It seems to me that the level of protection of network neutrality is somewhat weak (most likely not intentionally, but rather because of a desire to stay on general terms). The terms were just not well picked: The Internet and physical means of traffic on it shall be available to all on uniform, non-discriminatory terms. Internet content should not be prioritised or discriminated against for economic, social, cultural, religious or political reasons. One could still discriminate for technical reasons, discriminate against protocols, services and applications. Possible rewrite: The Internet and its usage for any purpose shall be available to all on uniform, non-discriminatory terms. Information transmitted on the Internet should not be prioritised or discriminated against for any reason other than the temporary management of security or risk of network failure.
