In many cases, however, we're letting it happen, by trading freedom for convenience and (often the illusion of) security. Yes, we need better laws and regulations. But what steps can we take as individuals to be more secure and free -- to take back the permissions we're losing? About Dan Dan Gillmor teaches digital media entrepreneurship and is a founding director of the Knight Center for Digital Media Entrepreneurship at Arizona State University's Walter Cronkite School of Journalism and Mass Communication <http://cronkite.asu.edu/>. The Internet could mean the culture made and distributed on the Internet, the LOLCATZ, memes, etc. ("The Internet loves this kind of stuff.") The Internet could mean the infrastructure itself, its speed and distribution. ("The Internet is so sloooow right now.") The Internet could mean the industry that builds it, the consumer and B2B companies that effectively own all the quasi-public spaces through which we traipse. ("The Internet wants to disintermediate blahblahblah.") And there are a thousand other times when we find it easier to say, "The Internet does" or "It feels like the Internet is" or whatever rather than attempt to identify the specific actors of the play. And maybe that was helpful. Maybe in such a distributed system it makes sense to use "The Internet" as a stand-in for causal agents that seem to inhere /in the network/ without belonging to any individual node. Maybe it's like a mob or a gatheration of starlings; the dynamic relationships between the individuals turn out to be more important than the things themselves. But in 2012, that way of talking, if it was ever helpful, is no longer. And there are five reasons for that: Apple, Google, Amazon, Facebook, and Microsoft. Interpreazione giuridica su diritti di accesso dei servizi segreti

Ciao, nell'articolo http://www.ilfattoquotidiano.it/2013/03/29/governo-attraverso-servizi-di-si… viene indicato che i servizi segreti avranno accesso a basi dati con informazioni sui cittadini italiani di operatori di telecomunicazioni e utility elettriche. Chiedo una interpretazione ai giuristi della lista in relazione a questo articolo, cioè per identificare effettivamente a quali informazioni i nostri servizi segreti potranno avere accesso nel futuro prossimo. L'articolo 11, citato nell'articolo, in riferimento alla norma http://www.astrid-online.it/Documenti/Servizi-di/DPCM-24-gennaio-2013.pdf dice: ================================================================ Art. 11 Operatori privati 1. Gli operatori privati che forniscono reti pubbliche di comunicazione o servizi di comunicazione elettronica accessibili al pubblico, quelli che gestiscono infrastrutture critiche di rilievo nazionale ed europeo, il cui funzionamento e' condizionato dall'operativita' di sistemi informatici e telematici, ivi comprese quelle individuate ai sensi dell'art. 1, comma 1, lett. d), del decreto del Ministro dell'interno 9 gennaio 2008, secondo quanto previsto dalla normativa vigente, ovvero previa apposita convenzione: c) forniscono informazioni agli organismi di informazione per la sicurezza e consentono ad essi l'accesso alle banche dati d'interesse ai fini della sicurezza cibernetica di rispettiva pertinenza, nei casi previsti dalla legge n. 124/2007; ================================================================ Dovremmo interpretare "banche dati d'interesse ai fini della sicurezza cibernetica" . L'interpretazione immediata che io ne do' è data da dati di tipo tecnico, come logs di apparati di sicurezza e di sistemi informativi che consentano ai servizi nostrani di avere un presidioni del cyberspazio potendo creare una sorta di "SOC" nazionale che ricevere e correla dati di dettaglio sugli attacchi informatici, realizando un SIEM https://en.wikipedia.org/wiki/Security_information_and_event_management . Questi dati tecnici sono scarsamente lesivi della privacy dei cittadini ed effettivamente realizzano una grande utilità a livello di protezione e cyber intelligence nazionale. Tuttavia posso vedere una interpretazione allargata, che invece mette a rischio effettivo la privacy dei cittadini. A titolo di esempio si potrebbe ritenere "d'interese ai fini della sicurezza cibernetica" la possibilità di accedere ai dati anagrafici e ai metadati di connessione dei clienti di un operatore di telecomunicazione, al fine di identificare l'intestazione di un indirizzo IP, poichè utili all'interno di attività di intelligence su tematiche di cybersecurity. Di fatto, nel caso di legittimazione di una interpretazione più ampia come l'esempio portato qui sopra, si fornirebbe un accesso totale e "senza mandato" a dati anagrafici, tabulati telematici e tabulati telefonici. Se volessimo effettuare una interpretazione ancora più ampia, potremmo definire il sistema di posta elettronica di un operatore di telecomunicazione una "base dati" che è "di interesse" ai fini delle attività di investigazione e intelligence per la "sicurezza cibernetica" . Con questa ulteriore interpretazione, si andrebbe ad autorizzare l'intelligence nazionale, ad esempio ad accedere a tutte le caselle di libero.it o virgilio.it . Cardozo School of Law, Yeshiva University, where he teaches intellectual property and Internet law. He is currently the Director of Cardozo's IP and Information Law Program, an Affiliated Scholar of the Center for Internet and Society at Stanford Law School, and an Affiliated Faculty Member of The Vincent and Elinor Ostrom Workshop in Political Theory and Policy Analysis, Indiana University. He received a BA in Astrophysics from Columbia University, an MS in Earth Resources Engineering from Columbia University, and a JD from the Georgetown University Law Center. After clerking for the Honorable Fred I. Parker of the U.S. Court of Appeals for the Second Circuit and practicing at Wilmer, Cutler & Pickering in Washington, DC, he joined the Loyola University, Chicago law faculty in 2002. ABSTRACT: There is a debate raging concerning the merits of private control over (or conversely, open access to) various types of resources. It takes place in a number of fields, including the intellectual property and cyberlaw literatures, as well as broader public debates concerning propertization, privatization, deregulation, and commercialization of such diverse things as communications networks, government services, national forests and scientific research. On the private control side, there is robust economic theory in support of the market mechanism with minimal government regulation. By contrast, on the open access side, there is a frequent call for protecting the “commons,” but the theoretical support for this prescriptive call is underdeveloped from an economics perspective. In fact, many that oppose propertization, privatization, deregulation, and commercialization view economics (the discipline) with sincere suspicion and doubt. In this short course, Professor Brett Frischmann will discuss insights from his recent book, Infrastructure: The Social Value of Shared Resources (Oxford 2012). He will explain why there are strong economic arguments for managing and sustaining infrastructure resources in an openly accessible manner. Professor Frischmann will help students obtain a better understanding of how these fundamental resources generate value for society and how decisions regarding access to such resources affects social welfare. The key insights from this analysis are that infrastructure resources generate value as inputs into a wide range of productive processes and that the outputs from these processes are often public goods and social goods that generate positive externalities that benefit society as a whole. Managing such resources in an openly accessible manner may be socially desirable from an economic perspective because doing so facilitates these downstream productive activities. For example, managing the Internet infrastructure in an openly accessible manner facilitates active citizen involvement in the production and sharing of public and social goods. Over the past decade, this has led to increased opportunities for a wide range of citizens to engage in entrepreneurship, political discourse, social network formation and community building, among many other activities.
