennemente" che tutti i risultati della ricerca (ovvero i dati e le opere scientifiche e divulgative basate su di essi) sarebbero stati diffusi con un approccio "open", utilizzando licenze di libera distribuzione. Adesso che il mio dottorato si è concluso e ho discusso la tesi, è giunto il momento di tener fede a questa promessa. Questo sito, quindi, è una sorta di estratto/derivazione della mia tesi di dottorato intitolata "Il diritto d'autore nell'era digitale. My strategy sets out a number of concrete points of action to be incorporated in the EU’s trade and development policies. New technologies bring huge opportunities, but people can only really enjoy them if we also tackle the threats emerging from the rise of ICTs, for example by authoritarian regimes. I want to express my gratitude to everyone who contributed to the report via my website, Facebook or Twitter. New technologies also offer ways for politicians to make better policies by working together with experts, voters and anyone interested. I pledge to continue doing so. Dutch Member of European Parliament Marietje Schaake (D66/ALDE) and Rapporteur for the report is happy with the broad support. Schaake: “The Parliament unequivocally acknowledges that digital freedoms, like uncensored access to the internet, are fundamental rights which deserve equal protection as traditional human rights. I have set out a number of concrete points of action to be incorporated in the EU’s trade and development policies. EU’s trade and association agreements, development programs and accession negotiations should be made conditional on respect for digital freedoms. Collected digital evidence, like smart phone pictures and clips of human rights violations should be admissible in court proceedings. Moreover, the EU should stop the export of digital arms: technologies used by authoritarian regimes to track and trace human rights activists, journalists and dissidents. “These kinds of exports toIranandSyriaare blocked now”, Schaake says. “But we need rules and regulations that ensure accountability of companies regarding the impact of their products and software, like misuse for human rights violations. We should think about ‘human rights by design’ to prevent or limit future harm.” *Credibility* The EU should help build the basic ICT infrastructure in developing counties, and provide wireless tablets to enable (online) education. To be a credible defender and advocate the EU domestically has to maintain high standards of digital freedom. The strategy calls on the EU to codify the principle of net neutrality, like theNetherlandsdid in 2012. European companies forced by third country government to take down online content, should be able to count on political backing from European authorities like the High Representative for Foreign Policy or the EU’s Trade Commissioner. *Global player* The EU should globally take the lead in promoting and protecting digital freedoms, Schaake explains. “EU is the world’s largest trading block, but it is also a community of values. It should use its power and act as a global player. The global and borderless nature of the Internet requires new forms of international cooperation and governance with multiple stakeholders. Technologies should be used to promote transparency and freedom.” *Crowd-sourced report* MEP Schaake used an innovative way of writing her report. She posted a discussion paper online on the EU’s digital freedom strategy in its external actions, and invited various stakeholders to provide input through crowd-sourcing. Many internet users, NGO’s, governments and businesses did so. “This is one of the many opportunities of the Internet: bridging the gap between citizens and politics”, says Schaake. The Overview provides a concise description of three years of BEREC’s activities in the field of net neutrality. It summarizes briefly how the Internet works and presents findings related to retail and wholesale relationships and observations in the context of net neutrality.
