Hi Philippe, the decision regards the webpage-administrator that has been sued by SGAE. The web page offers links, not content, and the court acknowledge that by analogising to search engines activity (google), and by affirming that is not an infringement of spanish law that of favouring or addressing users of p2p networks. It's true that the decision also analyses p2p networks (without being asked to do that) but the only relevant thing it says is that SGAE failed to prove what transmitted content SGAE was in charge to administrate, and that it is not possible to retrieve personal information from IP addresses (promusicae). Finally, it's true, it also furnishes a general recognition of what p2p interchange means, but on this aspect, I am afraid (I really am) that the reasoning is quite poor and sometimes contradictory (like when it tries to argue that p2p exchange is not a form of public communication (as described by the law), so much that it ends up reaffirming that in any case, the point is about proving what has been downloaded (something illegal) and who did it (and promusicae stated that there is no obligation for ISP to reveal data connected with IP). Especially because this last point (point 3 of the decision) is kind of weak, and is not what the court has been required to decide, that I wouldn't give much weight to it, but yes on the first part that to me is very interesting, i.e. a site that hosts links and facilitates information on p2p or trackers is not liable for copyright infringement (it would probably be contributory liability). This is not the first time that a Spanish first instance court has decided P2P sharing to be legal under the Spanish flavor of private copying exception. The Spanish law restricts the number of people to whom copies can be (directly) transmitted. The court has remarked that the plaintiffs against P2P usage would have to prove with how many other individuals a given uploader has shared its copy.

in realta' comunque, piu' che sul p2p la sentenza riguarda l'hosting di links a retip2p e tracker, il sito in questione non ospitava alcun materiale, ne pubblicita' e questo e' il motivo esso e' stato assolto...
