If it becomes too frictionless, you can slide more easily into a police state. I think we should restore a little bit of that friction." La "fatica" (friction) nel compiere il lavoro di indagine contribuisce a non cadere in uno stato di polizia. Astraendo, dice: vi è un punto in cui un atto socialmente indispensabile e formalmente legittimo può essere ripetuto con una tale facilità ed erga omnes da renderlo sostanzialmente illegittimo. Mi chiedo: quale principio giuridico può essere usato per sostenere questo punto di vista e identificare il punto discriminante? C'è qualcosa di più preciso e forte del principio di proporzionalità?
