prevenzione del terrorismo online: un nuovo regolamento EU
All'avvicinarsi delle elezioni e della scadenza per la trasposizione della Direttiva sul Terrorismo che introduceva obblighi di rimozione dei contenuti terroristici online, la Commissione presenta un nuovo Regolamento che va oltre, andando dalla reazione all'azione preventiva, in linea col trend a introdurre nuove obbligazioni per le piattaforme online come dimostrato dal nostro GC Frosio. Ad illustrare, male, la relazione fra i due strumenti ci pensa questo passaggio della proposta di regolamento: The proposal is also consistent and closely aligned with the Directive (EU) 2017/541 on Combatting Terrorism, the aim of which is to harmonise Member States' legislation criminalising terrorist offences. Article 21 of the Directive on Combating Terrorism requires Member States to take measures ensuring the swift removal of online content limited to public provocation and leaving Member States the choice of the measures. This Regulation, given its preventative nature, covers not only material inciting terrorism but also material for recruitment or training purposes, reflecting other offences related to terrorist activities, which are also covered by Directive (EU) 2017/541. This Regulation directly imposes duties of care on hosting service providers to remove terrorist content and harmonises procedures for removal orders with the aim to reduce accessibility to terrorist content online.
