Caro Alberto, l'algoritmo in se' e per se' non e' brevettabile nei paesi che aderiscono al trattato di Monaco (EPC), ma l'algoritmo puo' essere protetto come parte di un'invenzione se ha una finalita' tecnica (v. le EPO guidelines, e.g. https://www.epo.org/law-practice/legal-texts/html/guidelines/e/b_viii_2_2.htm e https://www.epo.org/law-practice/legal-texts/html/caselaw/2016/e/clr_i_d_9_1_8.htm ). Negli Stati Uniti il testo e' diverso (Mayo/Alice) ma i risultati sono molto simili, sia pur con una maggiore facilita' a ottenere un brevetto negli Stati Uniti. Ci sono poi sistemi in cui e' di fatto pressoche' impossibile brevettare algoritmi e.g. le Filippine. Poi il punto e' che il valore di un algoritmo e' spesso nel suo essere segreto, per cui difficilmente troverai Google e Facebook affannarsi a registrare i loro algoritmi.
