Cari saluti, oreste ______________________________________________________________________________________________________________________________________ While the debate over the governance of the Internet and the scope of domestic regulations is still open courts have developed various approaches that have resulted in rulings attempting to determine (and sometimes to extend) the scope of national jurisdictions. From this perspective, not only the prescriptive jurisdiction (i.e. the power to establish legal provisions), but also the enforcement jurisdiction (i.e. the power of a court to adjudicate a case and get the enforcement of the relevant decision) was concerned by this debate. The development of a case law related to the Internet advocates the progressive consolidation of a bundle of rules that frames the domestic regimes of the Internet that live together with a Global Regime of the Internet that is instead the result of rulemakers’ efforts to set international principles and norms. The time is ripe to try to bridge the gap between the approach of Internet lawyers and that of constitutional and European scholars concerning the protection of rights in the digital era. It is clearly emerging from the ongoing relevant debate that the topic related to the protection of fundamental rights in the Internet and the judicial enforcement of those rights goes far beyond what are considered the natural borders of the scope of application of Internet law, touching indeed crucial issues at the heart of EU Law, European constitutional law and, more broadly, human rights law. In light of these assumptions, the purpose of the symposium is to discuss the law and jurisprudence of the Internet by injecting into the debate a European and a constitutional “soul” with a view of reconciling the analysis of the relationship between new technologies and fundamental rights with the theoretical debate related to the process of supranational integration.
