Cate- Viktor Mayer Schönberger The technologies and data applications of the 21st century are rapidly combining to make data protection based on notice and choice irrelevant. While some might argue that privacy is no longer worth protecting, or that the approaches adopted more than 30 years ago continue to be appropriate today, there is a growing realization across a wide range of stakeholders that protecting privacy is more necessary than ever and that the best way to do so in light of digital technologies is through information use based risk assessments. Assessing the risks — positive and negative — of proposed uses of data according to flexible frameworks that employ clear terms developed and implemented through transparent processes is necessary not merely to reassert the relevance of data protection, but to shift the burden of data protection from individuals to data users, and to ensure that privacy is protected as a fundamental right while valuable data flows are facilitated. The participants in the Data Use and Impact Global Workshop helped to articulate the need for, and value of, the approach, and the practical issues raised by its implementation.
