Abstract:
The
research seeks to describe the public domain in copyright law not as
consumption of value for which payment has been waived but as a positing
of the activity of thinking as necessarily shared. The research
develops that seemingly novel proposition through analyses of copyright
doctrine and case law from several jurisdictions involving originality,
independent creation, idea/expression dichotomy, transformative use,
merely technical use, and personal use. Rather than a device in
calculations pertinent to wealth-maximization, the public domain is an
affirmation, constitutive of copyright law as a juridical order, of
thinking as radically free.
