The freedom to express and debate ideas is the foundation for all of our rights as a free people. In a country that has long cherished the freedom of expression, we cannot allow a limited number of online platforms to hand pick the speech that Americans may access and convey on the internet. This practice is fundamentally un-American and anti-democratic. When large, powerful social media companies censor opinions with which they disagree, they exercise a dangerous power. They cease functioning as passive bulletin boards, and ought to be viewed and treated as content creators. The growth of online platforms in recent years raises important questions about applying the ideals of the First Amendment to modern communications technology. Today, many Americans follow the news, stay in touch with friends and family, and share their views on current events through social media and other online platforms. As a result, these platforms function in many ways as a 21st century equivalent of the public square. Twitter, Facebook, Instagram, and YouTube wield immense, if not unprecedented, power to shape the interpretation of public events; to censor, delete, or disappear information; and to control what people see or do not see. Quello che diverte di più (si fa per dire) è che questo decreto trumpiano "per combattere la censura su Internet", come la "legge Avia" recentemente approvata qui in Francia, si trasformerà in un investimento fenomenale in moderazione commerciale dei contenuti di siti e media sociali. I media sociali, per evitare liabilities, filtreranno in maniera ancora più forte i loro user generated contents. Gli altri siti che non possono permettersi di pagare team di moderatori di decine di migliaia di persone, cercheranno di comprare questi servizi dai giganti della tech, che potranno boostare il loro business. Questi rischi sono già stati ampiamente sottolineati un anno fa, quando la Legge Avia era ancora in discussione e quando Trump ancora viveva un idillio con Twitter. Era da tempo evidente che quell'irresponsabilità iniziava ed esser indigesta anche in U.S. ma la domanda con cui chiudevo il pezzo mi pare ancora valida: <il punto nodale a mio parere è che a ben vedere non abbiamo neanche chiaro che internet vorremmo davvero, noi europei. Davvero lo Stato e i nostri Tribunali governerebbero meglio la libertà di espressione in rete rispetto alle imprese americane?> Dietro il 230 c'è un mondo, e non a caso ad oggi la Corte Suprema U.S. ha sempre evitato di pronunciarsi, declinando ogni richiesta, in un paese in cui la libertà di espressione è declinata al contrario, in negativo: non è il diritto del singolo di dire, ma il divieto del legislatore di limitare e legiferare sul punto.
