Title: Technological and Regulatory Assumptions Behind AI Governance in the EU
Abstract: This talk examines some regulatory assumptions underlying the European Union’s approach to artificial intelligence governance. Focusing primarily on the EU AI Act, it explores how legal definitions of AI, risk categorisation, and compliance obligations reflect particular conceptions of how AI systems are developed, deployed, and controlled. It also considers the regulatory assumptions embedded in enforcement mechanisms, conformity assessments, and governance structures, highlighting potential tensions between static legal frameworks and rapidly evolving technologies. By unpacking these assumptions, the talk aims to clarify the normative choices shaping EU AI regulation and to assess their implications for innovation, legal certainty, justice and effective risk mitigation.
