While previous debates were mostly focused on legal basis issues, recent debates in France and some preliminary thinking at European level seem to indicate that a proper delineation of the scope of the right to share digital works will be essential to its recognition. I made a tentative effort at a new formulation of the scope, which does not focus only on defining "non-market" but also on defining sharing as occuring "between individuals". "Between individuals" does not mean private, as sharing on the Internet is public in essence, even though it can be practiced in closed communities. It have produce tentative definitions using the concept of "sovereign control" of individuals between whom the sharing occurs on the storage space of copies.
